<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id82bb3776-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353"><num value="2353">§ 2353.</num><heading> Special rules for career and technical education</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82bb3777-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/a"><num value="a" class="bold">(a)</num><heading class="bold"> Special rule for minimal allocation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82bb3778-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> General authority</heading><chapeau style="-uslm-lc:I12" class="indent1">Notwithstanding the provisions of sections 2351 and 2352 of this title and in order to make a more equitable distribution of funds for programs serving the areas of greatest economic need, for any program year for which a minimal amount is made available by an eligible agency for distribution under section 2351 or 2352 of this title, such eligible agency may distribute such minimal amount for such year—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82bb3779-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/a/1/A"><num value="A">(A)</num><content> on a competitive basis; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82bb377a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/a/1/B"><num value="B">(B)</num><content> through any alternative method determined by the eligible agency.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82bb377b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Minimal amount</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of this section, the term “minimal amount” means not more than 15 percent of the total amount made available for distribution under <ref href="/us/usc/t20/s2322/a/1">section 2322(a)(1) of this title</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82bb377c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/b"><num value="b" class="bold">(b)</num><heading class="bold"> Redistribution</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82bb377d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In any academic year that an eligible recipient does not expend all of the amounts the eligible recipient is allocated for such year under section 2351 or 2352 of this title, such eligible recipient shall return any unexpended amounts to the eligible agency to be reallocated under section 2351 or 2352 of this title, as appropriate.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82bb377e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Redistribution of amounts returned late in an academic year</heading><content><p style="-uslm-lc:I12" class="indent1">In any academic year in which amounts are returned to the eligible agency under section 2351 or 2352 of this title and the eligible agency is unable to reallocate such amounts according to such sections in time for such amounts to be expended in such academic year, the eligible agency shall retain such amounts for distribution in combination with amounts provided under <ref href="/us/usc/t20/s2322/a/1">section 2322(a)(1) of this title</ref> for the following academic year.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82bb377f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/c"><num value="c" class="bold">(c)</num><heading class="bold"> Construction</heading><chapeau style="-uslm-lc:I11" class="indent0">Nothing in section 2351 or 2352 of this title shall be construed—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id82bb3780-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/c/1"><num value="1">(1)</num><content> to prohibit a local educational agency or a consortium thereof that receives assistance under <ref href="/us/usc/t20/s2351">section 2351 of this title</ref>, from working with an eligible institution or consortium thereof that receives assistance under <ref href="/us/usc/t20/s2352">section 2352 of this title</ref>, to carry out career and technical education programs or programs of study at the secondary level in accordance with this subchapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82bb3781-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/c/2"><num value="2">(2)</num><content> to prohibit an eligible institution or consortium thereof that receives assistance under <ref href="/us/usc/t20/s2352">section 2352 of this title</ref>, from working with a local educational agency or consortium thereof that receives assistance under <ref href="/us/usc/t20/s2351">section 2351 of this title</ref>, to carry out postsecondary and adult career and technical education programs or programs of study in accordance with this subchapter; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82bb3782-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/c/3"><num value="3">(3)</num><content> to require a charter school, that provides career and technical education programs or programs of study and is considered a local educational agency under State law, to jointly establish the charter school’s eligibility for assistance under this subchapter unless the charter school is explicitly permitted to do so under the State’s charter school statute.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82bb3783-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s2353/d"><num value="d" class="bold">(d)</num><heading class="bold"> Consistent application</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of this section, the eligible agency shall provide funds to charter schools offering career and technical education programs or programs of study in the same manner as the eligible agency provides those funds to other schools. Such career and technical education programs or programs of study within a charter school shall be of sufficient size, scope, and quality to be effective.</p>
