<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8328ed87-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573"><num value="6573">§ 6573.</num><heading> State administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8328ed88-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a"><num value="a" class="bold">(a)</num><heading class="bold"> Rulemaking</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8328ed89-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Each State that receives funds under this subchapter shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed8a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1/A"><num value="A">(A)</num><content> ensure that any State rules, regulations, and policies relating to this subchapter conform to the purposes of this subchapter and provide any such proposed rules, regulations, and policies to the committee of practitioners created under subsection (b) for review and comment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed8b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1/B"><num value="B">(B)</num><content> minimize such rules, regulations, and policies to which the State’s local educational agencies and schools are subject;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed8c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1/C"><num value="C">(C)</num><content> eliminate or modify State and local fiscal accounting requirements in order to facilitate the ability of schools to consolidate funds under schoolwide programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed8d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1/D"><num value="D">(D)</num><content> identify any such rule, regulation, or policy as a State-imposed requirement; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed8e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1/E"><num value="E">(E)</num><clause style="-uslm-lc:I13" class="indent2" id="id8328ed8f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1/E/i"><num value="i">(i)</num><content> identify any duplicative or contrasting requirements between the State and Federal rules or regulations; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id8328ed90-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/1/E/ii"><num value="ii">(ii)</num><content> eliminate the State rules and regulations that are duplicative of Federal requirements.</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8328ed91-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Support and facilitation</heading><content><p style="-uslm-lc:I12" class="indent1">State rules, regulations, and policies under this subchapter shall support and facilitate local educational agency and school-level systemic reform designed to enable all children to meet the challenging State academic standards.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8328ed92-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b"><num value="b" class="bold">(b)</num><heading class="bold"> Committee of practitioners</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8328ed93-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each State educational agency that receives funds under this subchapter shall create a State committee of practitioners to advise the State in carrying out its responsibilities under this subchapter.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8328ed94-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Membership</heading><chapeau style="-uslm-lc:I12" class="indent1">Each such committee shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed95-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/A"><num value="A">(A)</num><content> as a majority of its members, representatives from local educational agencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed96-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/B"><num value="B">(B)</num><content> administrators, including the administrators of programs described in other parts of this subchapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed97-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/C"><num value="C">(C)</num><content> teachers from traditional public schools and charter schools (if there are charter schools in the State) and career and technical educators;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed98-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/D"><num value="D">(D)</num><content> principals and other school leaders;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed99-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/E"><num value="E">(E)</num><content> parents;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed9a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/F"><num value="F">(F)</num><content> members of local school boards;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed9b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/G"><num value="G">(G)</num><content> representatives of private school children;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed9c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/H"><num value="H">(H)</num><content> specialized instructional support personnel and paraprofessionals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed9d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/I"><num value="I">(I)</num><content> representatives of authorized public chartering agencies (if there are charter schools in the State); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8328ed9e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/2/J"><num value="J">(J)</num><content> charter school leaders (if there are charter schools in the State).</content>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8328ed9f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6573/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Duties</heading><content><p style="-uslm-lc:I12" class="indent1">The duties of such committee shall include a review, before publication, of any proposed or final State rule or regulation pursuant to this subchapter. In an emergency situation where such rule or regulation must be issued within a very limited time to assist local educational agencies with the operation of the program under this subchapter, the State educational agency may issue a regulation without prior consultation, but shall immediately thereafter convene the State committee of practitioners to review the emergency regulation before issuance in final form.</p>
