L. 115–224, title I, § 116, July 31, 2018, 132 Stat. 1599.)","seq_in_title":1043,"parent_identifier":"/us/usc/t20/ch44/schI/ptA","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch44","level":"chapter","num":"CHAPTER 44—","heading":"CAREER AND TECHNICAL EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch44/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"CAREER AND TECHNICAL EDUCATION ASSISTANCE TO THE STATES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch44/schI/ptA","level":"part","num":"Part A—","heading":"Allotment and Allocation","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82b67c2f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327\"><num value=\"2327\">§ 2327.</num><heading> Tribally controlled postsecondary career and technical institutions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c30-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Grant program</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Subject to the availability of appropriations, the Secretary shall make grants under this section, to provide basic support for the education and training of Indian students, to tribally controlled postsecondary career and technical institutions that are not receiving Federal assistance as of the date on which the grant is provided under—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82b67c31-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/a/1\"><num value=\"1\">(1)</num><content> title I of the Tribally Controlled Colleges and Universities Assistance Act of 1978 (<ref href=\"/us/usc/t25/s1802\">25 U.S.C. 1802</ref> et seq.); or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82b67c32-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/a/2\"><num value=\"2\">(2)</num><content> the Navajo Community College Act (<ref href=\"/us/pl/92/189\">Public Law 92–189</ref>; <ref href=\"/us/stat/85/646\">85 Stat. 646</ref>).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c33-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Uses of grants</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Amounts made available under this section shall be used for career and technical education programs for Indian students and for the institutional support costs of the grant, including the expenses described in subsection (e).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c34-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Amount of grants</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c35-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If the sums appropriated for any fiscal year for grants under this section are not sufficient to pay in full the total amount which approved applicants are eligible to receive under this section for such fiscal year, the Secretary shall first allocate to each such applicant who received funds under this part for the preceding fiscal year an amount equal to 100 percent of the product of the per capita payment for the preceding fiscal year and such applicant’s Indian student count for the current program year, plus an amount equal to the actual cost of any increase to the per capita figure resulting from inflationary increases to necessary costs beyond the institution’s control.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c36-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Per capita determination</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For the purposes of paragraph (1), the per capita payment for any fiscal year shall be determined by dividing the amount available for grants to tribally controlled postsecondary career and technical institutions under this section for such program year by the sum of the Indian student counts of such institutions for such program year. The Secretary shall, on the basis of the most accurate data available from the institutions, compute the Indian student count for any fiscal year for which such count was not used for the purpose of making allocations under this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c37-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Indirect costs</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding any other provision of law or regulation, the Secretary shall not require the use of a restricted indirect cost rate for grants issued under this section.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c38-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Applications</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">To be eligible to receive a grant under this section, a tribally controlled postsecondary career and technical institution that is not receiving Federal assistance under title I of the Tribally Controlled Colleges and Universities Assistance Act of 1978 (<ref href=\"/us/usc/t25/s1802\">25 U.S.C. 1802</ref> et seq.) or the Navajo Community College Act (<ref href=\"/us/pl/92/189\">Public Law 92–189</ref>; <ref href=\"/us/stat/85/646\">85 Stat. 646</ref>) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c39-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Expenses</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c3a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall, subject to the availability of appropriations, provide for each program year to each tribally controlled postsecondary career and technical institution having an application approved by the Secretary, an amount necessary to pay expenses associated with—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82b67c3b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/e/1/A\"><num value=\"A\">(A)</num><content> the maintenance and operation of the program, including development costs, costs of basic and special instruction (including special programs for individuals with disabilities and academic instruction), materials, student costs, administrative expenses, boarding costs, transportation, student services, daycare and family support programs for students and their families (including contributions to the costs of education for dependents), and student stipends;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82b67c3c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/e/1/B\"><num value=\"B\">(B)</num><content> capital expenditures, including operations and maintenance, and minor improvements and repair, and physical plant maintenance costs, for the conduct of programs funded under this section;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82b67c3d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/e/1/C\"><num value=\"C\">(C)</num><content> costs associated with repair, upkeep, replacement, and upgrading of the instructional equipment; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82b67c3e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/e/1/D\"><num value=\"D\">(D)</num><content> institutional support of career and technical education.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c3f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Accounting</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each institution receiving a grant under this section shall provide annually to the Secretary an accurate and detailed accounting of the institution’s operating and maintenance expenses and such other information concerning costs as the Secretary may reasonably require.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c40-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Other programs</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c41-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as specifically provided in this chapter, eligibility for assistance under this section shall not preclude any tribally controlled postsecondary career and technical institution from receiving Federal financial assistance under any program authorized under the Higher Education Act of 1965 [<ref href=\"/us/usc/t20/s1001\">20 U.S.C. 1001</ref> et seq.], or under any other applicable program for the benefit of institutions of higher education or career and technical education.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c42-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Prohibition on alteration of grant amount</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The amount of any grant for which tribally controlled postsecondary career and technical institutions are eligible under this section shall not be altered because of funds allocated to any such institution from funds appropriated under <ref href=\"/us/usc/t25/s13\">section 13 of title 25</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c43-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/f/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Prohibition on contract denial</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No tribally controlled postsecondary career and technical institution for which an Indian Tribe has designated a portion of the funds appropriated for the Tribe from funds appropriated under <ref href=\"/us/usc/t25/s13\">section 13 of title 25</ref>, may be denied a contract for such portion under the Indian Self-Determination and Education Assistance Act [<ref href=\"/us/usc/t25/s5301\">25 U.S.C. 5301</ref> et seq.] (except as provided in that Act), or denied appropriate contract support to administer such portion of the appropriated funds.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c44-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Complaint resolution procedure</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall establish (after consultation with tribally controlled postsecondary career and technical institutions) a complaint resolution procedure for grant determinations and calculations under this section for tribally controlled postsecondary career and technical institutions.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c45-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c46-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Indian; Indian Tribe</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The terms “Indian” and “Indian Tribe” have the meanings given the terms “Indian” and “Indian tribe”, respectively, in section 2 of the Tribally Controlled Colleges and Universities Assistance Act of 1978 (<ref href=\"/us/usc/t25/s1801\">25 U.S.C. 1801</ref>).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82b67c47-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Indian student count</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b67c48-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “Indian student count” means a number equal to the total number of Indian students enrolled in each tribally controlled postsecondary career and technical institution, as determined in accordance with subparagraph (B).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82b67c49-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Determination</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b67c4a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Enrollment</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">For each academic year, the Indian student count shall be determined on the basis of the enrollments of Indian students as in effect at the conclusion of—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b67c4b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/i/I\"><num value=\"I\">(I)</num><content> in the case of the fall term, the third week of the fall term; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b67c4c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/i/II\"><num value=\"II\">(II)</num><content> in the case of the spring term, the third week of the spring term.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b67c4d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Calculation</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">For each academic year, the Indian student count for a tribally controlled postsecondary career and technical institution shall be the quotient obtained by dividing—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b67c4e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/ii/I\"><num value=\"I\">(I)</num><content> the sum of the credit hours of all Indian students enrolled in the tribally controlled postsecondary career and technical institution (as determined under clause (i)); by</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82b67c4f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/ii/II\"><num value=\"II\">(II)</num><content> 12.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b67c50-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Summer term</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Any credit earned in a class offered during a summer term shall be counted in the determination of the Indian student count for the succeeding fall term.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b67c51-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Students without secondary school degrees</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id82b67c52-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/iv/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">A credit earned at a tribally controlled postsecondary career and technical institution by any Indian student that has not obtained a secondary school degree (or the recognized equivalent of such a degree) shall be counted toward the determination of the Indian student count if the institution at which the student is enrolled has established criteria for the admission of the student on the basis of the ability of the student to benefit from the education or training of the institution.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id82b67c53-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/iv/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Presumption</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">The institution shall be presumed to have established the criteria described in subclause (I) if the admission procedures for the institution include counseling or testing that measures the aptitude of a student to successfully complete a course in which the student is enrolled.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id82b67c54-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/iv/III\"><num value=\"III\" class=\"bold\">(III)</num><heading class=\"bold\"> Credits toward secondary school degree</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">No credit earned by an Indian student for the purpose of obtaining a secondary school degree (or the recognized equivalent of such a degree) shall be counted toward the determination of the Indian student count under this clause.</p>\n</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82b67c55-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/h/2/B/v\"><num value=\"v\" class=\"bold\">(v)</num><heading class=\"bold\"> Continuing education programs</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Any credit earned by an Indian student in a continuing education program of a tribally controlled postsecondary career and technical institution shall be included in the determination of the sum of all credit hours of the student if the credit is converted to a credit hour basis in accordance with the system of the institution for providing credit for participation in the program.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82b67c56-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Authorization of appropriations</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">There are authorized to be appropriated to carry out this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82b67c57-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/i/1\"><num value=\"1\">(1)</num><content> $9,762,539 for fiscal year 2019;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82b67c58-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/i/2\"><num value=\"2\">(2)</num><content> $9,899,215 for fiscal year 2020;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82b67c59-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s2327/i/3\"><num value=\"3\">(3)</num><content> $10,037,804 for fiscal year 2021;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\"
