<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id82e61867-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603"><num value="5603">§ 5603.</num><heading> Establishment of Morris K. Udall and Stewart L. Udall Foundation</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82e61868-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I11" class="indent0">There is established as an independent entity of the executive branch of the United States Government, the Morris K. Udall and Stewart L. Udall Foundation.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82e61869-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b"><num value="b" class="bold">(b)</num><heading class="bold"> Board of Trustees</heading><chapeau style="-uslm-lc:I11" class="indent0">The Foundation shall be subject to the supervision and direction of the Board of Trustees. The Board shall be comprised of thirteen trustees, eleven of whom shall be voting members of the Board, as follows:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id82e6186a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/1"><num value="1">(1)</num><content> Two Trustees, shall be appointed by the President, with the advice and consent of the Senate, after considering the recommendation of the Speaker of the House of Representatives, in consultation with the Minority Leader of the House of Representatives.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82e6186b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/2"><num value="2">(2)</num><content> Two Trustees, shall be appointed by the President, with the advice and consent of the Senate, after considering the recommendation of the President pro tempore of the Senate, in consultation with the Majority and Minority Leaders of the Senate.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82e6186c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/3"><num value="3">(3)</num><chapeau> Five Trustees, not more than three of whom shall be of the same political party, shall be appointed by the President with the advice and consent of the Senate, who have shown leadership and interest in—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id82e6186d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/3/A"><num value="A">(A)</num><content> the continued use, enjoyment, education, and exploration of our Nation’s rich and bountiful natural resources, such as presidents of major foundations involved with the environment; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id82e6186e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/3/B"><num value="B">(B)</num><content> in the improvement of the health status of Native Americans and Alaska Natives and in strengthening tribal self-governance, such as tribal leaders involved in health and public policy development affecting Native American and Alaska Native communities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82e6186f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/4"><num value="4">(4)</num><content> The Secretary of the Interior, or the Secretary’s designee, who shall serve as a voting ex officio member of the Board but shall not be eligible to serve as Chairperson.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82e61870-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/5"><num value="5">(5)</num><content> The Secretary of Education, or the Secretary’s designee, who shall serve as a voting ex officio member of the Board but shall not be eligible to serve as Chairperson.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id82e61871-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/6"><num value="6">(6)</num><content> The President of the University of Arizona shall serve as a nonvoting, ex officio member and shall not be eligible to serve as chairperson.<ref class="footnoteRef" idref="fn002169">1</ref><note type="footnote" id="fn002169"><num>1</num> So in original. <paragraph style="-uslm-lc:I12" class="indent1" id="id82e61872-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/b/7"><num value="7">(7)</num><content> The chairperson of the President’s Council on Environmental Quality, who shall serve as a nonvoting, ex officio member and shall not be eligible to serve as chairperson.<sup>1</sup></content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82e61873-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c"><num value="c" class="bold">(c)</num><heading class="bold"> Term of office</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id82e61874-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c/1"><num value="1">(1)</num><heading> <ref class="footnoteRef" idref="fn002170">2</ref><note type="footnote" id="fn002170"><num>2</num> So in original. (2) has been enacted.</note> <inline class="small-caps">In general</inline>.—</heading><chapeau>The term of office of each member of the Board shall be six years, except that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id82e61875-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c/1/A"><num value="A">(A)</num><chapeau> in the case of the Trustees first taking offices—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id82e61876-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c/1/A/i"><num value="i">(i)</num><content> as designated by the President, one Trustee appointed pursuant to subsection (b)(2) and two trustees appointed pursuant to subsection (b)(3) shall each serve two years; and</content>

<clause style="-uslm-lc:I13" class="indent2" id="id82e61877-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c/1/A/ii"><num value="ii">(ii)</num><content> as designated by the President, one Trustee appointed pursuant to subsection (b)(1) and two Trustees appointed pursuant to subsection (b)(3) shall each serve four years; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id82e61878-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c/1/A/iii"><num value="iii">(iii)</num><content> as designated by the President, one Trustee appointed pursuant to subsection (b)(1), one Trustee appointed pursuant to subsection (b)(2), and one Trustee appointed pursuant to subsection (b)(3) shall each serve six years;</content>

</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82e61879-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c/1/B"><num value="B">(B)</num><content> a Trustee appointed to fill a vacancy shall serve for the remainder of the term for which the Trustee’s predecessor was appointed and shall be appointed in the same manner as the original appointment for that vacancy was made; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id82e6187a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/c/1/C"><num value="C">(C)</num><content> a Trustee may serve after the expiration of the Trustee’s term until a successor has been chosen.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82e6187b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/d"><num value="d" class="bold">(d)</num><heading class="bold"> Travel and subsistence pay</heading><content><p style="-uslm-lc:I11" class="indent0">Trustees shall serve without pay, but shall be entitled to reimbursement for travel, subsistence, and other necessary expenses incurred in the performance of their duties as members of the Board.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82e6187c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/e"><num value="e" class="bold">(e)</num><heading class="bold"> Location of Foundation</heading><content><p style="-uslm-lc:I11" class="indent0">The Foundation shall be located in Tucson, Arizona and the District of Columbia.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id82e6187d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/f"><num value="f" class="bold">(f)</num><heading class="bold"> Executive Director</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82e6187e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There shall be an Executive Director of the Foundation who shall be appointed by the Board. The Executive Director shall be the chief executive officer of the Foundation and shall carry out the functions of the Foundation subject to the supervision and direction of the Board. The Executive Director shall carry out such other functions consistent with the provisions of this chapter as the Board shall prescribe.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id82e6187f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s5603/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Compensation</heading><content><p style="-uslm-lc:I12" class="indent1">The Executive Director of the Foundation shall be compensated at a rate determined by the Board in accordance with <ref href="/us/usc/t5/s5383">section 5383 of title 5</ref>.</p>
