value=\"2323\">§ 2323.</num><heading> Accountability</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b19afb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Purpose</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The purpose of this section is to establish and support State and local performance accountability systems, comprised of the activities described in this section, to assess the effectiveness of the State and the eligible recipients of the State in achieving statewide progress in career and technical education, and to optimize the return of investment of Federal funds in career and technical education activities.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b19afc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> State determined performance measures</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b19afd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each eligible agency, with input from eligible recipients, shall establish State determined performance measures for a State that consist of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82b19afe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/1/A\"><num value=\"A\">(A)</num><content> the core indicators of performance described in subparagraphs (A) and (B) of paragraph (2); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82b19aff-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/1/B\"><num value=\"B\">(B)</num><content> a State determined level of performance described in paragraph (3)(A) for each core indicator of performance.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b19b00-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Indicators of performance</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b19b01-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Core indicators of performance for CTE concentrators at the secondary level</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Each eligible agency shall identify in the State plan core indicators of performance for CTE concentrators at the secondary level that are valid and reliable, and that include, at a minimum, measures of each of the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b02-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/i\"><num value=\"i\">(i)</num><chapeau> The percentage of CTE concentrators who graduate high school, as measured by—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b19b03-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/i/I\"><num value=\"I\">(I)</num><content> the four-year adjusted cohort graduation rate (defined in <ref href=\"/us/usc/t20/s7801\">section 7801 of this title</ref>); and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b19b04-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/i/II\"><num value=\"II\">(II)</num><content> at the State’s discretion, the extended-year adjusted cohort graduation rate defined in such section 7801.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b05-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/ii\"><num value=\"ii\">(ii)</num><content> CTE concentrator proficiency in the challenging State academic standards adopted by the State under <ref href=\"/us/usc/t20/s6311/b/1\">section 6311(b)(1) of this title</ref>, as measured by the academic assessments described in <ref href=\"/us/usc/t20/s6311/b/2\">section 6311(b)(2) of this title</ref>.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b06-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/iii\"><num value=\"iii\">(iii)</num><content> The percentage of CTE concentrators who, in the second quarter after exiting from secondary education, are in postsecondary education or advanced training, military service or a service program that receives assistance under title I of the National and Community Service Act of 1990 (<ref href=\"/us/usc/t42/s12511\">42 U.S.C. 12511</ref> et seq.), are volunteers as described in <ref href=\"/us/usc/t22/s2504/a\">section 2504(a) of title 22</ref>, or are employed.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b07-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/iv\"><num value=\"iv\">(iv)</num><chapeau> Indicators of career and technical education program quality as follows:</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b19b08-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/iv/I\"><num value=\"I\">(I)</num><chapeau> That shall include at least 1 of the following:</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b09-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/iv/I/aa\"><num value=\"aa\">(aa)</num><content> The percentage of CTE concentrators graduating from high school having attained a recognized postsecondary credential.</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b0a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/iv/I/bb\"><num value=\"bb\">(bb)</num><content> The percentage of CTE concentrators graduating from high school having attained postsecondary credits in the relevant career and technical education program or program of study earned through a dual or concurrent enrollment program or another credit transfer agreement.</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b0b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/iv/I/cc\"><num value=\"cc\">(cc)</num><content> The percentage of CTE concentrators graduating from high school having participated in work-based learning.</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b19b0c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/iv/II\"><num value=\"II\">(II)</num><content> That may include any other measure of student success in career and technical education that is statewide, valid, and reliable, and comparable across the State.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b0d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/A/v\"><num value=\"v\">(v)</num><content> The percentage of CTE concentrators in career and technical education programs and programs of study that lead to non-traditional fields.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b19b0e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Core indicators of performance for CTE concentrators at the postsecondary level</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Each eligible agency shall identify in the State plan core indicators of performance for CTE concentrators at the postsecondary level that are valid and reliable, and that include, at a minimum, measures of each of the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b0f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/B/i\"><num value=\"i\">(i)</num><content> The percentage of CTE concentrators who, during the second quarter after program completion, remain enrolled in postsecondary education, are in advanced training, military service, or a service program that receives assistance under title I of the National and Community Service Act of 1990 (<ref href=\"/us/usc/t42/s12511\">42 U.S.C. 12511</ref> et seq.), are volunteers as described in <ref href=\"/us/usc/t22/s2504/a\">section 2504(a) of title 22</ref>, or are placed or retained in employment.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b10-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> The percentage of CTE concentrators who receive a recognized postsecondary credential during participation in or within 1 year of program completion.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b19b11-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/B/iii\"><num value=\"iii\">(iii)</num><content> The percentage of CTE concentrators in career and technical education programs and programs of study that lead to non-traditional fields.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b19b12-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Alignment of performance indicators</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In developing core indicators of performance under subparagraphs (A) and (B), an eligible agency shall, to the greatest extent possible, align the indicators so that substantially similar information gathered for other State and Federal programs, or for any other purpose, may be used to meet the requirements of this section.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b19b13-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> State determined levels of performance</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b19b14-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> State determined levels of performance for core indicators of performance</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b19b15-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id82b19b16-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> Levels determined by the eligible agency</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Each eligible agency, with input from eligible recipients, shall establish in the State plan submitted under <ref href=\"/us/usc/t20/s2342\">section 2342 of this title</ref>, for each year covered by the State plan, State determined levels of performance for each of the core indicators described under subparagraphs (A) and (B) of paragraph (2) for career and technical education activities authorized under this subchapter. The level of performance for a core indicator shall be the same for all CTE concentrators in the State.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id82b19b17-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Technical assistance</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The Secretary may assist an eligible agency in establishing the State determined levels of performance under this subparagraph only at the request of that eligible agency.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id82b19b18-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/III\"><num value=\"III\" class=\"bold\">(III)</num><heading class=\"bold\"> Requirements</heading><chapeau style=\"-uslm-lc:I16\" class=\"indent4\">Such State determined levels of performance shall, at a minimum—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b19-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/III/aa\"><num value=\"aa\">(aa)</num><content> be expressed in a percentage or numerical form, so as to be objective, quantifiable, and measurable;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b1a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/III/bb\"><num value=\"bb\">(bb)</num><content> require the State to continually make meaningful progress toward improving the performance of all career and technical education students, including the subgroups of students described in <ref href=\"/us/usc/t20/s6311/h/1/C/ii\">section 6311(h)(1)(C)(ii) of this title</ref>, and special populations, as described in <ref href=\"/us/usc/t20/s2302/48\">section 2302(48) of this title</ref>; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b1b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/III/cc\"><num value=\"cc\">(cc)</num><content> have been subject to the public comment process described in subparagraph (B), and the eligible agency has provided a written response;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b1c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/III/dd\"><num value=\"dd\">(dd)</num><content> when being adjusted pursuant to clause (ii), take into account how the levels of performance involved compare with the State levels of performance established for other States, considering factors including the characteristics of actual (as opposed to anticipated) CTE concentrators when the CTE concentrators entered the program, and the services or instruction to be provided;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b19b1d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/III/ee\"><num value=\"ee\">(ee)</num><content> when being adjusted pursuant to clause (ii), be higher than the average actual performance of the 2 most recently completed program years, except in the case of unanticipated circumstances that require revisions in accordance with clause (iii); and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b1e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/i/III/ff\"><num value=\"ff\">(ff)</num><content> take into account the extent to which the State determined levels of performance advance the eligible agency’s goals, as set forth in the State plan.</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b1f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Allowable adjustment of State determined levels of performance for subsequent years</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Prior to the third program year covered by the State plan, each eligible agency may revise the State determined levels of performance for any of the core indicators of performance for the subsequent program years covered by the State plan, and submit the revised State determined levels of performance to the Secretary. If the eligible agency adjusts any levels of performance, the eligible agency shall adjust those levels in accordance with clause (i), and address written comments of stakeholders as described in subparagraph (B). The Secretary shall approve those revised levels of performance if those levels meet the requirements described in subclause (III) of clause (i). The State determined adjusted levels of performance identified under this clause shall be considered to be the State determined levels of performance for the State for such years and shall be incorporated into the State plan.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b20-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/A/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Unanticipated circumstances</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If unanticipated circumstances arise in a State or changes occur related to improvements in data or measurement approaches, the eligible agency, at the end of the program year, may revise the State determined levels of performance required under this subparagraph. After public comment, as described in subparagraph (B), the eligible agency shall submit such revised levels of performance to the Secretary with evidence supporting the revision. The Secretary shall approve any such revision if that revision meets the requirements of clause (ii).</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b40b21-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Public comment</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b22-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Each eligible agency shall develop the levels of performance under subparagraph (A) in consultation with the stakeholders identified in <ref href=\"/us/usc/t20/s2342/c/1/A\">section 2342(c)(1)(A) of this title</ref>.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b23-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Written comments</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Not less than 60 days prior to submission of the State plan, the eligible agency shall provide such stakeholders with the opportunity to provide written comments to the eligible agency, which shall be included in the State plan, regarding how the levels of performance described under subparagraph (A)—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b24-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/B/ii/I\"><num value=\"I\">(I)</num><content> meet the requirements of the law;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b25-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/B/ii/II\"><num value=\"II\">(II)</num><content> support the improvement of performance of all CTE concentrators, including subgroups of students, as described in <ref href=\"/us/usc/t20/s6311/h/1/C/ii\">section 6311(h)(1)(C)(ii) of this title</ref>, and special populations, as described in <ref href=\"/us/usc/t20/s2302/48\">section 2302(48) of this title</ref>; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b26-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/B/ii/III\"><num value=\"III\">(III)</num><content> support the needs of the local education and business community.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b27-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Eligible agency response</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Each eligible agency shall provide, in the State plan, a written response to the comments provided by stakeholders under clause (ii).</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b40b28-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> State report</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b29-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Each eligible agency that receives an allotment under <ref href=\"/us/usc/t20/s2321\">section 2321 of this title</ref> shall annually prepare and submit to the Secretary a report regarding—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b2a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/i/I\"><num value=\"I\">(I)</num><content> the progress of the State in achieving the State determined levels of performance on the core indicators of performance; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b2b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/i/II\"><num value=\"II\">(II)</num><content> the actual levels of performance for all CTE concentrators, and for each of the subgroups of students, as described in <ref href=\"/us/usc/t20/s6311/h/1/C/ii\">section 6311(h)(1)(C)(ii) of this title</ref>, and special populations, as described in <ref href=\"/us/usc/t20/s2302/48\">section 2302(48) of this title</ref>.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b2c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Data</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Except as provided in subparagraph (E), each eligible agency that receives an allotment under <ref href=\"/us/usc/t20/s2321\">section 2321 of this title</ref> shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b2d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/I\"><num value=\"I\">(I)</num><chapeau> disaggregate data for each of the indicators of performance under paragraph (2)—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b2e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/I/aa\"><num value=\"aa\">(aa)</num><content> for subgroups of students, as described in <ref href=\"/us/usc/t20/s6311/h/1/C/ii\">section 6311(h)(1)(C)(ii) of this title</ref>, and special populations, as described in <ref href=\"/us/usc/t20/s2302/48\">section 2302(48) of this title</ref>, that are served under this chapter; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b2f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/I/bb\"><num value=\"bb\">(bb)</num><content> by the career and technical education programs or programs of study of the CTE concentrators, except that in a case in which reporting by such program or program of study is impractical, the data may be disaggregated by the career clusters of the CTE concentrators, if appropriate;</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b30-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/II\"><num value=\"II\">(II)</num><content> identify and quantify any disparities or gaps in performance on the State determined levels of performance under subparagraph (A) between any such subgroup or special population and the performance of all CTE concentrators served by the eligible agency under this chapter, which shall include a quantifiable description of the progress each such subgroup or special population of students served by the eligible agency under this chapter has made in meeting the State determined levels of performance; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b31-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/III\"><num value=\"III\">(III)</num><chapeau> for CTE concentrators described in paragraph (2)(A)(iii) and paragraph (2)(B)(i), disaggregate data, to the extent such data is available, by each of the following:</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b32-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/III/aa\"><num value=\"aa\">(aa)</num><content> Individuals enrolled in postsecondary education (disaggregated by postsecondary award level, including certificate, associate, or baccalaureate degree).</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b33-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/III/bb\"><num value=\"bb\">(bb)</num><content> Individuals in advanced training.</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b34-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/III/cc\"><num value=\"cc\">(cc)</num><content> Individuals in military service or a service program that receives assistance under title I of the National and Community Service Act of 1990 (<ref href=\"/us/usc/t42/s12511\">42 U.S.C. 12511</ref> et seq.) or volunteers as described in <ref href=\"/us/usc/t22/s2504/a\">section 2504(a) of title 22</ref>.</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b35-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/ii/III/dd\"><num value=\"dd\">(dd)</num><content> Individuals in employment (including those individuals who are employed in a high-skill, high-wage, or in-demand sector or occupation).</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b36-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Nonduplication</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall ensure that each eligible agency does not report duplicative information under this section.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b37-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Information dissemination</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b38-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/iv/I\"><num value=\"I\">(I)</num><content> make the information contained in such reports available to the general public through a variety of formats, including electronically through the Internet;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b39-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/iv/II\"><num value=\"II\">(II)</num><content> disseminate State-by-State comparisons of the information contained in such reports; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b3a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/C/iv/III\"><num value=\"III\">(III)</num><content> provide the appropriate committees of Congress with copies of such reports.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b40b3b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> State dissemination of actual levels of performance</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">At the end of each program year, the eligible agency shall disseminate the actual levels of performance described in subparagraph (C)(i)(II)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b40b3c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/D/i\"><num value=\"i\">(i)</num><content> widely, including to students, parents, and educators;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b40b3d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/D/ii\"><num value=\"ii\">(ii)</num><content> through a variety of formats, including electronically through the Internet; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82b40b3e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/D/iii\"><num value=\"iii\">(iii)</num><content> in user-friendly formats and languages that are easily accessible, as determined by the eligible agency.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b40b3f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/3/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Rules for reporting data</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The disaggregation of data under this paragraph shall not be required when the number of students in a category is insufficient to yield statistically reliable information or when the results would reveal personally identifiable information about an individual student.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b40b40-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Local levels of performance</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b40b41-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Local levels of performance for core indicators of performance</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b42-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Each eligible recipient shall agree to accept the State determined levels of performance for each year of the plan established under paragraph (3) as local levels of performances, or negotiate with the State to reach agreement on new local levels of performance, for each of the core indicators of performance described in subparagraphs (A) and (B) of paragraph (2) for career and technical education activities authorized under this subchapter. The levels of performance established under this subparagraph shall, at a minimum—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b43-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i/I\"><num value=\"I\">(I)</num><content> be expressed in a percentage or numerical form, consistent with the form expressed in the State determined levels, so as to be objective, quantifiable, and measurable;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b44-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i/II\"><num value=\"II\">(II)</num><content> require the eligible recipient to continually make meaningful progress toward improving the performance of all CTE concentrators, including subgroups of students described in <ref href=\"/us/usc/t20/s6311/h/1/C/ii\">section 6311(h)(1)(C)(ii) of this title</ref> and special populations, as described in <ref href=\"/us/usc/t20/s2302/48\">section 2302(48) of this title</ref>;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b45-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i/III\"><num value=\"III\">(III)</num><content> when being adjusted as described in clause (iii), be higher than the average actual performance levels of the previous 2 program years, except in a case in which unanticipated circumstances arise with respect to the eligible recipient and that eligible recipient meets the requirements for revisions under clause (iv);</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b46-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i/IV\"><num value=\"IV\">(IV)</num><content> when being adjusted as described in clause (iii), take into account how the local levels of performance compare with the local levels of performance established for other eligible recipients, considering factors including the characteristics of actual (as opposed to anticipated) CTE concentrators at the time those CTE concentrators entered the program, and the services or instruction to be provided; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b47-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i/V\"><num value=\"V\">(V)</num><chapeau> set the local levels of performance using valid and reliable data that measures—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b48-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i/V/aa\"><num value=\"aa\">(aa)</num><content> the differences within the State in actual economic conditions (including differences in unemployment rates and job losses or gains in particular industries); and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82b40b49-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/i/V/bb\"><num value=\"bb\">(bb)</num><content> the abilities of the State and the eligible recipient to collect and access valid, reliable, and cost-effective data.</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b4a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Identification in the local application</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Each eligible recipient shall identify, in the local application submitted under <ref href=\"/us/usc/t20/s2354\">section 2354 of this title</ref>, levels of performance for each of the core indicators of performance for each of the program years covered by the local application.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b4b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Allowable adjustments of local levels of performance for subsequent years</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Prior to the third program year covered by the local application, the eligible recipient may, if the eligible recipient reaches an agreement with the eligible agency, adjust the local levels of performance for any of the core indicators of performance for the subsequent program years covered by the local application, in accordance with that agreement and with this subparagraph. The local adjusted levels of performance agreed to under this clause shall be considered to be the local levels of performance for the eligible recipient for such years and shall be incorporated into the local application.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b4c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/A/v\"><num value=\"v\" class=\"bold\">(v)</num><heading class=\"bold\"> <ref class=\"footnoteRef\" idref=\"fn002124\">1</ref><note type=\"footnote\" id=\"fn002124\"><num>1</num> So in original. (iv).</note> Revisions</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If unanticipated circumstances arise, or changes occur related to improvements in data or measurement approaches, the eligible recipient may request that the local levels of performance agreed to under clauses (i) and (iii) be revised. The eligible agency shall issue objective criteria and methods for making such revisions.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b40b4d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Local report</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b4e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Content of report</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Each eligible recipient that receives an allocation described in <ref href=\"/us/usc/t20/s2322\">section 2322 of this title</ref> shall annually prepare and submit to the eligible agency a report, which shall include the data on the actual performance levels described in clause (ii), including the progress of such recipient in achieving the local levels of performance on the core indicators of performance.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b40b4f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Data</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Except as provided in clauses (iii) and (iv), each eligible recipient that receives an allocation described in <ref href=\"/us/usc/t20/s2322\">section 2322 of this title</ref> shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b50-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/B/ii/I\"><num value=\"I\">(I)</num><content> disaggregate data for each of the indicators of performance under paragraph (2) for the subgroups of students described in <ref href=\"/us/usc/t20/s6311/h/1/C/ii\">section 6311(h)(1)(C)(ii) of this title</ref> and <ref href=\"/us/usc/t20/s2302/48\">section 2302(48) of this title</ref> that are served under this chapter;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b51-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/B/ii/II\"><num value=\"II\">(II)</num><content> identify and quantify any disparities or gaps in performance, as described in paragraph 3(C)(ii)(II), between any such category of students as described in subclause (I) (including special populations) and the performance of all CTE concentrators served by the eligible recipient under this chapter.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b40b52-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2323/b/4/B/ii/III\"><num value=\"III\">(III)</num><content> disaggregate data by the career and technical education programs or programs of study of the CTE concentrators, except that in a case in which reporting by such program or program of study is impractical, the data may be disaggregated by the career clusters of the CTE concentrators, if appropriate;
