L. 101–509, title V, § 529 [title I, § 112(a)(3)(A)], Nov. 5, 1990, 104 Stat. 1427, 1454.)","seq_in_title":1154,"parent_identifier":"/us/usc/t20/ch48/schI","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch48","level":"chapter","num":"CHAPTER 48—","heading":"DEPARTMENT OF EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch48/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id6c8f4d5c-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404\"><num value=\"3404\">§ 3404.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this chapter, unless otherwise provided or indicated by the context—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c8f4d5d-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404/1\"><num value=\"1\">(1)</num><content> the term “Department” means the Department of Education or any component thereof;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c8f4d5e-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404/2\"><num value=\"2\">(2)</num><content> the term “Secretary” means the Secretary of Education;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c8f4d5f-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404/3\"><num value=\"3\">(3)</num><content> the term “Deputy Secretary” means the Deputy Secretary of Education;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c8f4d60-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404/4\"><num value=\"4\">(4)</num><content> the term “function” includes any duty, obligation, power, authority, responsibility, right, privilege, activity, or program;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c8f4d61-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404/5\"><num value=\"5\">(5)</num><content> the term “State” includes the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, and the Trust Territory of the Pacific Islands;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c8f4d62-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404/6\"><num value=\"6\">(6)</num><content> the terms “private” and “private educational” refer to independent, nonpublic, and private institutions of elementary, secondary, and postsecondary education; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c8f4d63-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3404/7\"><num value=\"7\">(7)</num><content> the term “office” includes any office, institute, council, unit, organizational entity, or component thereof.</content>\n</paragraph>\n<sourceCredit id=\"id6c8f4d64-d2f2-11e9-aa7d-f436298d01bb\">(<ref href=\"/us/pl/96/88/tI/s104\">Pub. L. 101–509, title V, § 529 [title I, § 112(e)]</ref>, <date date=\"1990-11-05\">Nov. 5, 1990</date>, <ref href=\"/us/stat/104/1427\">104 Stat. 1427</ref>, 1455, provided that:<quotedContent origin=\"/us/pl/101/509/tV/s529/tI/s112/e\">\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">“(1)</num><content> This section [amending this section, <ref href=\"/us/usc/t20/s3412\">section 3412 of this title</ref>, sections 5313 and 5314 of Title 5, Government Organization and Employees, <ref href=\"/us/usc/t25/s472a\">section 472a of Title 25</ref>, Indians, <ref href=\"/us/usc/t42/s3533\">section 3533 of Title 42</ref>, The Public Health and Welfare, and <ref href=\"/us/usc/t43/s1452\">section 1452 of Title 43</ref>, Public Lands and enacting provisions set out as notes under this section and <ref href=\"/us/usc/t42/s3501\">section 3501 of Title 42</ref>] shall take effect on the first day of the first pay period that begins on or after the date of enactment of this Act [<date date=\"1990-11-05\">Nov. 5, 1990</date>].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"A\">(A)</num><content> The incumbent in the position of Under Secretary of Health and Human Services on the day immediately preceding the date this section takes effect may serve as Deputy Secretary of Health and Human Services at the pleasure of the President after such day.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"B\">“(B)</num><content> The incumbent in the position of Under Secretary of the Interior on the day immediately preceding the date this section takes effect may serve as Deputy Secretary of the Interior at the pleasure of the President after such day.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"C\">“(C)</num><content> The incumbent in the position of Under Secretary of Education on the day immediately preceding the date this section takes effect may serve as Deputy Secretary of Education at the pleasure of the President after such day.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"D\">“(D)</num><content> The incumbent in the position of Under Secretary of Housing and Urban Development on the day immediately preceding the date this section takes effect may serve as Deputy Secretary of Housing and Urban Development at the pleasure of the President after such day.”</content>\n</subparagraph>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id6c8f7478-d2f2-11e9-aa7d-f436298d01bb\"><heading class=\"centered smallCaps\">Construction of References</heading><p><ref href=\"/us/pl/101/509/tV/s529/tI/s112/c\">Pub.
