<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id82deebea-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441"><num value="4441">§ 4441.</num><heading> Program for Native Hawaiian and Alaska Native culture and arts development</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82deebeb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary of the Interior is authorized to make grants for the purpose of supporting programs for Native Hawaiian or Alaska Native culture and arts development to any private, nonprofit organization or institution which—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id82deebec-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/a/1"><num value="1">(1)</num><content> primarily serves and represents Native Hawaiians or Alaska Natives, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82deebed-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/a/2"><num value="2">(2)</num><content> has been recognized by the Governor of the State of Hawaii or the Governor of the State of Alaska, as appropriate, for the purpose of making such organization or institution eligible to receive such grants.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82deebee-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/b"><num value="b" class="bold">(b)</num><heading class="bold"> Purpose of grants</heading><chapeau style="-uslm-lc:I11" class="indent0">Grants made under subsection (a) shall, to the extent deemed possible by the Secretary and the recipient of the grant, be used—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id82deebef-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/b/1"><num value="1">(1)</num><content> to provide scholarly study of, and instruction in, Native Hawaiian or Alaska Native art and culture,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82deebf0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/b/2"><num value="2">(2)</num><content> to establish programs which culminate in the awarding of degrees in the various fields of Native Hawaiian or Alaska Native art and culture, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82deebf1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/b/3"><num value="3">(3)</num><content> to establish centers and programs with respect to Native Hawaiian or Alaska Native art and culture that are similar in purpose to the centers and programs described in subsections (b) and (c) of <ref href="/us/usc/t20/s4417">section 4417 of this title</ref>.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82deebf2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c"><num value="c" class="bold">(c)</num><heading class="bold"> Management of grants</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id82deebf3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/1"><num value="1">(1)</num><content> Any organization or institution which is the recipient of a grant made under subsection (a) shall establish a governing board to manage and control the program with respect to which such grant is made.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id82deebf4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/2"><num value="2">(2)</num><chapeau> For any grants made with respect to Native Hawaiian art and culture, the members of the governing board which is required to be established under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebf5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/2/A"><num value="A">(A)</num><content> be Native Hawaiians or individuals widely recognized in the field of Native Hawaiian art and culture,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebf6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/2/B"><num value="B">(B)</num><content> include a representative of the Office of Hawaiian Affairs of the State of Hawaii,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebf7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/2/C"><num value="C">(C)</num><content> include the president of the University of Hawaii,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebf8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/2/D"><num value="D">(D)</num><content> include the president of the Bishop Museum, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebf9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/2/E"><num value="E">(E)</num><content> serve for a fixed term of office.</content>
</subparagraph>

<paragraph style="-uslm-lc:I11" class="indent0" id="id82deebfa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/3"><num value="3">(3)</num><chapeau> For any grants made with respect to Alaska Native art and culture, the members of the governing board which is required to be established under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebfb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/3/A"><num value="A">(A)</num><content> include Alaska Natives and individuals widely recognized in the field of Alaska Native art and culture,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebfc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/3/B"><num value="B">(B)</num><content> represent the Eskimo, Indian and Aleut cultures of Alaska, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82deebfd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s4441/c/3/C"><num value="C">(C)</num><content> serve for a fixed term.</content>
