<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id82a5b40d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482"><num value="1482">§ 1482.</num><heading> Administrative provisions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b40e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a"><num value="a" class="bold">(a)</num><heading class="bold"> Applicant and recipient responsibilities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b40f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Development and assessment of projects</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall require that an applicant for, and a recipient of, a grant, contract, or cooperative agreement for a project under part B or C—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b410-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/1/A"><num value="A">(A)</num><content> involve individuals with disabilities or parents of individuals with disabilities ages birth through 26 in planning, implementing, and evaluating the project; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b411-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/1/B"><num value="B">(B)</num><content> where appropriate, determine whether the project has any potential for replication and adoption by other entities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b412-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Additional responsibilities</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may require a recipient of a grant, contract, or cooperative agreement under part B or C to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b413-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/2/A"><num value="A">(A)</num><content> share in the cost of the project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b414-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/2/B"><num value="B">(B)</num><content> prepare any findings and products from the project in formats that are useful for specific audiences, including parents, administrators, teachers, early intervention personnel, related services personnel, and individuals with disabilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b415-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/2/C"><num value="C">(C)</num><content> disseminate such findings and products; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b416-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/a/2/D"><num value="D">(D)</num><content> collaborate with other such recipients in carrying out subparagraphs (B) and (C).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b417-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b"><num value="b" class="bold">(b)</num><heading class="bold"> Application management</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b418-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Standing panel</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b419-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall establish and use a standing panel of experts who are qualified, by virtue of their training, expertise, or experience, to evaluate each application under part B or C that requests more than $75,000 per year in Federal financial assistance.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b41a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Membership</heading><chapeau style="-uslm-lc:I13" class="indent2">The standing panel shall include, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id82a5b41b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/i"><num value="i">(i)</num><content> individuals who are representatives of institutions of higher education that plan, develop, and carry out high quality programs of personnel preparation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b41c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/ii"><num value="ii">(ii)</num><content> individuals who design and carry out scientifically based research targeted to the improvement of special education programs and services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b41d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/iii"><num value="iii">(iii)</num><content> individuals who have recognized experience and knowledge necessary to integrate and apply scientifically based research findings to improve educational and transitional results for children with disabilities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b41e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/iv"><num value="iv">(iv)</num><content> individuals who administer programs at the State or local level in which children with disabilities participate;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b41f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/v"><num value="v">(v)</num><content> individuals who prepare parents of children with disabilities to participate in making decisions about the education of their children;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b420-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/vi"><num value="vi">(vi)</num><content> individuals who establish policies that affect the delivery of services to children with disabilities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b421-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/vii"><num value="vii">(vii)</num><content> individuals who are parents of children with disabilities ages birth through 26 who are benefiting, or have benefited, from coordinated research, personnel preparation, and technical assistance; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b422-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/B/viii"><num value="viii">(viii)</num><content> individuals with disabilities.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b423-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Term</heading><content><p style="-uslm-lc:I13" class="indent2">No individual shall serve on the standing panel for more than 3 consecutive years.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b424-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Peer-review panels for particular competitions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b425-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Composition</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall ensure that each subpanel selected from the standing panel that reviews an application under part B or C includes—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id82a5b426-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/2/A/i"><num value="i">(i)</num><content> individuals with knowledge and expertise on the issues addressed by the activities described in the application; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id82a5b427-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/2/A/ii"><num value="ii">(ii)</num><content> to the extent practicable, parents of children with disabilities ages birth through 26, individuals with disabilities, and persons from diverse backgrounds.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b428-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Federal employment limitation</heading><content><p style="-uslm-lc:I13" class="indent2">A majority of the individuals on each subpanel that reviews an application under part B or C shall be individuals who are not employees of the Federal Government.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b429-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Use of discretionary funds for administrative purposes</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b42a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Expenses and fees of non-Federal panel members</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may use funds available under part B or C to pay the expenses and fees of the panel members who are not officers or employees of the Federal Government.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id82a5b42b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Administrative support</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may use not more than 1 percent of the funds appropriated to carry out part B or C to pay non-Federal entities for administrative support related to management of applications submitted under part B or C, respectively.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b42c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/c"><num value="c" class="bold">(c)</num><heading class="bold"> Program evaluation</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary may use funds made available to carry out part B or C to evaluate activities carried out under part B or C, respectively.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82a5b42d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/d"><num value="d" class="bold">(d)</num><heading class="bold"> Minimum funding required</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b42e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), the Secretary shall ensure that, for each fiscal year, not less than the following amounts are provided under parts B and C to address the following needs:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b42f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/d/1/A"><num value="A">(A)</num><content> $12,832,000 to address the educational, related services, transitional, and early intervention needs of children with deaf-blindness.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b430-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/d/1/B"><num value="B">(B)</num><content> $4,000,000 to address the postsecondary, vocational, technical, continuing, and adult education needs of individuals with deafness.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82a5b431-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/d/1/C"><num value="C">(C)</num><content> $4,000,000 to address the educational, related services, and transitional needs of children with an emotional disturbance and those who are at risk of developing an emotional disturbance.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82a5b432-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s1482/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Ratable reduction</heading><content><p style="-uslm-lc:I12" class="indent1">If the sum of the amount appropriated to carry out parts B and C, and part E of the Education Sciences Reform Act of 2002 [<ref href="/us/usc/t20/s9567">20 U.S.C. 9567</ref> et seq.] for any fiscal year is less than $130,000,000, the amounts listed in paragraph (1) shall be ratably reduced for the fiscal year.</p>
