<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83371e31-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825"><num value="6825">§ 6825.</num><heading> Subgrants to eligible entities</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e32-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/a"><num value="a" class="bold">(a)</num><heading class="bold"> Purposes of subgrants</heading><chapeau style="-uslm-lc:I11" class="indent0">A State educational agency may make a subgrant to an eligible entity from funds received by the agency under this subpart only if the entity agrees to expend the funds to improve the education of English learners by assisting the children to learn English and meet the challenging State academic standards. In carrying out activities with such funds, the eligible entity shall use effective approaches and methodologies for teaching English learners and immigrant children and youth for the following purposes:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83371e33-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/a/1"><num value="1">(1)</num><content> Developing and implementing new language instruction educational programs and academic content instructional programs for English learners and immigrant children and youth, including early childhood education programs, elementary school programs, and secondary school programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e34-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/a/2"><num value="2">(2)</num><content> Carrying out highly focused, innovative, locally designed activities to expand or enhance existing language instruction educational programs and academic content instructional programs for English learners and immigrant children and youth.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e35-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/a/3"><num value="3">(3)</num><content> Implementing, within an individual school, schoolwide programs for restructuring, reforming, and upgrading all relevant programs, activities, and operations relating to language instruction educational programs and academic content instruction for English learners and immigrant children and youth.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e36-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/a/4"><num value="4">(4)</num><content> Implementing, within the entire jurisdiction of a local educational agency, agencywide programs for restructuring, reforming, and upgrading all relevant programs, activities, and operations relating to language instruction educational programs and academic content instruction for English learners and immigrant children and youth.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e37-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/b"><num value="b" class="bold">(b)</num><heading class="bold"> Direct administrative expenses</heading><content><p style="-uslm-lc:I11" class="indent0">Each eligible entity receiving funds under <ref href="/us/usc/t20/s6824/a">section 6824(a) of this title</ref> for a fiscal year may use not more than 2 percent of such funds for the cost of administering this subpart.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e38-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c"><num value="c" class="bold">(c)</num><heading class="bold"> Required subgrantee activities</heading><chapeau style="-uslm-lc:I11" class="indent0">An eligible entity receiving funds under <ref href="/us/usc/t20/s6824/a">section 6824(a) of this title</ref> shall use the funds—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83371e39-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/1"><num value="1">(1)</num><chapeau> to increase the English language proficiency of English learners by providing effective language instruction educational programs that meet the needs of English learners and demonstrate success in increasing—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e3a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/1/A"><num value="A">(A)</num><content> English language proficiency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e3b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/1/B"><num value="B">(B)</num><content> student academic achievement;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e3c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/2"><num value="2">(2)</num><chapeau> to provide effective professional development to classroom teachers (including teachers in classroom settings that are not the settings of language instruction educational programs), principals and other school leaders, administrators, and other school or community-based organizational personnel, that is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e3d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/2/A"><num value="A">(A)</num><content> designed to improve the instruction and assessment of English learners;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e3e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/2/B"><num value="B">(B)</num><content> designed to enhance the ability of such teachers, principals, and other school leaders to understand and implement curricula, assessment practices and measures, and instructional strategies for English learners;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e3f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/2/C"><num value="C">(C)</num><content> effective in increasing children’s English language proficiency or substantially increasing the subject matter knowledge, teaching knowledge, and teaching skills of such teachers; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e40-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/2/D"><num value="D">(D)</num><content> of sufficient intensity and duration (which shall not include activities such as 1-day or short-term workshops and conferences) to have a positive and lasting impact on the teachers’ performance in the classroom, except that this subparagraph shall not apply to an activity that is one component of a long-term, comprehensive professional development plan established by a teacher and the teacher’s supervisor based on an assessment of the needs of the teacher, the supervisor, the students of the teacher, and any local educational agency employing the teacher, as appropriate; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e41-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/3"><num value="3">(3)</num><chapeau> to provide and implement other effective activities and strategies that enhance or supplement language instruction educational programs for English learners, which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e42-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/3/A"><num value="A">(A)</num><content> shall include parent, family, and community engagement activities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e43-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/c/3/B"><num value="B">(B)</num><content> may include strategies that serve to coordinate and align related programs.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e44-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d"><num value="d" class="bold">(d)</num><heading class="bold"> Authorized subgrantee activities</heading><chapeau style="-uslm-lc:I11" class="indent0">Subject to subsection (c), an eligible entity receiving funds under <ref href="/us/usc/t20/s6824/a">section 6824(a) of this title</ref> may use the funds to achieve any of the purposes described in subsection (a) by undertaking 1 or more of the following activities:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83371e45-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/1"><num value="1">(1)</num><content> Upgrading program objectives and effective instructional strategies.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e46-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/2"><num value="2">(2)</num><content> Improving the instructional program for English learners by identifying, acquiring, and upgrading curricula, instructional materials, educational software, and assessment procedures.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e47-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/3"><num value="3">(3)</num><chapeau> Providing to English learners—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e48-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/3/A"><num value="A">(A)</num><content> tutorials and academic or career and technical education; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e49-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/3/B"><num value="B">(B)</num><content> intensified instruction, which may include materials in a language that the student can understand, interpreters, and translators.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e4a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/4"><num value="4">(4)</num><content> Developing and implementing effective preschool, elementary school, or secondary school language instruction educational programs that are coordinated with other relevant programs and services.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e4b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/5"><num value="5">(5)</num><content> Improving the English language proficiency and academic achievement of English learners.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e4c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/6"><num value="6">(6)</num><chapeau> Providing community participation programs, family literacy services, and parent and family outreach and training activities to English learners and their families—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e4d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/6/A"><num value="A">(A)</num><content> to improve the English language skills of English learners; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e4e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/6/B"><num value="B">(B)</num><content> to assist parents and families in helping their children to improve their academic achievement and becoming active participants in the education of their children.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e4f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/7"><num value="7">(7)</num><chapeau> Improving the instruction of English learners, which may include English learners with a disability, by providing for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e50-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/7/A"><num value="A">(A)</num><content> the acquisition or development of educational technology or instructional materials;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e51-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/7/B"><num value="B">(B)</num><content> access to, and participation in, electronic networks for materials, training, and communication; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e52-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/7/C"><num value="C">(C)</num><content> incorporation of the resources described in subparagraphs (A) and (B) into curricula and programs, such as those funded under this subpart.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e53-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/8"><num value="8">(8)</num><content> Offering early college high school or dual or concurrent enrollment programs or courses designed to help English learners achieve success in postsecondary education.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83371e54-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/d/9"><num value="9">(9)</num><content> Carrying out other activities that are consistent with the purposes of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e55-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e"><num value="e" class="bold">(e)</num><heading class="bold"> Activities by agencies experiencing substantial increases in immigrant children and youth</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83371e56-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">An eligible entity receiving funds under <ref href="/us/usc/t20/s6824/d/1">section 6824(d)(1) of this title</ref> shall use the funds to pay for activities that provide enhanced instructional opportunities for immigrant children and youth, which may include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e57-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1/A"><num value="A">(A)</num><content> family literacy, parent and family outreach, and training activities designed to assist parents and families to become active participants in the education of their children;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e58-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1/B"><num value="B">(B)</num><content> recruitment of, and support for, personnel, including teachers and paraprofessionals who have been specifically trained, or are being trained, to provide services to immigrant children and youth;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e59-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1/C"><num value="C">(C)</num><content> provision of tutorials, mentoring, and academic or career counseling for immigrant children and youth;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e5a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1/D"><num value="D">(D)</num><content> identification, development, and acquisition of curricular materials, educational software, and technologies to be used in the program carried out with awarded funds;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e5b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1/E"><num value="E">(E)</num><content> basic instructional services that are directly attributable to the presence of immigrant children and youth in the local educational agency involved, including the payment of costs of providing additional classroom supplies, costs of transportation, or such other costs as are directly attributable to such additional basic instructional services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e5c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1/F"><num value="F">(F)</num><content> other instructional services that are designed to assist immigrant children and youth to achieve in elementary schools and secondary schools in the United States, such as programs of introduction to the educational system and civics education; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83371e5d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/1/G"><num value="G">(G)</num><content> activities, coordinated with community-based organizations, institutions of higher education, private sector entities, or other entities with expertise in working with immigrants, to assist parents and families of immigrant children and youth by offering comprehensive community services.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83371e5e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Duration of subgrants</heading><content><p style="-uslm-lc:I12" class="indent1">The duration of a subgrant made by a State educational agency under <ref href="/us/usc/t20/s6824/d/1">section 6824(d)(1) of this title</ref> shall be determined by the agency in its discretion.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e5f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/f"><num value="f" class="bold">(f)</num><heading class="bold"> Selection of method of instruction</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83371e60-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">To receive a subgrant from a State educational agency under this subpart, an eligible entity shall select one or more methods or forms of effective instruction to be used in the programs and activities undertaken by the entity to assist English learners to attain English language proficiency and meet challenging State academic standards.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83371e61-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Consistency</heading><content><p style="-uslm-lc:I12" class="indent1">The selection described in paragraph (1) shall be consistent with sections 6845 through 6847 of this title.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83371e62-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s6825/g"><num value="g" class="bold">(g)</num><heading class="bold"> Supplement, not supplant</heading><content><p style="-uslm-lc:I11" class="indent0">Federal funds made available under this subpart shall be used so as to supplement the level of Federal, State, and local public funds that, in the absence of such availability, would have been expended for programs for English learners and immigrant children and youth and in no case to supplant such Federal, State, and local public funds.</p>
