<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id82cbd8e8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c"><num value="3423c">§ 3423c.</num><heading> Office of Indian Education</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82cbd8e9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/a"><num value="a" class="bold">(a)</num><heading class="bold"> Office of Indian Education</heading><content><p style="-uslm-lc:I11" class="indent0">There shall be an Office of Indian Education (referred to in this section as “the Office”) in the Department of Education.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82cbd8ea-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/b"><num value="b" class="bold">(b)</num><heading class="bold"> Director</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82cbd8eb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Appointment and reporting</heading><content><p style="-uslm-lc:I12" class="indent1">The Office shall be under the direction of the Director, who shall be appointed by the Secretary and who shall report directly to the Assistant Secretary for Elementary and Secondary Education.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82cbd8ec-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I12" class="indent1">The Director shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82cbd8ed-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/b/2/A"><num value="A">(A)</num><content> be responsible for administering part A of title VI of the Elementary and Secondary Education Act of 1965 [<ref href="/us/usc/t20/s7401">20 U.S.C. 7401</ref> et seq.];</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82cbd8ee-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/b/2/B"><num value="B">(B)</num><content> be involved in, and be primarily responsible for, the development of all policies affecting Indian children and adults under programs administered by the Office of Elementary and Secondary Education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82cbd8ef-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/b/2/C"><num value="C">(C)</num><content> coordinate the development of policy and practice for all programs in the Department relating to Indian persons; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82cbd8f0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/b/2/D"><num value="D">(D)</num><content> assist the Assistant Secretary of the Office of Educational Research and Improvement in identifying research priorities related to the education of Indian persons.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82cbd8f1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/c"><num value="c" class="bold">(c)</num><heading class="bold"> Indian preference in employment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82cbd8f2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3423c/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall give a preference to Indian persons in all personnel actions in the Office.</p>
