<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83371e23-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824"><num value="6824">§ 6824.</num><heading> Within-State allocations</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e24-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">After making the reservation required under subsection (d)(1), each State educational agency receiving a grant under <ref href="/us/usc/t20/s6821/c/2">section 6821(c)(2) of this title</ref> shall award subgrants for a fiscal year by allocating in a timely manner to each eligible entity in the State having a plan approved under <ref href="/us/usc/t20/s6826">section 6826 of this title</ref> an amount that bears the same relationship to the amount received under the grant and remaining after making such reservation as the population of English learners in schools served by the eligible entity bears to the population of English learners in schools served by all eligible entities in the State.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e25-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/b"><num value="b" class="bold">(b)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I11" class="indent0">A State educational agency shall not award a subgrant from an allocation made under subsection (a) if the amount of such subgrant would be less than $10,000.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e26-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/c"><num value="c" class="bold">(c)</num><heading class="bold"> Reallocation</heading><content><p style="-uslm-lc:I11" class="indent0">Whenever a State educational agency determines that an amount from an allocation made to an eligible entity under subsection (a) for a fiscal year will not be used by the entity for the purpose for which the allocation was made, the agency shall, in accordance with such rules as it determines to be appropriate, reallocate such amount, consistent with such subsection, to other eligible entities in the State that the agency determines will use the amount to carry out that purpose.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e27-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/d"><num value="d" class="bold">(d)</num><heading class="bold"> Required reservation</heading><chapeau style="-uslm-lc:I11" class="indent0">A State educational agency receiving a grant under this subpart for a fiscal year—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83371e28-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/d/1"><num value="1">(1)</num><content> shall reserve not more than 15 percent of the agency’s allotment under <ref href="/us/usc/t20/s6821/c/2">section 6821(c)(2) of this title</ref> to award subgrants to eligible entities in the State that have experienced a significant increase, as compared to the average of the 2 preceding fiscal years, in the percentage or number of immigrant children and youth, who have enrolled, during the fiscal year for which the subgrant is made, in public and nonpublic elementary schools and secondary schools in the geographic areas under the jurisdiction of, or served by, such entities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e29-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/d/2"><num value="2">(2)</num><chapeau> in awarding subgrants under paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e2a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/d/2/A"><num value="A">(A)</num><content> shall equally consider eligible entities that satisfy the requirement of such paragraph but have limited or no experience in serving immigrant children and youth; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e2b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6824/d/2/B"><num value="B">(B)</num><content> shall consider the quality of each local plan under <ref href="/us/usc/t20/s6826">section 6826 of this title</ref> and ensure that each subgrant is of sufficient size and scope to meet the purposes of this part.</content>
