L. 114–95, title II, § 2002, Dec. 10, 2015, 129 Stat. 1938.)","seq_in_title":1571,"parent_identifier":"/us/usc/t20/ch70/schII/ptB/spt2","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70","level":"chapter","num":"CHAPTER 70—","heading":"STRENGTHENING AND IMPROVEMENT OF ELEMENTARY AND SECONDARY SCHOOLS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"PREPARING, TRAINING, AND RECRUITING HIGH-QUALITY TEACHERS, PRINCIPALS, OR OTHER SCHOOL LEADERS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schII/ptB","level":"part","num":"Part B—","heading":"National Activities","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schII/ptB/spt2","level":"subpart","num":"subpart 2—","heading":"literacy education for all, results for the nation","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id83301946-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642\"><num value=\"6642\">§ 6642.</num><heading> Comprehensive literacy State development grants</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83301947-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Grants authorized</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">From the amounts reserved by the Secretary under <ref href=\"/us/usc/t20/s6621/2\">section 6621(2) of this title</ref> and not reserved under subsection (b), the Secretary shall award grants, on a competitive basis, to State educational agencies to enable the State educational agencies to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83301948-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/a/1\"><num value=\"1\">(1)</num><content> provide subgrants to eligible entities serving a diversity of geographic areas, giving priority to entities serving greater numbers or percentages of children from low-income families; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83301949-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/a/2\"><num value=\"2\">(2)</num><content> develop or enhance comprehensive literacy instruction plans that ensure high-quality instruction and effective strategies in reading and writing for children from early childhood education through grade 12, including English learners and children with disabilities.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8330194a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Reservation</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">From the amounts reserved to carry out this subpart for a fiscal year, the Secretary shall reserve—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8330194b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/b/1\"><num value=\"1\">(1)</num><content> not more than a total of 5 percent for national activities, including a national evaluation, technical assistance and training, data collection, and reporting;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8330194c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/b/2\"><num value=\"2\">(2)</num><content> one half of 1 percent for the Secretary of the Interior to carry out a program described in this subpart at schools operated or funded by the Bureau of Indian Education; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8330194d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/b/3\"><num value=\"3\">(3)</num><content> one half of 1 percent for the outlying areas to carry out a program under this subpart.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8330194e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Duration of grants</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">A grant awarded under this subpart shall be for a period of not more than 5 years total. Such grant may be renewed for an additional 2-year period upon the termination of the initial period of the grant if the grant recipient demonstrates to the satisfaction of the Secretary that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8330194f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/c/1\"><num value=\"1\">(1)</num><content> the State has made adequate progress; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83301950-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/c/2\"><num value=\"2\">(2)</num><content> renewing the grant for an additional 2-year period is necessary to carry out the objectives of the grant described in subsection (d).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83301951-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> State applications</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83301952-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A State educational agency desiring a grant under this subpart shall submit an application to the Secretary, at such time and in such manner as the Secretary may require. The State educational agency shall collaborate with the State agency responsible for administering early childhood education programs and the State agency responsible for administering child care programs in the State in writing and implementing the early childhood education portion of the grant application under this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83301953-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">An application described in paragraph (1) shall include, at a minimum, the following:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301954-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/A\"><num value=\"A\">(A)</num><content> A needs assessment that analyzes literacy needs across the State and in high-need schools and local educational agencies that serve high-need schools, including identifying the most significant gaps in literacy proficiency and inequities in student access to effective teachers of literacy, considering each of the subgroups of students, as defined in <ref href=\"/us/usc/t20/s6311/c/2\">section 6311(c)(2) of this title</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301955-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/B\"><num value=\"B\">(B)</num><content> A description of how the State educational agency, in collaboration with the State literacy team, if applicable, will develop a State comprehensive literacy instruction plan or will revise and update an already existing State comprehensive literacy instruction plan.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301956-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/C\"><num value=\"C\">(C)</num><content> An implementation plan that includes a description of how the State educational agency will carry out the State activities described in subsection (f).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301957-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/D\"><num value=\"D\">(D)</num><chapeau> An assurance that the State educational agency will use implementation grant funds described in subsection (f)(1) for comprehensive literacy instruction programs as follows:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83301958-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/D/i\"><num value=\"i\">(i)</num><content> Not less than 15 percent of such grant funds shall be used for State and local programs and activities pertaining to children from birth through kindergarten entry.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83301959-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/D/ii\"><num value=\"ii\">(ii)</num><content> Not less than 40 percent of such grant funds shall be used for State and local programs and activities, allocated equitably among the grades of kindergarten through grade 5.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8330195a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/D/iii\"><num value=\"iii\">(iii)</num><content> Not less than 40 percent of such grant funds shall be used for State and local programs and activities, allocated equitably among grades 6 through 12.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8330195b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/E\"><num value=\"E\">(E)</num><chapeau> An assurance that the State educational agency will give priority in awarding a subgrant under <ref href=\"/us/usc/t20/s6643\">section 6643 of this title</ref> to an eligible entity that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8330195c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/E/i\"><num value=\"i\">(i)</num><content> serves children from birth through age 5 who are from families with income levels at or below 200 percent of the Federal poverty line; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8330195d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/d/2/E/ii\"><num value=\"ii\">(ii)</num><content> is a local educational agency serving a high number or percentage of high-need schools.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8330195e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Priority</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In awarding grants under this section, the Secretary shall give priority to State educational agencies that will use the grant funds for evidence-based activities, defined for the purpose of this subsection as activities meeting the requirements of <ref href=\"/us/usc/t20/s7801/21/A/i\">section 7801(21)(A)(i) of this title</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8330195f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> State activities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83301960-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A State educational agency receiving a grant under this section shall use not less than 95 percent of such grant funds to award subgrants to eligible entities, based on their needs assessment and a competitive application process.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83301961-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Reservation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">A State educational agency receiving a grant under this section may reserve not more than 5 percent for activities identified through the needs assessment and comprehensive literacy plan described in subparagraphs (A) and (B) of subsection (d)(2), including the following activities:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301962-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/2/A\"><num value=\"A\">(A)</num><content> Providing technical assistance, or engaging qualified providers to provide technical assistance, to eligible entities to enable the eligible entities to design and implement literacy programs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301963-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/2/B\"><num value=\"B\">(B)</num><content> Coordinating with institutions of higher education in the State to provide recommendations to strengthen and enhance pre-service courses for students preparing to teach children from birth through grade 12 in explicit, systematic, and intensive instruction in evidence-based literacy methods.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301964-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/2/C\"><num value=\"C\">(C)</num><content> Reviewing and updating, in collaboration with teachers and institutions of higher education, State licensure or certification standards in the area of literacy instruction in early education through grade 12.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301965-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/2/D\"><num value=\"D\">(D)</num><content> Making publicly available, including on the State educational agency’s website, information on promising instructional practices to improve child literacy achievement.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301966-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/2/E\"><num value=\"E\">(E)</num><content> Administering and monitoring the implementation of subgrants by eligible entities.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83301967-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Additional uses</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">After carrying out the activities described in paragraphs (1) and (2), a State educational agency may use any remaining amount to carry out 1 or more of the following activities:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301968-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/3/A\"><num value=\"A\">(A)</num><content> Developing literacy coach training programs and training literacy coaches.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83301969-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s6642/f/3/B\"><num value=\"B\">(B)</num><content> Administration and evaluation of activities carried out under this
