L. 103–382, title II, § 271(a)(2), Oct. 20, 1994, 108 Stat. 3929.)","seq_in_title":1179,"parent_identifier":"/us/usc/t20/ch48/schIII","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch48","level":"chapter","num":"CHAPTER 48—","heading":"DEPARTMENT OF EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch48/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"TRANSFERS OF AGENCIES AND FUNCTIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id6c93ba6b-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444\"><num value=\"3444\">§ 3444.</num><heading> Transfer of programs from National Science Foundation</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6c93ba6c-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Science education; exceptions</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6c93ba6d-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a/1\"><num value=\"1\">(1)</num><chapeau> There are transferred to the Secretary all programs relating to science education of the National Science Foundation or the Director of the National Science Foundation established prior to <date date=\"1980-05-04\">May 4, 1980</date>, pursuant to the National Science Foundation Act of 1950 [<ref href=\"/us/usc/t42/s1861\">42 U.S.C. 1861</ref> et seq.], except the programs or parts of programs, as determined after review by the Director of the Office of Science and Technology Policy and the Director of the National Science Foundation, which relate to—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c93ba6e-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a/1/A\"><num value=\"A\">(A)</num><content> scientific career development;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c93ba6f-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a/1/B\"><num value=\"B\">(B)</num><content> the continuing education of scientific personnel;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c93ba70-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a/1/C\"><num value=\"C\">(C)</num><content> increasing the participation of women, minorities, and the handicapped in careers in science;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c93ba71-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a/1/D\"><num value=\"D\">(D)</num><content> the conduct of basic and applied research and development applied to science learning at all educational levels and the dissemination of results concerning such research and development; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6c93ba72-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a/1/E\"><num value=\"E\">(E)</num><content> informing the general public of the nature of science and technology and of attendant values and public policy issues.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6c93ba73-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/a/2\"><num value=\"2\">(2)</num><content> Except as provided in paragraph (1), no mission oriented research functions or programs of the National Science Foundation or any other Federal agency shall be transferred by this chapter.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6c93ba74-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Authority of Secretary; consultation and advice</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized to conduct the programs transferred by subsection (a). In conducting such programs the Secretary shall consult, as appropriate, with the Director of the National Science Foundation, and shall establish advisory mechanisms designed to assure that scientists and engineers are fully involved in the development, implementation, and review of science education programs.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6c93e185-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Report by Secretary</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The annual report to be transmitted by the Secretary pursuant to <ref href=\"/us/usc/t20/s3486\">section 3486 of this title</ref> shall include a description of arrangements, developed by the Secretary in consultation with the Director of the National Science Foundation, for coordinated planning and operation of science education programs, including measures to facilitate the implementations of successful innovations.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id6c93e186-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s3444/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Reservation of certain Foundation authority</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section is intended to repeal or limit the authority of the National Science Foundation or the Director of the National Science Foundation to initiate and conduct programs under the National Science Foundation Act of 1950 [<ref href=\"/us/usc/t42/s1861\">42 U.S.C. 1861</ref> et seq.].</p>\n</content>\n</subsection>\n<sourceCredit id=\"id6c93e187-d2f2-11e9-aa7d-f436298d01bb\">(<ref href=\"/us/pl/96/88/tIII/s303\">Pub.
