<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida754f277-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101"><num value="7101">§ 7101.</num><heading> General provisions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida754f278-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a"><num value="a" class="bold">(a)</num><heading class="bold"> Parental consent</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida754f279-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida754f27a-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Informed written consent</heading><content><p style="-uslm-lc:I13" class="indent2">A State, local educational agency, or other entity receiving funds under this subchapter shall obtain prior written, informed consent from the parent of each child who is under 18 years of age to participate in any mental-health assessment or service that is funded under this subchapter and conducted in connection with an elementary school or secondary school under this subchapter.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida754f27b-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Contents</heading><content><p style="-uslm-lc:I13" class="indent2">Before obtaining the consent described in subparagraph (A), the entity shall provide the parent written notice describing in detail such mental health assessment or service, including the purpose for such assessment or service, the provider of such assessment or service, when such assessment or service will begin, and how long such assessment or service may last.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida754f27c-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">The informed written consent required under this paragraph shall not be a waiver of any rights or protections under <ref href="/us/usc/t20/s1232g">section 1232g of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida754f27d-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception</heading><chapeau>Notwithstanding paragraph (1)(A), the written, informed consent described in such paragraph shall not be required in—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida754f27e-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/2/A"><num value="A">(A)</num><content> an emergency, where it is necessary to protect the immediate health and safety of the child, other children, or entity personnel; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida754f27f-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/2/B"><num value="B">(B)</num><chapeau> other instances in which an entity actively seeks parental consent but such consent cannot be reasonably obtained, as determined by the State or local educational agency, including in the case of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida754f280-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/2/B/i"><num value="i">(i)</num><content> a child whose parent has not responded to the notice described in paragraph (1)(B); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida754f281-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/a/2/B/ii"><num value="ii">(ii)</num><content> a child who has attained 14 years of age and is an unaccompanied youth, as defined in <ref href="/us/usc/t42/s11434a">section 11434a of title 42</ref>.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida754f282-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/b"><num value="b" class="bold">(b)</num><heading class="bold"> Prohibited use of funds</heading><content><p style="-uslm-lc:I11" class="indent0">No funds under this subchapter may be used for medical services or drug treatment or rehabilitation, except for integrated student supports, specialized instructional support services, or referral to treatment for impacted students, which may include students who are victims of, or witnesses to, crime or who illegally use drugs.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida754f283-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/c"><num value="c" class="bold">(c)</num><heading class="bold"> Prohibition on mandatory medication</heading><chapeau>No child shall be required to obtain a prescription for a controlled substance, as defined in <ref href="/us/usc/t21/s802">section 802 of title 21</ref> as a condition of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida754f284-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/c/1"><num value="1">(1)</num><content> receiving an evaluation or other service described under this subchapter; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida754f285-138c-11e6-9f43-fbe3da20a848" identifier="/us/usc/t20/s7101/c/2"><num value="2">(2)</num><content> attending a school receiving assistance under this subchapter.</content>
