<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6c77cdce-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687"><num value="1687">§ 1687.</num><heading> Interpretation of “program or activity”</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this chapter, the term “program or activity” and “program” mean all of the operations of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6c77cdcf-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd0-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/1/A"><num value="A">(A)</num><content> a department, agency, special purpose district, or other instrumentality of a State or of a local government; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd1-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/1/B"><num value="B">(B)</num><content> the entity of such State or local government that distributes such assistance and each such department or agency (and each other State or local government entity) to which the assistance is extended, in the case of assistance to a State or local government;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd2-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd3-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/2/A"><num value="A">(A)</num><content> a college, university, or other postsecondary institution, or a public system of higher education; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd4-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/2/B"><num value="B">(B)</num><content> a local educational agency (as defined in section section <ref class="footnoteRef" idref="fn002117">1</ref><note type="footnote" id="fn002117"><num>1</num> So in original.</note> 7801 of this title), system of vocational education, or other school system;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd5-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd6-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/3/A"><num value="A">(A)</num><chapeau> an entire corporation, partnership, or other private organization, or an entire sole proprietorship—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id6c77cdd7-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/3/A/i"><num value="i">(i)</num><content> if assistance is extended to such corporation, partnership, private organization, or sole proprietorship as a whole; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id6c77cdd8-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/3/A/ii"><num value="ii">(ii)</num><content> which is principally engaged in the business of providing education, health care, housing, social services, or parks and recreation; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id6c77cdd9-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/3/B"><num value="B">(B)</num><content> the entire plant or other comparable, geographically separate facility to which Federal financial assistance is extended, in the case of any other corporation, partnership, private organization, or sole proprietorship; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c77cdda-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s1687/4"><num value="4">(4)</num><content> any other entity which is established by two or more of the entities described in paragraph (1), (2), or (3);</content>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">any part of which is extended Federal financial assistance, except that such term does not include any operation of an entity which is controlled by a religious organization if the application of <ref href="/us/usc/t20/s1681">section 1681 of this title</ref> to such operation would not be consistent with the religious tenets of such organization.</continuation>
