L. 114–95, title IX, § 9215(fff), Dec. 10, 2015, 129 Stat. 2186.)","seq_in_title":1410,"parent_identifier":"/us/usc/t20/ch65","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch65","level":"chapter","num":"CHAPTER 65—","heading":"NATIONAL ENVIRONMENTAL EDUCATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id6ca7dec8-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502\"><num value=\"5502\">§ 5502.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For the purposes of this chapter, the term—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7dec9-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/1\"><num value=\"1\">(1)</num><content> “Administrator” means the Administrator of the Environmental Protection Agency;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7deca-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/2\"><num value=\"2\">(2)</num><content> “Agency” means the United States Environmental Protection Agency;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7decb-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/3\"><num value=\"3\">(3)</num><content> “Federal agency” or “agency of the United States” means any department, agency or other instrumentality of the Federal Government, any independent agency or establishment of the Federal Government including any Government corporation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7decc-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/4\"><num value=\"4\">(4)</num><content> “Secretary” means the Secretary of the Department of Education;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7decd-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/5\"><num value=\"5\">(5)</num><content> “local educational agency” means any education agency as defined in <ref href=\"/us/usc/t20/s7801\">section 7801 of this title</ref> and shall include any tribal education agency;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7dece-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/6\"><num value=\"6\">(6)</num><content> “not-for-profit” organization <ref class=\"footnoteRef\" idref=\"fn002167\">1</ref><note type=\"footnote\" id=\"fn002167\"><num>1</num> So in original. Probably should be “ ‘not-for-profit organization’ ”.</note> means an organization, association, or institution described in <ref href=\"/us/usc/t26/s501/c/3\">section 501(c)(3) of title 26</ref>, which is exempt from taxation pursuant to the provisions of <ref href=\"/us/usc/t26/s501/a\">section 501(a) of title 26</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7decf-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/7\"><num value=\"7\">(7)</num><content> “noncommercial education broadcasting entities” means any noncommercial educational broadcasting station (and/or its legal nonprofit affiliates) as defined and licensed by the Federal Communications Commission;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7ded0-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/8\"><num value=\"8\">(8)</num><content> “tribal education agency” means a school or community college which is controlled by an Indian tribe, band, or nation, including any Alaska Native village, which is recognized as eligible for special programs and services provided by the United States to Indians because of their status as Indians and which is not administered by the Bureau of Indian Affairs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7ded1-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/9\"><num value=\"9\">(9)</num><content> “Federal natural resource management agencies” means the United States Forest Service, the Bureau of Land Management, the National Park Service, and the Fish and Wildlife Service;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7ded2-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/10\"><num value=\"10\">(10)</num><content> “environmental engineering” means the discipline within engineering and science concerned with the development and application of scientific and technical solutions to protecting the aquatic and atmospheric environment, including, but not limited to, all phases of water resources planning, water supply, water treatment, air pollution characterization and control, remediation of hazardous substances, environmental transport of contaminants in surface and ground water and atmosphere, and methods for assessment and control of pollution;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7ded3-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/11\"><num value=\"11\">(11)</num><content> “environmental education” and “environmental education and training” mean educational activities and training activities involving elementary, secondary, and postsecondary students, as such terms are defined in the State in which they reside, and environmental education personnel, but does not include technical training activities directed toward environmental management professionals or activities primarily directed toward the support of noneducational research and development;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7ded4-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/12\"><num value=\"12\">(12)</num><content> “Foundation” means the National Environmental Education and Training Foundation established pursuant to <ref href=\"/us/usc/t20/s5509\">section 5509 of this title</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ca7ded5-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s5502/13\"><num value=\"13\">(13)</num><content> “Board of Directors” means the Board of Directors of the National Environmental Education and Training Foundation.</content>\n</paragraph>\n<sourceCredit id=\"id6ca7ded6-d2f2-11e9-aa7d-f436298d01bb\">(<ref href=\"/us/pl/101/619/s3\">Pub.
