L. 114–95, title I, §§ 1501(a)(4), 1601(a), Dec. 10, 2015, 129 Stat. 1906, 1910.)","seq_in_title":1552,"parent_identifier":"/us/usc/t20/ch70/schI/ptF","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70","level":"chapter","num":"CHAPTER 70—","heading":"STRENGTHENING AND IMPROVEMENT OF ELEMENTARY AND SECONDARY SCHOOLS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"IMPROVING THE ACADEMIC ACHIEVEMENT OF THE DISADVANTAGED","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schI/ptF","level":"part","num":"Part F—","heading":"General Provisions","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8328ed5c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571\"><num value=\"6571\">§ 6571.</num><heading> Federal regulations</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8328ed5d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may issue, in accordance with subsections (b) through (d) and subject to <ref href=\"/us/usc/t20/s6311/e\">section 6311(e) of this title</ref>, such regulations as are necessary to reasonably ensure that there is compliance with this subchapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8328ed5e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Negotiated rulemaking process</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8328ed5f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Before publishing in the Federal Register proposed regulations to carry out this subchapter, the Secretary shall obtain the advice and recommendations of representatives of Federal, State, and local administrators, parents, teachers, principals, other school leaders (including charter school leaders), paraprofessionals, and members of local school boards and other organizations involved with the implementation and operation of programs under this subchapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8328ed60-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Meetings and electronic exchange</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Such advice and recommendations may be obtained through such mechanisms as regional meetings and electronic exchanges of information. Such regional meetings and electronic exchanges of information shall be public and notice of such meetings and exchanges shall be provided to interested stakeholders.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8328ed61-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Proposed regulations</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">After obtaining such advice and recommendations, and before publishing proposed regulations, the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed62-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/3/A\"><num value=\"A\">(A)</num><content> establish a negotiated rulemaking process on, at a minimum, standards, assessments under <ref href=\"/us/usc/t20/s6311/b/2\">section 6311(b)(2) of this title</ref>, and the requirement under <ref href=\"/us/usc/t20/s6321\">section 6321 of this title</ref> that funds under part A be used to supplement, and not supplant, State and local funds;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed63-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/3/B\"><num value=\"B\">(B)</num><content> select individuals to participate in such process from among individuals or groups that provided advice and recommendations, including representation from all geographic regions of the United States, in such numbers as will provide an equitable balance between representatives of parents and students and representatives of educators and education officials; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed64-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/3/C\"><num value=\"C\">(C)</num><content> prepare a draft of proposed policy options that shall be provided to the individuals selected by the Secretary under subparagraph (B) not less than 15 days before the first meeting under such process.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8328ed65-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Process</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Such process—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed66-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/4/A\"><num value=\"A\">(A)</num><content> shall not be subject to the Federal Advisory Committee Act (5 U.S.C. App.); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed67-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/b/4/B\"><num value=\"B\">(B)</num><content> shall, unless otherwise provided as described in subsection (c), follow the provisions of subchapter III of chapter 5 of title V <ref class=\"footnoteRef\" idref=\"fn002198\">1</ref><note type=\"footnote\" id=\"fn002198\"><num>1</num> So in original. Probably should be “5”.</note> (commonly known as the “Negotiated Rulemaking Act of 1990”).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8328ed68-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Alternative process for certain exceptions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">If consensus, as defined in <ref href=\"/us/usc/t5/s562\">section 562 of title 5</ref>, on any proposed regulation is not reached by the individuals selected under subsection (b)(3)(B) for the negotiated rulemaking process, or if the Secretary determines that a negotiated rulemaking process is unnecessary, the Secretary may propose a regulation in the following manner:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8328ed69-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Notice to Congress</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Not less than 15 business days prior to issuing a notice of proposed rulemaking in the Federal Register, the Secretary shall provide to the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Education and the Workforce of the House of Representatives, and other relevant congressional committees, notice of the Secretary’s intent to issue a notice of proposed rulemaking that shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed6a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/1/A\"><num value=\"A\">(A)</num><content> a copy of the proposed regulation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed6b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/1/B\"><num value=\"B\">(B)</num><content> the need to issue the regulation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed6c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/1/C\"><num value=\"C\">(C)</num><content> the anticipated burden, including the time, cost, and paperwork burden, the regulation will impose on State educational agencies, local educational agencies, schools, and other entities that may be impacted by the regulation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed6d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/1/D\"><num value=\"D\">(D)</num><content> the anticipated benefits to State educational agencies, local educational agencies, schools, and other entities that may be impacted by the regulation; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed6e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/1/E\"><num value=\"E\">(E)</num><content> any regulations that will be repealed when the new regulation is issued.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8328ed6f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Comment period for Congress</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed70-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/2/A\"><num value=\"A\">(A)</num><content> before issuing any notice of proposed rulemaking under this subsection, provide Congress with a comment period of 15 business days to make comments on the proposed regulation, beginning on the date that the Secretary provides the notice of intent to the appropriate committees of Congress under paragraph (1); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed71-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/2/B\"><num value=\"B\">(B)</num><content> include and seek to address all comments submitted by Congress in the public rulemaking record for the regulation published in the Federal Register.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8328ed72-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Comment and review period; emergency situations</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The comment and review period for any proposed regulation shall be not less than 60 days unless an emergency requires a shorter period, in which case the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed73-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/3/A\"><num value=\"A\">(A)</num><content> designate the proposed regulation as an emergency with an explanation of the emergency in the notice to Congress under paragraph (1);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed74-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/3/B\"><num value=\"B\">(B)</num><content> publish the length of the comment and review period in such notice and in the Federal Register; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8328ed75-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/c/3/C\"><num value=\"C\">(C)</num><content> conduct immediately thereafter regional meetings to review such proposed regulation before issuing any final regulation.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8328ed76-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Regulations to carry out this subchapter may not require local programs to follow a particular instructional model, such as the provision of services outside the regular classroom or school program.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8328ed77-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6571/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Nothing in this section affects the applicability of subchapter II of chapter 5, and chapter 7, of title 5 (commonly known as the “Administrative Procedure Act”) or chapter 8 of title 5 (commonly known as the “Congressional Review Act”).</p>\n</content>\n</subsection>\n<sourceCredit id=\"id8328ed78-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/10/tI/s1601\">Pub.
