UDALL FOUNDATION","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id82e618fe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608\"><num value=\"5608\">§ 5608.</num><heading> Administrative provisions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e618ff-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In order to carry out the provisions of this chapter, the Foundation may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61900-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/1\"><num value=\"1\">(1)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61901-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/1/A\"><num value=\"A\">(A)</num><content> appoint such personnel as may be necessary to carry out the provisions of this chapter, without regard to the provisions of title 5 governing appointments in the competitive service; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61902-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/1/B\"><num value=\"B\">(B)</num><content> fix the compensation of the personnel appointed under subparagraph (A) at a rate not to exceed the maximum rate for employees in grade GS–15 of the General Schedule under <ref href=\"/us/usc/t5/s5332\">section 5332 of title 5</ref>, except that up to 4 employees (in addition to the Executive Director under <ref href=\"/us/usc/t20/s5603/f/2\">section 5603(f)(2) of this title</ref>) may be paid at a rate determined by the Board in accordance with <ref href=\"/us/usc/t5/s5383\">section 5383 of title 5</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61903-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/2\"><num value=\"2\">(2)</num><content> procure or fund the Center to procure temporary and intermittent services of experts and consultants as are necessary to the extent authorized by <ref href=\"/us/usc/t5/s3109\">section 3109 of title 5</ref>, but at rates not to exceed the rate specified at the time of such service for level IV of the Executive Schedule under <ref href=\"/us/usc/t5/s5315\">section 5315 of title 5</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61904-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/3\"><num value=\"3\">(3)</num><content> prescribe such regulations as the Foundation considers necessary governing the manner in which its functions shall be carried out;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61905-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/4\"><num value=\"4\">(4)</num><content> accept, hold, solicit, administer, and utilize donations, grants, and gifts, both real and personal, for the purpose of aiding or facilitating the work of the Foundation;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61906-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/5\"><num value=\"5\">(5)</num><content> accept and utilize the services of voluntary and noncompensated personnel and reimburse such personnel for travel expenses, including per diem, as authorized by <ref href=\"/us/usc/t5/s5703\">section 5703 of title 5</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61907-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/6\"><num value=\"6\">(6)</num><content> enter into contracts, grants, or other arrangements or modifications thereof, to carry out the provisions of this chapter, and such contracts or modifications thereof may, with the concurrence of two-thirds of the members of the Board of Trustees, be entered into without performance or other bonds, and without regard to <ref href=\"/us/usc/t41/s6101\">section 6101 of title 41</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61908-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/7\"><num value=\"7\">(7)</num><content> to <ref class=\"footnoteRef\" idref=\"fn002174\">1</ref><note type=\"footnote\" id=\"fn002174\"><num>1</num> So in original. The word “to” probably should not appear.</note> rent office space in the District of Columbia and Tucson, Arizona, or their environs; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id82e61909-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/a/8\"><num value=\"8\">(8)</num><content> make other necessary expenditures.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id82e6190a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s5608/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> The Institute</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The authorities set forth above shall apply to the National Center established pursuant to <ref href=\"/us/usc/t20/s5607a\">section 5607a of this title</ref> and to the activities of the Foundation under <ref href=\"/us/usc/t20/s5604/7\">section 5604(7) of this title</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id82e6190b-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/102/259/s12\">Pub.
