To the extent practicable, the plan shall be coordinated with the plan developed pursuant to <ref href=\"/us/usc/t20/s9567b/c\">section 9567b(c) of this title</ref> <ref class=\"footnoteRef\" idref=\"fn002116\">1</ref><note type=\"footnote\" id=\"fn002116\"><num>1</num> See References in Text note below.</note> and shall include mechanisms to address early intervention, educational, related service and transitional needs identified by State educational agencies in applications submitted for State personnel development grants under part A and for grants under parts B and C.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a5b3e3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Public comment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall provide a public comment period of not less than 45 days on the plan.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a5b3e4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Distribution of funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In implementing the plan, the Secretary shall, to the extent appropriate, ensure that funds awarded under parts B and C are used to carry out activities that benefit, directly or indirectly, children with the full range of disabilities and of all ages.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a5b3e5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Reports to Congress</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall annually report to Congress on the Secretary’s activities under parts B and C, including an initial report not later than 12 months after <date date=\"2004-12-03\">December 3, 2004</date>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a5b3e6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Assistance authorized</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to award grants to, or enter into contracts or cooperative agreements with, eligible entities to enable the eligible entities to carry out the purposes of such parts in accordance with the comprehensive plan described in subsection (a).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a5b3e7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Special populations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a5b3e8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Application requirement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In making an award of a grant, contract, or cooperative agreement under part B or C, the Secretary shall, as appropriate, require an eligible entity to demonstrate how the eligible entity will address the needs of children with disabilities from minority backgrounds.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82a5b3e9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Required outreach and technical assistance</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding any other provision of this chapter, the Secretary shall reserve not less than 2 percent of the total amount of funds appropriated to carry out parts B and C for either or both of the following activities:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3ea-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/c/2/A\"><num value=\"A\">(A)</num><content> Providing outreach and technical assistance to historically Black colleges and universities, and to institutions of higher education with minority enrollments of not less than 25 percent, to promote the participation of such colleges, universities, and institutions in activities under this part.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3eb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/c/2/B\"><num value=\"B\">(B)</num><content> Enabling historically Black colleges and universities, and the institutions described in subparagraph (A), to assist other colleges, universities, institutions, and agencies in improving educational and transitional results for children with disabilities, if the historically Black colleges and universities and the institutions of higher education described in subparagraph (A) meet the criteria established by the Secretary under this part.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a5b3ec-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Priorities</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary, in making an award of a grant, contract, or cooperative agreement under part B or C, may, without regard to the rulemaking procedures under <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref>, limit competitions to, or otherwise give priority to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a5b3ed-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1\"><num value=\"1\">(1)</num><chapeau> projects that address 1 or more—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3ee-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1/A\"><num value=\"A\">(A)</num><content> age ranges;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3ef-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1/B\"><num value=\"B\">(B)</num><content> disabilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1/C\"><num value=\"C\">(C)</num><content> school grades;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1/D\"><num value=\"D\">(D)</num><content> types of educational placements or early intervention environments;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1/E\"><num value=\"E\">(E)</num><content> types of services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1/F\"><num value=\"F\">(F)</num><content> content areas, such as reading; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/1/G\"><num value=\"G\">(G)</num><content> effective strategies for helping children with disabilities learn appropriate behavior in the school and other community based educational settings;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a5b3f5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/2\"><num value=\"2\">(2)</num><content> projects that address the needs of children based on the severity or incidence of their disability;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a5b3f6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3\"><num value=\"3\">(3)</num><chapeau> projects that address the needs of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/A\"><num value=\"A\">(A)</num><content> low achieving students;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/B\"><num value=\"B\">(B)</num><content> underserved populations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3f9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/C\"><num value=\"C\">(C)</num><content> children from low income families;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3fa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/D\"><num value=\"D\">(D)</num><content> limited English proficient children;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3fb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/E\"><num value=\"E\">(E)</num><content> unserved and underserved areas;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3fc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/F\"><num value=\"F\">(F)</num><content> rural or urban areas;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3fd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/G\"><num value=\"G\">(G)</num><content> children whose behavior interferes with their learning and socialization;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3fe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/H\"><num value=\"H\">(H)</num><content> children with reading difficulties;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b3ff-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/I\"><num value=\"I\">(I)</num><content> children in public charter schools;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b400-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/J\"><num value=\"J\">(J)</num><content> children who are gifted and talented; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82a5b401-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/3/K\"><num value=\"K\">(K)</num><content> children with disabilities served by local educational agencies that receive payments under title VII of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s7701\">20 U.S.C. 7701</ref> et seq.];</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a5b402-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/4\"><num value=\"4\">(4)</num><content> projects to reduce inappropriate identification of children as children with disabilities, particularly among minority children;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a5b403-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/5\"><num value=\"5\">(5)</num><content> projects that are carried out in particular areas of the country, to ensure broad geographic coverage;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a5b404-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/6\"><num value=\"6\">(6)</num><content> projects that promote the development and use of technologies with universal design, assistive technology devices, and assistive technology services to maximize children with disabilities’ access to and participation in the general education curriculum; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82a5b405-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/d/7\"><num value=\"7\">(7)</num><content> any activity that is authorized in part B or C.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82a5b406-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s1481/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Eligibility for financial assistance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No State or local educational agency, or other public institution or agency, may receive a grant or enter into a contract or cooperative agreement under part B or C that relates exclusively to programs, projects, and activities pertaining to children aged 3 through 5, inclusive, unless the State is eligible to receive a grant under <ref href=\"/us/usc/t20/s1419/b\">section
