<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6c9c6c3b-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020"><num value="4020">§ 4020.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For purposes of this subchapter:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c3c-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/1"><num value="1">(1)</num><chapeau> The term “asbestos” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c3d-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/1/A"><num value="A">(A)</num><content> chrysotile, amosite, or crocidolite; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c3e-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/1/B"><num value="B">(B)</num><content> in fibrous form, tremolite, anthophyllite, or actinolite.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c3f-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/2"><num value="2">(2)</num><content> The term “Attorney General” means the Attorney General of the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c40-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/3"><num value="3">(3)</num><content> The term “threat” or “hazard” means that an asbestos material is friable or easily damaged, or within reach of students or employees or otherwise susceptible to damage (including damage from water, vibration, or air circulation) which could result in the dispersal of asbestos fibers into the school environment.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c41-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/4"><num value="4">(4)</num><chapeau> The term “local educational agency” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c42-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/4/A"><num value="A">(A)</num><content> any local educational agency as defined in <ref href="/us/usc/t20/s7801">section 7801 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c43-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/4/B"><num value="B">(B)</num><content> the governing authority of any nonprofit elementary or secondary school.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c44-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/5"><num value="5">(5)</num><chapeau> The term “nonprofit elementary or secondary school” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c45-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/5/A"><num value="A">(A)</num><content> any elementary school or secondary school as defined in <ref href="/us/usc/t20/s7801">section 7801 of this title</ref> owned and operated by one or more nonprofit corporations or associations no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c46-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/5/B"><num value="B">(B)</num><content> any school of any agency of the United States.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c47-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/6"><num value="6">(6)</num><chapeau> The term “school buildings” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c48-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/6/A"><num value="A">(A)</num><content> structures suitable for use as classrooms, laboratories, libraries, school eating facilities, or facilities used for the preparation of food;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c49-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/6/B"><num value="B">(B)</num><content> any gymnasium or other facility which is specially designed for athletic or recreational activities for an academic course in physical education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c4a-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/6/C"><num value="C">(C)</num><content> other facilities used for the instruction of students, for research, or for the administration of educational or research programs; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6c9c6c4b-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/6/D"><num value="D">(D)</num><content> maintenance, storage, or utility facilities essential to the operation of the facilities described in subparagraphs (A) through (C) of this paragraph.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c4c-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/7"><num value="7">(7)</num><content> The term “Administrator” means the Administrator of the Environmental Protection Agency, or the Administrator’s designee.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id6c9c6c4d-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s4020/8"><num value="8">(8)</num><content> The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and the Bureau of Indian Affairs.</content>
