UDALL FOUNDATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82e618de-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b\"><num value=\"5607b\">§ 5607b.</num><heading> Use of the National Center by Federal agency or other entity</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618df-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Authorization</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A Federal agency may use the Foundation and the National Center to provide assessment, mediation, collaboration, or other related services in connection with a dispute or conflict related to the environment, public lands, or natural resources, or with a Federal, State, or tribal process or procedure that may result in a dispute or conflict.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618e0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Payment</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618e1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A Federal agency may enter into a contract and expend funds to obtain the services of the National Center.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618e2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Payment into Environmental Dispute Resolution Fund</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A payment from an executive agency on a contract entered into under paragraph (1) shall be paid into the Environmental Dispute Resolution Fund established under <ref href=\"/us/usc/t20/s5607a\">section 5607a of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618e3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Notification and concurrence</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618e4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Notification</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An agency or instrumentality of the Federal Government shall notify the chairperson of the President’s Council on Environmental Quality when using the Foundation or the National Center to provide the services described in subsection (a).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618e5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Notification descriptions</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In a matter involving two or more agencies or instrumentalities of the Federal Government, notification under paragraph (1) shall include a written description of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618e6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/2/A\"><num value=\"A\">(A)</num><content> the issues and parties involved;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618e7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/2/B\"><num value=\"B\">(B)</num><content> prior efforts, if any, undertaken by the agency to resolve or address the issue or issues;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618e8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/2/C\"><num value=\"C\">(C)</num><content> all Federal agencies or instrumentalities with a direct interest or involvement in the matter and a statement that all Federal agencies or instrumentalities agree to mediation, collaboration, and dispute resolution; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id82e618e9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/2/D\"><num value=\"D\">(D)</num><content> other relevant information.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618ea-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Concurrence</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82e618eb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In a matter that involves two or more agencies or instrumentalities of the Federal Government (including branches or divisions of a single agency or instrumentality), the agencies or instrumentalities of the Federal Government shall obtain the concurrence of the chairperson of the President’s Council on Environmental Quality before using the Foundation or National Center to provide the services described in subsection (a).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82e618ec-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/c/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Indication of concurrence or nonconcurrence</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The chairperson of the President’s Council on Environmental Quality shall indicate concurrence or nonconcurrence under subparagraph (A) not later than 20 days after receiving notice under paragraph (2).</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618ed-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Exceptions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618ee-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Legal issues and enforcement</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82e618ef-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A dispute or conflict involving agencies or instrumentalities of the Federal Government (including branches or divisions of a single agency or instrumentality) that concern purely legal issues or matters, interpretation or determination of law, or enforcement of law by one agency against another agency shall not be submitted to the Foundation or National Center.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id82e618f0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Applicability</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Subparagraph (A) does not apply to a dispute or conflict concerning—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82e618f1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d/1/B/i\"><num value=\"i\">(i)</num><content> agency implementation of a program or project;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82e618f2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d/1/B/ii\"><num value=\"ii\">(ii)</num><content> a matter involving two or more agencies with parallel authority requiring facilitation and coordination of the various Government agencies; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id82e618f3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d/1/B/iii\"><num value=\"iii\">(iii)</num><content> a nonlegal policy or decisionmaking matter that involves two or more agencies that are jointly operating a project.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id82e618f4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Other mandated mechanisms or avenues</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A dispute or conflict involving agencies or instrumentalities of the Federal Government (including branches or divisions of a single agency or instrumentality) for which Congress by law has mandated another dispute resolution mechanism or avenue to address or resolve shall not be submitted to the Foundation or National Center.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618f5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Non-Federal entities</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id82e618f6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/e/1\"><num value=\"1\">(1)</num><content> Non-Federal entities, including state <ref class=\"footnoteRef\" idref=\"fn002173\">1</ref><note type=\"footnote\" id=\"fn002173\"><num>1</num> So in original. Probably should be capitalized.</note> and local governments, Native American tribal governments, nongovernmental organizations and persons, as defined in <ref href=\"/us/usc/t1/s1\">section 1 of title 1</ref>, may use the Foundation and the National Center to provide assessment, mediation, or other related services in connection with a dispute or conflict involving the Federal government <ref class=\"footnoteRef\" idref=\"fn002173\">1</ref> related to the environment, public lands, or natural resources.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id82e618f7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/e/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Payment into the environmental dispute resolution fund</inline>.—</heading><content>Entities utilizing services pursuant to this subsection shall reimburse the National Center for the costs of services provided. Such amounts shall be deposited into the Environmental Dispute Resolution Fund established under <ref href=\"/us/usc/t20/s5607a\">section 5607a of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618f8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5607b/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Agency management or control</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Use of the Foundation or National Center to provide independent and impartial assessment, mediation, or other dispute or conflict resolution under this section shall not be considered to be the establishment or use of an advisory committee within the meaning of the Federal Advisory Committee Act (5 U.S.C.
