<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id834a3176-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273"><num value="7273">§ 7273.</num><heading> Program authorized</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834a3177-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a"><num value="a" class="bold">(a)</num><heading class="bold"> Program authorized</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834a3178-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall use not less than 95 percent of the amounts made available under <ref href="/us/usc/t20/s7251/b/2/B">section 7251(b)(2)(B) of this title</ref> to award grants, on a competitive basis and subject to subsection (e), to eligible entities for the following activities:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a3179-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Promise neighborhoods</heading><chapeau style="-uslm-lc:I13" class="indent2">The implementation of a comprehensive, effective continuum of coordinated services that meets the purpose described in <ref href="/us/usc/t20/s7271/1">section 7271(1) of this title</ref> by carrying out activities in neighborhoods with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id834a317a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a/1/A/i"><num value="i">(i)</num><content> high concentrations of low-income individuals;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id834a317b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a/1/A/ii"><num value="ii">(ii)</num><content> multiple signs of distress, which may include high rates of poverty, childhood obesity, academic failure, and juvenile delinquency, adjudication, or incarceration; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id834a317c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a/1/A/iii"><num value="iii">(iii)</num><content> schools implementing comprehensive support and improvement activities or targeted support and improvement activities under <ref href="/us/usc/t20/s6311/d">section 6311(d) of this title</ref>.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a317d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Full-service community schools</heading><content><p style="-uslm-lc:I13" class="indent2">The provision of assistance to public elementary schools or secondary schools to function as full-service community schools.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834a317e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Sufficient size and scope</heading><content><p style="-uslm-lc:I12" class="indent1">Each grant awarded under this subpart shall be of sufficient size and scope to allow the eligible entity to carry out the applicable purposes of this subpart.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834a317f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/b"><num value="b" class="bold">(b)</num><heading class="bold"> Duration</heading><content><p style="-uslm-lc:I11" class="indent0">A grant awarded under this subpart shall be for a period of not more than 5 years, and may be extended for an additional period of not more than 2 years.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834a3180-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/c"><num value="c" class="bold">(c)</num><heading class="bold"> Continued funding</heading><chapeau style="-uslm-lc:I11" class="indent0">Continued funding of a grant under this subpart, including a grant extended under subsection (b), after the third year of the initial grant period shall be contingent on the eligible entity’s progress toward meeting—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id834a3181-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/c/1"><num value="1">(1)</num><content> with respect to a grant for activities described in <ref href="/us/usc/t20/s7274">section 7274 of this title</ref>, the performance metrics described in <ref href="/us/usc/t20/s7274/h">section 7274(h) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id834a3182-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/c/2"><num value="2">(2)</num><content> with respect to a grant for activities described in <ref href="/us/usc/t20/s7275">section 7275 of this title</ref>, annual performance objectives and outcomes under <ref href="/us/usc/t20/s7275/a/4/C">section 7275(a)(4)(C) of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834a3183-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d"><num value="d" class="bold">(d)</num><heading class="bold"> Matching requirements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834a3184-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Promise neighborhood activities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a3185-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Matching funds</heading><content><p style="-uslm-lc:I13" class="indent2">Each eligible entity receiving a grant under this subpart for activities described in <ref href="/us/usc/t20/s7274">section 7274 of this title</ref> shall contribute matching funds in an amount equal to not less than 100 percent of the amount of the grant. Such matching funds shall come from Federal, State, local, and private sources.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a3186-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Private sources</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall require that a portion of the matching funds come from private sources, which may include in-kind contributions.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a3187-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Adjustment</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may adjust the matching funds requirement under this paragraph for applicants that demonstrate high need, including applicants from rural areas and applicants that wish to provide services on tribal lands.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a3188-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Financial hardship waiver</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may waive or reduce, on a case-by-case basis, the matching requirement under this paragraph, including the requirement for funds from private sources, for a period of 1 year at a time, if the eligible entity demonstrates significant financial hardship.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834a3189-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Full-service community schools activities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a318a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Each eligible entity receiving a grant under this subpart for activities described in <ref href="/us/usc/t20/s7275">section 7275 of this title</ref> shall provide matching funds from non-Federal sources, which may be provided in part with in-kind contributions.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a318b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I13" class="indent2">The Bureau of Indian Education may meet the requirement of subparagraph (A) using funds from other Federal sources.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834a318c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Special rules</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a318d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may not require any eligible entity receiving a grant under this subpart to provide matching funds in an amount that exceeds the amount of the grant award.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834a318e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Consideration</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding this subsection, the Secretary shall not consider the ability of an eligible entity to match funds when determining which applicants will receive grants under this subpart.</p>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834a318f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/e"><num value="e" class="bold">(e)</num><heading class="bold"> Reservation for rural areas</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834a3190-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">From the amounts allocated under subsection (a) for grants to eligible entities, the Secretary shall use not less than 15 percent of such amounts to award grants to eligible entities that propose to carry out the activities described in such subsection in rural areas.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834a3191-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exception</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall reduce the amount described in paragraph (1) if the Secretary does not receive a sufficient number of applications of sufficient quality.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834a3192-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7273/f"><num value="f" class="bold">(f)</num><heading class="bold"> Minimum number of grants</heading><content><p style="-uslm-lc:I11" class="indent0">For each fiscal year, the Secretary shall award under this subpart not fewer than 3 grants for activities described in <ref href="/us/usc/t20/s7274">section 7274 of this title</ref> and not fewer than 10 grants for activities described in <ref href="/us/usc/t20/s7275">section 7275 of this title</ref>, subject to the availability of appropriations, the requirements of subsection (a)(2), and the number and quality of applications.</p>
