and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3124-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/a/1/B\"><num value=\"B\">(B)</num><content> rigorously evaluate such innovations, in accordance with subsection (e).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id834a3125-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Description of grants</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The grants described in paragraph (1) shall include—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3126-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/a/2/A\"><num value=\"A\">(A)</num><content> early-phase grants to fund the development, implementation, and feasibility testing of a program, which prior research suggests has promise, for the purpose of determining whether the program can successfully improve student achievement or attainment for high-need students;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3127-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/a/2/B\"><num value=\"B\">(B)</num><content> mid-phase grants to fund implementation and a rigorous evaluation of a program that has been successfully implemented under an early-phase grant described in subparagraph (A) or other effort meeting similar criteria, for the purpose of measuring the program’s impact and cost effectiveness, if possible using existing administrative data; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3128-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/a/2/C\"><num value=\"C\">(C)</num><chapeau> expansion grants to fund implementation and a rigorous replication evaluation of a program that has been found to produce sizable, important impacts under a mid-phase grant described in subparagraph (B) or other effort meeting similar criteria, for the purposes of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id834a3129-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/a/2/C/i\"><num value=\"i\">(i)</num><content> determining whether such impacts can be successfully reproduced and sustained over time; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id834a312a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/a/2/C/ii\"><num value=\"ii\">(ii)</num><content> identifying the conditions in which the program is most effective.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id834a312b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Eligible entity</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this subpart, the term “eligible entity” means any of the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a312c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/1\"><num value=\"1\">(1)</num><content> A local educational agency.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a312d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/2\"><num value=\"2\">(2)</num><content> A State educational agency.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a312e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/3\"><num value=\"3\">(3)</num><content> The Bureau of Indian Education.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a312f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/4\"><num value=\"4\">(4)</num><content> A consortium of State educational agencies or local educational agencies.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a3130-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/5\"><num value=\"5\">(5)</num><content> A nonprofit organization.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a3131-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/6\"><num value=\"6\">(6)</num><chapeau> A State educational agency, a local educational agency, a consortium described in paragraph (4), or the Bureau of Indian Education, in partnership with—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3132-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/6/A\"><num value=\"A\">(A)</num><content> a nonprofit organization;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3133-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/6/B\"><num value=\"B\">(B)</num><content> a business;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3134-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/6/C\"><num value=\"C\">(C)</num><content> an educational service agency; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3135-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/b/6/D\"><num value=\"D\">(D)</num><content> an institution of higher education.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id834a3136-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Rural areas</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id834a3137-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In awarding grants under subsection (a), the Secretary shall ensure that not less than 25 percent of the funds made available for any fiscal year are awarded for programs that meet both of the following requirements:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3138-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/1/A\"><num value=\"A\">(A)</num><chapeau> The grantee is—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id834a3139-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/1/A/i\"><num value=\"i\">(i)</num><content> a local educational agency with an urban-centric district locale code of 32, 33, 41, 42, or 43, as determined by the Secretary;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id834a313a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/1/A/ii\"><num value=\"ii\">(ii)</num><content> a consortium of such local educational agencies;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id834a313b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/1/A/iii\"><num value=\"iii\">(iii)</num><content> an educational service agency or a nonprofit organization in partnership with such a local educational agency; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id834a313c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/1/A/iv\"><num value=\"iv\">(iv)</num><content> a grantee described in clause (i) or (ii) in partnership with a State educational agency.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a313d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/1/B\"><num value=\"B\">(B)</num><content> A majority of the schools to be served by the program are designated with a locale code of 32, 33, 41, 42, or 43, or a combination of such codes, as determined by the Secretary.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id834a313e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Notwithstanding paragraph (1), the Secretary shall reduce the amount of funds made available under such paragraph if the Secretary does not receive a sufficient number of applications of sufficient quality.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id834a313f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Matching funds</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In order to receive a grant under subsection (a), an eligible entity shall demonstrate that the eligible entity will provide matching funds, in cash or through in-kind contributions, from Federal, State, local, or private sources in an amount equal to 10 percent of the funds provided under such grant, except that the Secretary may waive the matching funds requirement, on a case-by-case basis, upon a showing of exceptional circumstances, such as—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a3140-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d/1\"><num value=\"1\">(1)</num><content> the difficulty of raising matching funds for a program to serve a rural area;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a3141-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d/2\"><num value=\"2\">(2)</num><chapeau> the difficulty of raising matching funds in areas with a concentration of local educational agencies or schools with a high percentage of students aged 5 through 17—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3142-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d/2/A\"><num value=\"A\">(A)</num><content> who are in poverty, as counted in the most recent census data approved by the Secretary;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3143-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d/2/B\"><num value=\"B\">(B)</num><content> who are eligible for a free or reduced price lunch under the Richard B. Russell National School Lunch Act (<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3144-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d/2/C\"><num value=\"C\">(C)</num><content> whose families receive assistance under the State program funded under part A of title IV of the Social Security Act (<ref href=\"/us/usc/t42/s601\">42 U.S.C. 601</ref> et seq.); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id834a3145-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d/2/D\"><num value=\"D\">(D)</num><content> who are eligible to receive medical assistance under the Medicaid program; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a3146-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/d/3\"><num value=\"3\">(3)</num><content> the difficulty of raising funds on tribal land.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id834a3147-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Evaluation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Each recipient of a grant under this section shall conduct an independent evaluation of the effectiveness of the program carried out under such grant.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id834a3148-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Technical assistance</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may reserve not more than 5 percent of the funds appropriated under <ref href=\"/us/usc/t20/s7251/b/2/A\">section 7251(b)(2)(A) of this title</ref> for each fiscal year to—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a3149-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/f/1\"><num value=\"1\">(1)</num><content> provide technical assistance for eligibility entities, which may include pre-application workshops, web-based seminars, and evaluation support; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id834a314a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7261/f/2\"><num value=\"2\">(2)</num><content> to disseminate best practices.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id834a314b-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/10/tIV/s4611\">Pub.
