<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id832da7d4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632"><num value="6632">§ 6632.</num><heading> Teacher and school leader incentive fund grants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id832da7d5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants authorized</heading><content><p style="-uslm-lc:I11" class="indent0">From the amounts reserved by the Secretary under <ref href="/us/usc/t20/s6621/1">section 6621(1) of this title</ref>, the Secretary shall award grants, on a competitive basis, to eligible entities to enable the eligible entities to develop, implement, improve, or expand performance-based compensation systems or human capital management systems, in schools served by the eligible entity.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id832da7d6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/b"><num value="b" class="bold">(b)</num><heading class="bold"> Duration of grants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id832da7d7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A grant awarded under this subpart shall be for a period of not more than 3 years.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id832da7d8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Renewal</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may renew a grant awarded under this subpart for a period of not more than 2 years if the grantee demonstrates to the Secretary that the grantee is effectively using funds. Such renewal may include allowing the grantee to scale up or replicate the successful program.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id832da7d9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I12" class="indent1">A local educational agency may receive (whether individually or as part of a consortium or partnership) a grant under this subpart, as amended by the Every Student Succeeds Act,<ref class="footnoteRef" idref="fn002199">1</ref><note type="footnote" id="fn002199"><num>1</num> See References in Text note below.</note> only twice.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id832da7da-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c"><num value="c" class="bold">(c)</num><heading class="bold"> Applications</heading><chapeau style="-uslm-lc:I11" class="indent0">An eligible entity desiring a grant under this subpart shall submit an application to the Secretary at such time and in such manner as the Secretary may reasonably require. The application shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id832da7db-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/1"><num value="1">(1)</num><content> a description of the performance-based compensation system or human capital management system that the eligible entity proposes to develop, implement, improve, or expand through the grant;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7dc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/2"><num value="2">(2)</num><content> a description of the most significant gaps or insufficiencies in student access to effective teachers, principals, or other school leaders in high-need schools, including gaps or inequities in how effective teachers, principals, or other school leaders are distributed across the local educational agency, as identified using factors such as data on school resources, staffing patterns, school environment, educator support systems, and other school-level factors;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7dd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/3"><num value="3">(3)</num><content> a description and evidence of the support and commitment from teachers, principals, or other school leaders, which may include charter school leaders, in the school (including organizations representing teachers, principals, or other school leaders), the community, and the local educational agency to the activities proposed under the grant;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7de-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/4"><num value="4">(4)</num><content> a description of how the eligible entity will develop and implement a fair, rigorous, valid, reliable, and objective process to evaluate teacher, principal, or other school leader performance under the system that is based in part on measures of student academic achievement, including the baseline performance against which evaluations of improved performance will be made;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7df-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/5"><num value="5">(5)</num><content> a description of the local educational agencies or schools to be served under the grant, including such student academic achievement, demographic, and socioeconomic information as the Secretary may request;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7e0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/6"><num value="6">(6)</num><content> a description of the effectiveness of teachers, principals, or other school leaders in the local educational agency and the schools to be served under the grant and the extent to which the system will increase the effectiveness of teachers, principals, or other school leaders in such schools;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7e1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/7"><num value="7">(7)</num><content> a description of how the eligible entity will use grant funds under this subpart in each year of the grant, including a timeline for implementation of such activities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7e2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/8"><num value="8">(8)</num><content> a description of how the eligible entity will continue the activities assisted under the grant after the grant period ends;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7e3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/9"><num value="9">(9)</num><content> a description of the State, local, or other public or private funds that will be used to supplement the grant, including funds under part A, and sustain the activities assisted under the grant after the end of the grant period;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7e4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/10"><num value="10">(10)</num><chapeau> a description of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7e5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/10/A"><num value="A">(A)</num><content> the rationale for the project;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7e6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/10/B"><num value="B">(B)</num><content> how the proposed activities are evidence-based; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7e7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/10/C"><num value="C">(C)</num><content> if applicable, the prior experience of the eligible entity in developing and implementing such activities; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id832da7e8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/c/11"><num value="11">(11)</num><content> a description of how activities funded under this subpart will be evaluated, monitored, and publically reported.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id832da7e9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/d"><num value="d" class="bold">(d)</num><heading class="bold"> Award basis</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id832da7ea-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Priority</heading><content><p style="-uslm-lc:I12" class="indent1">In awarding a grant under this subpart, the Secretary shall give priority to an eligible entity that concentrates the activities proposed to be assisted under the grant on teachers, principals, or other school leaders serving in high-need schools.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id832da7eb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Equitable distribution</heading><content><p style="-uslm-lc:I12" class="indent1">To the extent practicable, the Secretary shall ensure an equitable geographic distribution of grants under this subpart, including the distribution of such grants between rural and urban areas.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id832da7ec-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e"><num value="e" class="bold">(e)</num><heading class="bold"> Use of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id832da7ed-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible entity that receives a grant under this subpart shall use the grant funds to develop, implement, improve, or expand, in collaboration with teachers, principals, other school leaders, and members of the public, a performance-based compensation system or human capital management system consistent with this subpart.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id832da7ee-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Authorized activities</heading><chapeau style="-uslm-lc:I12" class="indent1">Grant funds under this subpart may be used for one or more of the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7ef-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/A"><num value="A">(A)</num><chapeau> Developing or improving an evaluation and support system, including as part of a human capital management system as applicable, that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id832da7f0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/A/i"><num value="i">(i)</num><content> reflects clear and fair measures of teacher, principal, or other school leader performance, based in part on demonstrated improvement in student academic achievement; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id832da7f1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/A/ii"><num value="ii">(ii)</num><content> provides teachers, principals, or other school leaders with ongoing, differentiated, targeted, and personalized support and feedback for improvement, including professional development opportunities designed to increase effectiveness.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7f2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/B"><num value="B">(B)</num><content> Conducting outreach within a local educational agency or a State to gain input on how to construct an evaluation and support system described in subparagraph (A) and to develop support for the evaluation and support system, including by training appropriate personnel in how to observe and evaluate teachers, principals, or other school leaders.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7f3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/C"><num value="C">(C)</num><chapeau> Providing principals or other school leaders with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id832da7f4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/C/i"><num value="i">(i)</num><content> balanced autonomy to make budgeting, scheduling, and other school-level decisions in a manner that meets the needs of the school without compromising the intent or essential components of the policies of the local educational agency or State; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id832da7f5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/C/ii"><num value="ii">(ii)</num><content> authority to make staffing decisions that meet the needs of the school, such as building an instructional leadership team that includes teacher leaders or offering opportunities for teams or pairs of effective teachers or candidates to teach or start teaching in high-need schools together.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7f6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D"><num value="D">(D)</num><chapeau> Implementing, as part of a comprehensive performance-based compensation system, a differentiated salary structure, which may include bonuses and stipends, to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id832da7f7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D/i"><num value="i">(i)</num><chapeau> teachers who—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id832da7f8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D/i/I"><num value="I">(I)</num><chapeau> teach in—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id832da7f9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D/i/I/aa"><num value="aa">(aa)</num><content> high-need schools; or</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id832da7fa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D/i/I/bb"><num value="bb">(bb)</num><content> high-need subjects;</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id832da7fb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D/i/II"><num value="II">(II)</num><content> raise student academic achievement; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id832da7fc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D/i/III"><num value="III">(III)</num><content> take on additional leadership responsibilities; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id832da7fd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/D/ii"><num value="ii">(ii)</num><content> principals or other school leaders who serve in high-need schools and raise student academic achievement in the schools.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id832da7fe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/E"><num value="E">(E)</num><chapeau> Improving the local educational agency’s system and process for the recruitment, selection, placement, and retention of effective teachers, principals, or other school leaders in high-need schools, such as by improving local educational agency policies and procedures to ensure that high-need schools are competitive and timely in—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id832da7ff-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/E/i"><num value="i">(i)</num><content> attracting, hiring, and retaining effective educators;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id832da800-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/E/ii"><num value="ii">(ii)</num><content> offering bonuses or higher salaries to effective educators; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id832da801-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/E/iii"><num value="iii">(iii)</num><content> establishing or strengthening school leader residency programs and teacher residency programs.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id832da802-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/e/2/F"><num value="F">(F)</num><content> Instituting career advancement opportunities characterized by increased responsibility and pay that reward and recognize effective teachers, principals, or other school leaders in high-need schools and enable them to expand their leadership and results, such as through teacher-led professional development, mentoring, coaching, hybrid roles, administrative duties, and career ladders.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id832da803-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/f"><num value="f" class="bold">(f)</num><heading class="bold"> Matching requirement</heading><content><p style="-uslm-lc:I11" class="indent0">Each eligible entity that receives a grant under this subpart shall provide, from non-Federal sources, an amount equal to 50 percent of the amount of the grant (which may be provided in cash or in kind) to carry out the activities supported by the grant.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id832da804-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6632/g"><num value="g" class="bold">(g)</num><heading class="bold"> Supplement, not supplant</heading><content><p style="-uslm-lc:I11" class="indent0">Grant funds provided under this subpart shall be used to supplement, not supplant, other Federal or State funds available to carry out activities described in this subpart.</p>
