<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id833c0005-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116"><num value="7116">§ 7116.</num><heading> Local educational agency applications</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id833c0006-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/a"><num value="a" class="bold">(a)</num><heading class="bold"> Eligibility</heading><chapeau style="-uslm-lc:I11" class="indent0">To be eligible to receive an allocation under <ref href="/us/usc/t20/s7115/a">section 7115(a) of this title</ref>, a local educational agency shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id833c0007-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/a/1"><num value="1">(1)</num><content> submit an application, which shall contain, at a minimum, the information described in subsection (e), to the State educational agency at such time, in such manner, and containing such information as the State educational agency may reasonably require; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id833c0008-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/a/2"><num value="2">(2)</num><content> complete a needs assessment in accordance with subsection (d).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id833c0009-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/b"><num value="b" class="bold">(b)</num><heading class="bold"> Consortium</heading><content><p style="-uslm-lc:I11" class="indent0">If a local educational agency desires to carry out the activities described in this subpart in consortium with one or more surrounding local educational agencies as described in <ref href="/us/usc/t20/s7115/a/3">section 7115(a)(3) of this title</ref>, such local educational agencies shall submit a single application as required under subsection (a).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id833c000a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/c"><num value="c" class="bold">(c)</num><heading class="bold"> Consultation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id833c000b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A local educational agency, or consortium of such agencies, shall develop its application through consultation with parents, teachers, principals, other school leaders, specialized instructional support personnel, students, community-based organizations, local government representatives (which may include a local law enforcement agency, local juvenile court, local child welfare agency, or local public housing agency), Indian tribes or tribal organizations that may be located in the region served by the local educational agency (where applicable), charter school teachers, principals, and other school leaders (if such agency or consortium of such agencies supports charter schools), and others with relevant and demonstrated expertise in programs and activities designed to meet the purpose of this subpart.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id833c000c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Continued consultation</heading><content><p style="-uslm-lc:I12" class="indent1">The local educational agency, or consortium of such agencies, shall engage in continued consultation with the entities described in paragraph (1) in order to improve the local activities in order to meet the purpose of this subpart and to coordinate such implementation with other related strategies, programs, and activities being conducted in the community.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id833c000d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/d"><num value="d" class="bold">(d)</num><heading class="bold"> Needs assessment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id833c000e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2) and prior to receiving an allocation under this subpart, a local educational agency or consortium of such agencies shall conduct a comprehensive needs assessment of the local educational agency or agencies proposed to be served under this subpart in order to examine needs for improvement of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id833c000f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/d/1/A"><num value="A">(A)</num><content> access to, and opportunities for, a well-rounded education for all students;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833c0010-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/d/1/B"><num value="B">(B)</num><content> school conditions for student learning in order to create a healthy and safe school environment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833c0011-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/d/1/C"><num value="C">(C)</num><content> access to personalized learning experiences supported by technology and professional development for the effective use of data and technology.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id833c0012-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I12" class="indent1">A local educational agency receiving an allocation under <ref href="/us/usc/t20/s7115/a">section 7115(a) of this title</ref> in an amount that is less than $30,000 shall not be required to conduct a comprehensive needs assessment under paragraph (1).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id833c0013-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Frequency of needs assessment</heading><content><p style="-uslm-lc:I12" class="indent1">Each local educational agency, or consortium of local educational agencies, shall conduct the needs assessment described in paragraph (1) once every 3 years.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id833c0014-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e"><num value="e" class="bold">(e)</num><heading class="bold"> Contents of local application</heading><chapeau style="-uslm-lc:I11" class="indent0">Each application submitted under this section by a local educational agency, or a consortium of such agencies, shall include the following:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id833c0015-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Descriptions</heading><chapeau style="-uslm-lc:I12" class="indent1">A description of the activities and programming that the local educational agency, or consortium of such agencies, will carry out under this subpart, including a description of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id833c0016-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/1/A"><num value="A">(A)</num><content> any partnership with an institution of higher education, business, nonprofit organization, community-based organization, or other public or private entity with a demonstrated record of success in implementing activities under this subpart;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833c0017-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/1/B"><num value="B">(B)</num><content> if applicable, how funds will be used for activities related to supporting well-rounded education under <ref href="/us/usc/t20/s7117">section 7117 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833c0018-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/1/C"><num value="C">(C)</num><content> if applicable, how funds will be used for activities related to supporting safe and healthy students under <ref href="/us/usc/t20/s7118">section 7118 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833c0019-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/1/D"><num value="D">(D)</num><content> if applicable, how funds will be used for activities related to supporting the effective use of technology in schools under <ref href="/us/usc/t20/s7119">section 7119 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833c001a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/1/E"><num value="E">(E)</num><content> the program objectives and intended outcomes for activities under this subpart, and how the local educational agency, or consortium of such agencies, will periodically evaluate the effectiveness of the activities carried out under this section based on such objectives and outcomes.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id833e4a0b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Assurances</heading><chapeau style="-uslm-lc:I12" class="indent1">Each application shall include assurances that the local educational agency, or consortium of such agencies, will—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id833e4a0c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/A"><num value="A">(A)</num><chapeau> prioritize the distribution of funds to schools served by the local educational agency, or consortium of such agencies, that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id833e4a0d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/A/i"><num value="i">(i)</num><content> are among the schools with the greatest needs, as determined by such local educational agency, or consortium;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id833e4a0e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/A/ii"><num value="ii">(ii)</num><content> have the highest percentages or numbers of children counted under <ref href="/us/usc/t20/s6333/c">section 6333(c) of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id833e4a0f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/A/iii"><num value="iii">(iii)</num><content> are identified for comprehensive support and improvement under <ref href="/us/usc/t20/s6311/c/4/D/i">section 6311(c)(4)(D)(i) of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id833e4a10-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/A/iv"><num value="iv">(iv)</num><content> are implementing targeted support and improvement plans as described in <ref href="/us/usc/t20/s6311/d/2">section 6311(d)(2) of this title</ref>; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id833e4a11-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/A/v"><num value="v">(v)</num><content> are identified as a persistently dangerous public elementary school or secondary school under <ref href="/us/usc/t20/s7912">section 7912 of this title</ref>;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833e4a12-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/B"><num value="B">(B)</num><content> comply with <ref href="/us/usc/t20/s7881">section 7881 of this title</ref> (regarding equitable participation by private school children and teachers);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833e4a13-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/C"><num value="C">(C)</num><content> use not less than 20 percent of funds received under this subpart to support one or more of the activities authorized under <ref href="/us/usc/t20/s7117">section 7117 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833e4a14-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/D"><num value="D">(D)</num><content> use not less than 20 percent of funds received under this subpart to support one or more activities authorized under <ref href="/us/usc/t20/s7118">section 7118 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833e4a15-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/E"><num value="E">(E)</num><content> use a portion of funds received under this subpart to support one or more activities authorized under <ref href="/us/usc/t20/s7119/a">section 7119(a) of this title</ref>, including an assurance that the local educational agency, or consortium of local educational agencies, will comply with <ref href="/us/usc/t20/s7119/b">section 7119(b) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id833e4a16-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/e/2/F"><num value="F">(F)</num><content> annually report to the State for inclusion in the report described in <ref href="/us/usc/t20/s7114/a/2">section 7114(a)(2) of this title</ref> how funds are being used under this subpart to meet the requirements of subparagraphs (C) through (E).</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id833e4a17-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7116/f"><num value="f" class="bold">(f)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I11" class="indent0">Any local educational agency receiving an allocation under <ref href="/us/usc/t20/s7115/a/1">section 7115(a)(1) of this title</ref> in an amount less than $30,000 shall be required to provide only one of the assurances described in subparagraphs (C), (D), and (E) of subsection (e)(2).</p>
