<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id82d575fb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998"><num value="3998">§ 3998.</num><heading> Computation of grant amounts</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82d575fc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/a"><num value="a" class="bold">(a)</num><heading class="bold"> Payments to grantees</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82d575fd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Payment by State</heading><content><p style="-uslm-lc:I12" class="indent1">The State shall pay to the extent of amounts received by it from the Secretary under this part, to each applicant having an application approved under <ref href="/us/usc/t20/s3997">section 3997 of this title</ref>, the Federal share of the cost of the program described in the application.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82d575fe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Amount</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id82d575ff-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/a/2/A"><num value="A">(A)</num><content> Except as provided in subparagraph (B), the Federal share for each fiscal year shall be 75 percent.</content>

<subparagraph style="-uslm-lc:I12" class="indent1" id="id82d57600-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/a/2/B"><num value="B">(B)</num><content> In the case of an applicant that receives a waiver under <ref href="/us/usc/t20/s3995/c">section 3995(c) of this title</ref>, the Federal share for each fiscal year may be as much as 100 percent.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82d57601-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Non-Federal share</heading><content><p style="-uslm-lc:I12" class="indent1">The non-Federal share of payments under this part may be in cash or in kind, fairly evaluated, including plant, equipment, or services.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82d57602-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/b"><num value="b" class="bold">(b)</num><heading class="bold"> Payments to States</heading><chapeau style="-uslm-lc:I11" class="indent0">Except as provided in subsection (c), each State shall receive under this part the greater of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id82d57603-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/b/1"><num value="1">(1)</num><content> an amount equal to its share of funds appropriated under chapter 1 of the Education Consolidation and Improvement Act; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82d57604-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/b/2"><num value="2">(2)</num><content> $225,000.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82d57605-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s3998/c"><num value="c" class="bold">(c)</num><heading class="bold"> Reduction for insufficient funding</heading><content><p style="-uslm-lc:I11" class="indent0">If sums appropriated to carry out this part are not sufficient to permit the Secretary to pay in full the grants which States may receive under subsection (b), the amount of such grants shall be ratably reduced.</p>
