<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8321c0e3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399"><num value="6399">§ 6399.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">As used in this part:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8321c0e4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/1"><num value="1" class="bold">(1)</num><heading class="bold"> Local operating agency</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “local operating agency” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8321c0e5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/1/A"><num value="A">(A)</num><content> a local educational agency to which a State educational agency makes a subgrant under this part;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8321c0e6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/1/B"><num value="B">(B)</num><content> a public or private agency with which a State educational agency or the Secretary makes an arrangement to carry out a project under this part; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8321c0e7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/1/C"><num value="C">(C)</num><content> a State educational agency, if the State educational agency operates the State’s migrant education program or projects directly.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8321c0e8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/2"><num value="2" class="bold">(2)</num><heading class="bold"> Migratory agricultural worker</heading><content><p style="-uslm-lc:I12" class="indent1">The term “migratory agricultural worker” means an individual who made a qualifying move in the preceding 36 months and, after doing so, engaged in new temporary or seasonal employment or personal subsistence in agriculture, which may be dairy work or the initial processing of raw agricultural products. If an individual did not engage in such new employment soon after a qualifying move, such individual may be considered a migratory agricultural worker if the individual actively sought such new employment and has a recent history of moves for temporary or seasonal agricultural employment.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8321c0e9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/3"><num value="3" class="bold">(3)</num><heading class="bold"> Migratory child</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “migratory child” means a child or youth who made a qualifying move in the preceding 36 months—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8321c0ea-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/3/A"><num value="A">(A)</num><content> as a migratory agricultural worker or a migratory fisher; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8321c0eb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/3/B"><num value="B">(B)</num><content> with, or to join, a parent or spouse who is a migratory agricultural worker or a migratory fisher.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8321c0ec-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/4"><num value="4" class="bold">(4)</num><heading class="bold"> Migratory fisher</heading><content><p style="-uslm-lc:I12" class="indent1">The term “migratory fisher” means an individual who made a qualifying move in the preceding 36 months and, after doing so, engaged in new temporary or seasonal employment or personal subsistence in fishing. If the individual did not engage in such new employment soon after the move, the individual may be considered a migratory fisher if the individual actively sought such new employment and has a recent history of moves for temporary or seasonal fishing employment.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8321c0ed-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/5"><num value="5" class="bold">(5)</num><heading class="bold"> Qualifying move</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “qualifying move” means a move due to economic necessity—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8321c0ee-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/5/A"><num value="A">(A)</num><content> from one residence to another residence; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8321c0ef-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/5/B"><num value="B">(B)</num><chapeau> from one school district to another school district, except—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8321c0f0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/5/B/i"><num value="i">(i)</num><content> in the case of a State that is comprised of a single school district, wherein a qualifying move is from one administrative area to another within such district; or</content>

<clause style="-uslm-lc:I14" class="indent3" id="id8321c0f1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6399/5/B/ii"><num value="ii">(ii)</num><content> in the case of a school district of more than 15,000 square miles, wherein a qualifying move is a distance of 20 miles or more to a temporary residence.</content>
