UDALL FOUNDATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82e61891-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605\"><num value=\"5605\">§ 5605.</num><heading> Authority of Foundation</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e61892-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Authority of Foundation</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e61893-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82e61894-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> General programming authority</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The Foundation is authorized to identify and conduct, directly or by contract, such programs, activities, and services as the Foundation considers appropriate to carry out the purposes described in <ref href=\"/us/usc/t20/s5604\">section 5604 of this title</ref>, which may include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82e61895-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/A/i\"><num value=\"i\">(i)</num><content> awarding scholarships, fellowships, internships, and grants, by national competition, to eligible individuals, as determined by the Foundation and in accordance with paragraphs (2), (3), and (4), for study in fields related to the environment or Native American and Alaska Native health care and tribal policy;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82e61896-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> funding the Center to carry out and manage other programs, activities, and services; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82e61897-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/A/iii\"><num value=\"iii\">(iii)</num><content> other education programs that the Board determines are consistent with the purposes for which the Foundation is established.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82e61898-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> John S. McCain III National Center for Environmental Conflict Resolution</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82e61899-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The Foundation shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82e6189a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/B/i/I\"><num value=\"I\">(I)</num><content> establish the John S. McCain III National Center for Environmental Conflict Resolution as part of the Foundation; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id82e6189b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/B/i/II\"><num value=\"II\">(II)</num><chapeau> identify and conduct such programs, activities, and services as the Foundation determines appropriate to permit the Foundation to provide assessment, mediation, collaboration, training, and other related services to resolve—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82e6189c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/B/i/II/aa\"><num value=\"aa\">(aa)</num><content> environmental disputes; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id82e6189d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/B/i/II/bb\"><num value=\"bb\">(bb)</num><content> Federal, State, or tribal environmental or natural resource decision-making processes or procedures that may result in a dispute or conflict that may cause or result in disputes.</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id82e6189e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/1/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Geographic proximity of conflict resolution provision</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In providing assessment, mediation, collaboration, training, and other related services under clause (i)(II) to resolve environmental disputes, the Foundation shall consider, to the maximum extent practicable, conflict resolution providers within the geographic proximity of the conflict.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e6189f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Scholarships</heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e618a0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/2/A\"><num value=\"A\">(A)</num><content> Scholarships shall be awarded to outstanding undergraduate students who intend to pursue careers related to the environment and to outstanding Native American and Alaska Native undergraduate students who intend to pursue careers in health care and tribal public policy.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e618a1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/2/B\"><num value=\"B\">(B)</num><content> An eligible individual awarded a scholarship under this chapter may receive payments under this chapter only during such periods as the Foundation finds that the eligible individual is maintaining satisfactory proficiency and devoting full time to study or research and is not engaging in gainful employment other than employment approved by the Foundation pursuant to regulations of the Board.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e618a2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/2/C\"><num value=\"C\">(C)</num><content> The Foundation may require reports containing such information, in such form, and to be filed at such times as the Foundation determines to be necessary from any eligible individual awarded a scholarship under this chapter. Such reports shall be accompanied by a certificate from an appropriate official at the institution of higher education, approved by the Foundation, stating that such individual is making satisfactory progress in, and is devoting essentially full time to study or research, except as otherwise provided in this subsection.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618a3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Fellowships</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Fellowships shall be awarded to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618a4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/3/A\"><num value=\"A\">(A)</num><content> outstanding graduate students who intend to pursue advanced degrees in fields related to the environment and to outstanding Native American and Alaska Native graduate students who intend to pursue advanced degrees in health care and tribal public policy, including law and medicine; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618a5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/3/B\"><num value=\"B\">(B)</num><content> faculty from a variety of disciplines to bring the expertise of such faculty to the Foundation.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618a6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Internships</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Internships shall be awarded to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618a7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/4/A\"><num value=\"A\">(A)</num><content> deserving and qualified individuals to participate in internships in Federal, State and local agencies or in offices of major environmental organizations pursuant to <ref href=\"/us/usc/t20/s5604\">section 5604 of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618a8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/4/B\"><num value=\"B\">(B)</num><content> deserving and qualified Native American and Alaska Native individuals to participate in internships in Federal, State and local agencies or in offices of major public health or public policy organizations pursuant to <ref href=\"/us/usc/t20/s5604\">section 5604 of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618a9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Parks in focus</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Foundation shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618aa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/5/A\"><num value=\"A\">(A)</num><content> identify and invite the participation of youth throughout the United States to enjoy the Nation’s parks and wilderness and other outdoor areas, in an education program intended to carry out the purpose of paragraphs (1) and (2) of <ref href=\"/us/usc/t20/s5604\">section 5604 of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618ab-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/5/B\"><num value=\"B\">(B)</num><content> provide training and education programs and activities to teach Federal employees, natural resource professionals, elementary and secondary school educators, and others to work with youth to promote the use and enjoyment of the Nation’s parks and wilderness and other outdoor areas.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618ac-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Specific programs</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Foundation shall assist in the development and implementation of programs at the Center—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618ad-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/6/A\"><num value=\"A\">(A)</num><content> to provide for an annual meeting of experts to discuss contemporary environmental issues;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618ae-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/6/B\"><num value=\"B\">(B)</num><content> to conduct environmental policy research; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618af-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/6/C\"><num value=\"C\">(C)</num><content> to promote dialogue with visiting policymakers on environmental, natural resource, and public lands issues.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618b0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Repository</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Foundation shall provide direct or indirect assistance from the proceeds of the Trust Fund to the Center to maintain the current site of the repository for the papers of Morris K. Udall and Stewart L. Udall and other such public papers as may be appropriate and assure such papers’ availability to the public.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618b1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Coordination</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Foundation shall assist in the development and implementation of a Program for Environmental Policy Research and Environmental Conflict Resolution and Training to be located at the Center.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618b2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/a/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Native Nations Institute</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Foundation shall provide direct or indirect assistance to the Native Nations Institute from the annual appropriations to the Trust Fund in such amounts as Congress may direct to conduct research and provide education and training to Native American and Alaska Native professionals and leaders on Native American and Alaska Native health care issues and tribal public policy issues as provided in <ref href=\"/us/usc/t20/s5604/7\">section 5604(7) of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618b3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Udall Scholars</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Recipients of scholarships, fellowships, and internships under this chapter shall be known as “Udall Scholars”, “Udall Fellows”, and “Udall Interns”, respectively.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618b4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Program priorities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618b5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Foundation shall determine the priority of the programs to be carried out under this chapter and the amount of funds to be allocated for such programs from the funds earned annually from the interest derived from the investment of the Trust Fund, subject to paragraph (2).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618b6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitations</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In determining the amount of funds to be allocated for programs carried out under this chapter for a year—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618b7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/c/2/A\"><num value=\"A\">(A)</num><content> not less than 50 percent of such annual interest earnings shall be utilized for the programs set forth in paragraphs (2), (3), (4), and (5) of subsection (a);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618b8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/c/2/B\"><num value=\"B\">(B)</num><content> not more than 17.5 percent of such annual interest earnings shall be allocated for salaries and other administrative purposes; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618b9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/c/2/C\"><num value=\"C\">(C)</num><content> not less than 20 percent of such annual interest earnings shall be appropriated to the Center for activities under paragraphs (7) and (8) of subsection (a).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618ba-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Donations</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Any funds received by the Foundation in the form of donations or grants, as well as any unexpended earnings on interest from the Trust Fund that is carried forward from prior years—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e618bb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/d/1\"><num value=\"1\">(1)</num><content> shall not be included in the calculation of the funds available for allocations pursuant to subsection (c); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e618bc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5605/d/2\"><num value=\"2\">(2)</num><content> shall be available to carry out the provisions of this chapter as the Board determines to be necessary and appropriate.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id82e618bd-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/102/259/s7\">Pub.
