<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id82da30fe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353"><num value="4353">§ 4353.</num><heading> Audit</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82da30ff-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/a"><num value="a" class="bold">(a)</num><heading class="bold"> Government Accountability Office authority</heading><chapeau style="-uslm-lc:I11" class="indent0">All financial transactions and accounts of the corporation or institution of higher education, as the case may be, in connection with the expenditure of any moneys appropriated by any law of the United States—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id82da3100-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/a/1"><num value="1">(1)</num><content> for the benefit of Gallaudet University or for the construction of facilities for its use; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82da3101-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/a/2"><num value="2">(2)</num><content> for the benefit of the National Technical Institute for the Deaf or for the construction of facilities for its use,</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82da3102-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/b"><num value="b" class="bold">(b)</num><heading class="bold"> Independent financial and compliance audit</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82da3103-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Gallaudet University shall have an annual independent financial and compliance audit made of the programs and activities of the University, including the national mission and school operations of the elementary and secondary education programs at Gallaudet. The institution of higher education with which the Secretary has an agreement under <ref href="/us/usc/t20/s4332">section 4332 of this title</ref> shall have an annual independent financial and compliance audit made of the programs and activities of such institution of higher education, including NTID, and containing specific schedules and analyses for all NTID funds, as determined by the Secretary.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82da3105-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Submission of audits</heading><content><p style="-uslm-lc:I12" class="indent1">A copy of each audit described in paragraph (1) shall be provided to the Secretary and the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate within 15 days of acceptance of the audit by the University or the institution authorized to establish and operate the NTID under <ref href="/us/usc/t20/s4332/a">section 4332(a) of this title</ref>, as the case may be, but not later than January 10 of each year.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82da3106-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limitations regarding expenditure of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82da3107-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">No funds appropriated under this chapter for Gallaudet University, including the Kendall Demonstration Elementary School and the Model Secondary School for the Deaf, or for the National Technical Institute for the Deaf may be expended on the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82da3108-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/1/A"><num value="A">(A)</num><content> Alcoholic beverages.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82da3109-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/1/B"><num value="B">(B)</num><content> Goods or services for personal use.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82da310a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/1/C"><num value="C">(C)</num><content> Housing and personal living expenses (but only to the extent such expenses are not required by written employment agreement).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82da310b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/1/D"><num value="D">(D)</num><content> Lobbying, except that nothing in this subparagraph shall be construed to prohibit the University and NTID from educating the Congress, the Secretary, and others regarding programs, projects, and activities conducted at those institutions.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82da310c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/1/E"><num value="E">(E)</num><content> Membership in country clubs and social or dining clubs and organizations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82da310d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Policies</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="id82da310e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/A"><num value="A">(A)</num><content> Not later than 180 days after <date date="1992-10-16">October 16, 1992</date>, the University and NTID shall develop policies, to be applied uniformly, for the allowability of expenditures for each institution. These policies should reflect the unique nature of these institutions. The principles established by the Office of Management and Budget for costs of educational institutions may be used as guidance in developing these policies. General principles relating to allowability and reasonableness of all costs associated with the operations of the institutions shall be addressed. These policies shall be submitted to the Secretary for review and comments, and to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82da310f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B"><num value="B">(B)</num><chapeau> Policies under subparagraph (A) shall include the following:</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id82da3110-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/i"><num value="i">(i)</num><content> Noninstitutional professional activities.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82da3111-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/ii"><num value="ii">(ii)</num><content> Fringe benefits.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82da3112-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/iii"><num value="iii">(iii)</num><content> Interest on loans.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82da3113-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/iv"><num value="iv">(iv)</num><content> Rental cost of buildings and equipment.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82da3114-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/v"><num value="v">(v)</num><content> Sabbatical leave.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82da3115-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/vi"><num value="vi">(vi)</num><content> Severance pay.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82da3116-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/vii"><num value="vii">(vii)</num><content> Travel.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82da3117-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4353/c/2/B/viii"><num value="viii">(viii)</num><content> Royalties and other costs for uses of patents.</content>
