<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6c97b1e1-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610"><num value="3610">§ 3610.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For purposes of this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1e2-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/1"><num value="1">(1)</num><chapeau> the term “asbestos” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1e3-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/1/A"><num value="A">(A)</num><content> chrysotile, amosite, or crocidolite; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1e4-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/1/B"><num value="B">(B)</num><content> in fibrous form, tremolite, anthophyllite, or actinolite;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1e5-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/2"><num value="2">(2)</num><content> the term “Attorney General” means the Attorney General of the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1e6-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/3"><num value="3">(3)</num><content> the term “imminent hazard to the health and safety” means, for purposes of <ref href="/us/usc/t20/s3605">section 3605 of this title</ref>, that an asbestos material is, according to standards established by the Secretary, friable or easily damaged, or within easy reach of students or otherwise susceptible to damage (including damage from water or air circulation) which could result in the dispersal of asbestos fibers into the school environment;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1e7-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/4"><num value="4">(4)</num><chapeau> the term “local educational agency” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1e8-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/4/A"><num value="A">(A)</num><content> any local educational agency as defined in section 198(a)(10) <ref class="footnoteRef" idref="fn002139">1</ref><note type="footnote" id="fn002139"><num>1</num> See References in Text note below.</note> of the Elementary and Secondary Education Act of 1965;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1e9-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/4/B"><num value="B">(B)</num><content> the governing authority of any nonprofit elementary or secondary school;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1ea-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/5"><num value="5">(5)</num><chapeau> the term “nonprofit elementary or secondary school” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1eb-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/5/A"><num value="A">(A)</num><content> any elementary or secondary school (as defined in section 198(a)(7) <sup>1</sup> of the Elementary and Secondary Education Act of 1965) owned and operated by one or more nonprofit corporations or associations no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1ec-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/5/B"><num value="B">(B)</num><content> any school of any agency of the United States;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1ed-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/6"><num value="6">(6)</num><chapeau> the term “school buildings” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1ee-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/6/A"><num value="A">(A)</num><content> structures suitable for use as classrooms, laboratories, libraries, school eating facilities, or facilities used for the preparation of food;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1ef-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/6/B"><num value="B">(B)</num><content> any gymnasium or other facility which is specially designed for athletic or recreational activities for an academic course in physical education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1f0-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/6/C"><num value="C">(C)</num><content> other facilities used for the instruction of students, for research, or for the administration of educational or research programs; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c97b1f1-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/6/D"><num value="D">(D)</num><content> maintenance, storage, or utility facilities essential to the operation of the facilities described in subparagraphs (A) through (C) of this paragraph;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1f2-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/7"><num value="7">(7)</num><content> the term “Secretary” means the Secretary of Education, or his designee;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1f3-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/8"><num value="8">(8)</num><content> the term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, the Bureau of Indian Affairs, and the Office of Overseas Schools of the Department of Defense; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id6c97b1f4-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s3610/9"><num value="9">(9)</num><content> the term “State educational agency” has the same meaning given such term by section 198(a)(17) <sup>1</sup> of the Elementary and Secondary Education Act of 1965.</content>
