L. 114–95, title I, § 1501(b), Dec. 10, 2015, 129 Stat. 1906.)","seq_in_title":1551,"parent_identifier":"/us/usc/t20/ch70/schI/ptE","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70","level":"chapter","num":"CHAPTER 70—","heading":"STRENGTHENING AND IMPROVEMENT OF ELEMENTARY AND SECONDARY SCHOOLS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"IMPROVING THE ACADEMIC ACHIEVEMENT OF THE DISADVANTAGED","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schI/ptE","level":"part","num":"Part E—","heading":"Flexibility for Equitable Per-Pupil Funding","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id83267c0b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491\"><num value=\"6491\">§ 6491.</num><heading> Flexibility for equitable per-pupil funding</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c0c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Purpose</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The purpose of the program under this section is to provide local educational agencies with flexibility to consolidate eligible Federal funds and State and local education funding in order to create a single school funding system based on weighted per-pupil allocations for low-income and otherwise disadvantaged students.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c0d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Authority</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c0e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary is authorized to enter into local flexibility demonstration agreements—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c0f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/b/1/A\"><num value=\"A\">(A)</num><content> for not more than 3 years with local educational agencies that are selected under subsection (c) and submit proposed agreements that meet the requirements of subsection (d); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c10-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/b/1/B\"><num value=\"B\">(B)</num><content> under which such agencies may consolidate and use funds in accordance with subsection (d) in order to develop and implement a school funding system based on weighted per-pupil allocations for low-income and otherwise disadvantaged students.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c11-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Flexibility</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as described in subsection (d)(1)(I), the Secretary is authorized to waive, for local educational agencies entering into agreements under this section, any provision of this chapter that would otherwise prevent such agency from using eligible Federal funds as part of such agreement.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c12-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Selection of local educational agencies</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c13-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary may enter into local flexibility demonstration agreements with not more than 50 local educational agencies with an approved application under subsection (d).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c14-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Selection</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each local educational agency shall be selected based on such agency—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c15-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/c/2/A\"><num value=\"A\">(A)</num><content> submitting a proposed local flexibility demonstration agreement under subsection (d);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c16-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/c/2/B\"><num value=\"B\">(B)</num><content> demonstrating that the agreement meets the requirements of such subsection; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c17-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/c/2/C\"><num value=\"C\">(C)</num><content> agreeing to meet the continued demonstration requirements under subsection (e).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c18-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Expansion</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Beginning with the 2019–2020 academic year, the Secretary may extend funding flexibility authorized under this section to any local educational agency that submits and has approved an application under subsection (d), as long as a significant majority of the demonstration agreements with local educational agencies described in paragraph (1) meet the requirements of subsection (d)(2) and subsection (e)(1) as of the end of the 2018–2019 academic year.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c19-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Required terms of local flexibility demonstration agreement</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c1a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Application</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each local educational agency that desires to participate in the program under this section shall submit, at such time and in such form as the Secretary may prescribe, an application to enter into a local flexibility demonstration agreement with the Secretary in order to develop and implement a school funding system based on weighted per-pupil allocations that meets the requirements of this section. The application shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c1b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/A\"><num value=\"A\">(A)</num><chapeau> a description of the school funding system based on weighted per-pupil allocations, including—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c1c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/A/i\"><num value=\"i\">(i)</num><content> the weights used to allocate funds within such system;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c1d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/A/ii\"><num value=\"ii\">(ii)</num><content> the local educational agency’s legal authority to use State and local education funds consistent with this section;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c1e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/A/iii\"><num value=\"iii\">(iii)</num><content> how such system will meet the requirements of paragraph (2); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c1f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/A/iv\"><num value=\"iv\">(iv)</num><content> how such system will support the academic achievement of students, including low-income students, the lowest-achieving students, English learners, and children with disabilities;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c20-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/B\"><num value=\"B\">(B)</num><content> a list of funding sources, including eligible Federal funds, the local educational agency will include in such system;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c21-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/C\"><num value=\"C\">(C)</num><content> a description of the amount and percentage of total local educational agency funding, including State and local education funds and eligible Federal funds, that will be allocated through such system;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c22-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/D\"><num value=\"D\">(D)</num><content> the per-pupil expenditures (which shall include actual personnel expenditures, including staff salary differentials for years of employment, and actual nonpersonnel expenditures) of State and local education funds for each school served by the agency for the preceding fiscal year;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c23-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/E\"><num value=\"E\">(E)</num><content> the per-pupil amount of eligible Federal funds each school served by the agency received in the preceding fiscal year, disaggregated by the programs supported by the eligible Federal funds;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c24-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/F\"><num value=\"F\">(F)</num><content> a description of how such system will ensure that any eligible Federal funds allocated through the system will meet the purposes of each Federal program supported by such funds, including serving students from low-income families, English learners, migratory children, and children who are neglected, delinquent, or at risk, as applicable;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c25-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/G\"><num value=\"G\">(G)</num><content> an assurance that the local educational agency developed and will implement the local flexibility demonstration agreement in consultation with teachers, principals, other school leaders (including charter school leaders in a local educational agency that has charter schools), administrators of Federal programs impacted by the agreement, parents, community leaders, and other relevant stakeholders;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c26-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/H\"><num value=\"H\">(H)</num><content> an assurance that the local educational agency will use fiscal control and sound accounting procedures that ensure proper disbursement of, and accounting for, eligible Federal funds consolidated and used under such system;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c27-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/I\"><num value=\"I\">(I)</num><content> an assurance that the local educational agency will continue to meet the requirements of sections 6320, 6321, and 7881 of this title; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c28-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/1/J\"><num value=\"J\">(J)</num><content> an assurance that the local educational agency will meet the requirements of all applicable Federal civil rights laws in carrying out the agreement and in consolidating and using funds under the agreement.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c29-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Requirements of the system</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83267c2a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">A local educational agency’s school funding system based on weighted per-pupil allocations shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c2b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A/i\"><num value=\"i\">(i)</num><content> except as allowed under clause (iv), allocate a significant portion of funds, including State and local education funds and eligible Federal funds, to the school level based on the number of students in a school and a formula developed by the agency under this section that determines per-pupil weighted amounts;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c2c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A/ii\"><num value=\"ii\">(ii)</num><content> use weights or allocation amounts that allocate substantially more funding to English learners, students from low-income families, and students with any other characteristics associated with educational disadvantage chosen by the local educational agency, than to other students;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c2d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A/iii\"><num value=\"iii\">(iii)</num><chapeau> ensure that each high-poverty school receives, in the first year of the demonstration agreement—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id83267c2e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A/iii/I\"><num value=\"I\">(I)</num><content> more per-pupil funding, including from Federal, State, and local sources, for low-income students than such funding received for low-income students in the year prior to entering into a demonstration agreement under this section; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id83267c2f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A/iii/II\"><num value=\"II\">(II)</num><content> at least as much per-pupil funding, including from Federal, State, and local sources, for English learners as such funding received for English learners in the year prior to entering into a demonstration agreement under this section;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c30-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A/iv\"><num value=\"iv\">(iv)</num><content> be used to allocate to schools a significant percentage, which shall be a percentage agreed upon during the application process, of all the local educational agency’s State and local education funds and eligible Federal funds; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c31-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/A/v\"><num value=\"v\">(v)</num><content> include all school-level actual personnel expenditures for instructional staff (including staff salary differentials for years of employment) and actual nonpersonnel expenditures in the calculation of the local educational agency’s State and local education funds and eligible Federal funds to be allocated under clause (i).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83267c32-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Percentage</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In establishing the percentage described in subparagraph (A)(iv) for the system, the local educational agency shall demonstrate that the percentage—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c33-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/B/i\"><num value=\"i\">(i)</num><content> under such subparagraph is sufficient to carry out the purposes of the demonstration agreement under this section and to meet each of the requirements of this subsection; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83267c34-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/B/ii\"><num value=\"ii\">(ii)</num><content> of State and local education funds and eligible Federal funds that are not allocated through the local educational agency’s school funding system based on weighted per-pupil allocations, does not undermine or conflict with the requirements of the demonstration agreement under this section.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83267c35-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/d/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Expenditures</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">After allocating funds through the system, the local educational agency shall charge schools for the per-pupil expenditures of State and local education funds and eligible Federal funds, including actual personnel expenditures (including staff salary differentials for years of employment) for instructional staff and actual nonpersonnel expenditures.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c36-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Continued demonstration</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each local educational agency with an approved application under subsection (d) shall annually—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c37-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/e/1\"><num value=\"1\">(1)</num><chapeau> demonstrate to the Secretary that, as compared to the previous year, no high-poverty school served by the agency received—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c38-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/e/1/A\"><num value=\"A\">(A)</num><content> less per-pupil funding, including from Federal, State, and local sources, for low-income students; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c39-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/e/1/B\"><num value=\"B\">(B)</num><content> less per-pupil funding, including from Federal, State, and local sources, for English learners;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c3a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/e/2\"><num value=\"2\">(2)</num><content> make public and report to the Secretary the per-pupil expenditures (including actual personnel expenditures that include staff salary differentials for years of employment, and actual non-personnel expenditures) of State and local education funds and eligible Federal funds for each school served by the agency, disaggregated by each quartile of students attending the school based on student level of poverty and by each major racial or ethnic group in the school, for the preceding fiscal year;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c3b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/e/3\"><num value=\"3\">(3)</num><content> make public the total number of students enrolled in each school served by the agency and the number of students enrolled in each such school disaggregated by each of the subgroups of students, as defined in <ref href=\"/us/usc/t20/s6311/c/2\">section 6311(c)(2) of this title</ref>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c3c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/e/4\"><num value=\"4\">(4)</num><content> notwithstanding paragraph (1), (2), or (3), ensure that any information to be reported or made public under this subsection is only reported or made public if such information does not reveal personally identifiable information.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c3d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Limitations on administrative expenditures</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each local educational agency that has entered into a local flexibility demonstration agreement with the Secretary under this section may use, for administrative purposes, an amount of eligible Federal funds that is not more than the percentage of funds allowed for such purposes under any of the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c3e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/f/1\"><num value=\"1\">(1)</num><content> This subchapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c3f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/f/2\"><num value=\"2\">(2)</num><content> Subchapter II.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c40-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/f/3\"><num value=\"3\">(3)</num><content> Subchapter III.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c41-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/f/4\"><num value=\"4\">(4)</num><content> Part A of subchapter IV.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c42-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/f/5\"><num value=\"5\">(5)</num><content> Part B of subchapter V.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c43-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Peer review</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may establish a peer-review process to assist in the review of a proposed local flexibility demonstration agreement.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c44-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Noncompliance</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may, after providing notice and an opportunity for a hearing (including the opportunity to provide supporting evidence as provided for in subsection (i)), terminate a local flexibility demonstration agreement under this section if there is evidence that the local educational agency has failed to comply with the terms of the agreement and the requirements under subsections (d) and (e).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c45-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Evidence</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If a local educational agency believes that the Secretary’s determination under subsection (h) is in error for statistical or other substantive reasons, the local educational agency may provide supporting evidence to the Secretary, and the Secretary shall consider that evidence before making a final determination.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c46-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/j\"><num value=\"j\" class=\"bold\">(j)</num><heading class=\"bold\"> Program evaluation</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">From the amount reserved for evaluation activities under <ref href=\"/us/usc/t20/s7981\">section 7981 of this title</ref>, the Secretary, acting through the Director of the Institute of Education Sciences, shall, in consultation with the relevant program office at the Department, evaluate—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c47-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/j/1\"><num value=\"1\">(1)</num><content> the implementation of the local flexibility demonstration agreements under this section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c48-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/j/2\"><num value=\"2\">(2)</num><content> the impact of such agreements on improving the equitable distribution of State and local funding and increasing student achievement.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c49-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/k\"><num value=\"k\" class=\"bold\">(k)</num><heading class=\"bold\"> Renewal of local flexibility demonstration agreement</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may renew for additional 3-year terms a local flexibility demonstration agreement under this section if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c4a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/k/1\"><num value=\"1\">(1)</num><content> the local educational agency has met the requirements under subsections (d)(2) and (e) and agrees to, and has a high likelihood of, continuing to meet such requirements; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83267c4b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/k/2\"><num value=\"2\">(2)</num><content> the Secretary determines that renewing the local flexibility demonstration agreement is in the interest of students served under this subchapter and subchapter III.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83267c4c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/l\"><num value=\"l\" class=\"bold\">(l)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83267c4d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/l/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Eligible Federal funds</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “eligible Federal funds” means funds received by a local educational agency under—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c4e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/l/1/A\"><num value=\"A\">(A)</num><content> this subchapter;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c4f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/l/1/B\"><num value=\"B\">(B)</num><content> subchapter II;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c50-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/l/1/C\"><num value=\"C\">(C)</num><content> subchapter III;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83267c51-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6491/l/1/D\"><num value=\"D\">(D)</num><content> part A of subchapter IV;
