<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id834ca203-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281"><num value="7281">§ 7281.</num><heading> National activities for school safety</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834ca204-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/a"><num value="a" class="bold">(a)</num><heading class="bold"> Program authorized</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834ca205-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">From the funds reserved under <ref href="/us/usc/t20/s7251/b/1">section 7251(b)(1) of this title</ref>, the Secretary—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id834ca206-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/a/1/A"><num value="A">(A)</num><content> shall use a portion of such funds for the Project School Emergency Response to Violence program (in this section referred to as “Project SERV”), in order to provide education-related services to eligible entities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id834ca207-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/a/1/B"><num value="B">(B)</num><content> may use a portion of such funds to carry out other activities to improve students’ safety and well-being, during and after the school day, under this section directly or through grants, contracts, or cooperative agreements with public or private entities or individuals, or other Federal agencies, such as providing technical assistance to States and local educational agencies carrying out activities under this section or conducting a national evaluation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834ca208-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Availability</heading><content><p style="-uslm-lc:I12" class="indent1">Amounts reserved under <ref href="/us/usc/t20/s7251/b/1">section 7251(b)(1) of this title</ref> for Project SERV are authorized to remain available until expended for Project SERV.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834ca209-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b"><num value="b" class="bold">(b)</num><heading class="bold"> Project SERV</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834ca20a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Additional use of funds</heading><content><p style="-uslm-lc:I12" class="indent1">Funds made available under subsection (a) for extended services grants under Project SERV may be used by an eligible entity to initiate or strengthen violence prevention activities as part of the activities designed to restore the learning environment that was disrupted by the violent or traumatic crisis in response to which the grant was awarded.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834ca20b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Application process</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834ca20c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">An eligible entity desiring to use a portion of extended services grant funds under Project SERV to initiate or strengthen a violence prevention activity shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id834ca20d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2/A/i"><num value="i">(i)</num><content> submit, in an application that meets all requirements of the Secretary for Project SERV, the information described in subparagraph (B); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id834ca20e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2/A/ii"><num value="ii">(ii)</num><content> in the case of an eligible entity that has already received an extended services grant under Project SERV, submit an addition to the original application that includes the information described in subparagraph (B).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id834ca20f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Application requirements</heading><chapeau style="-uslm-lc:I13" class="indent2">An application, or addition to an application, for an extended services grant pursuant to subparagraph (A) shall include the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id834ca210-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2/B/i"><num value="i">(i)</num><content> A demonstration of the need for funds due to a continued disruption or a substantial risk of disruption to the learning environment.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id834ca211-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2/B/ii"><num value="ii">(ii)</num><content> An explanation of the proposed activities that are designed to restore and preserve the learning environment.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id834ca212-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/2/B/iii"><num value="iii">(iii)</num><content> A budget and budget narrative for the proposed activities.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834ca213-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Award basis</heading><content><p style="-uslm-lc:I12" class="indent1">Any award of funds under Project SERV for violence prevention activities under this section shall be subject to the discretion of the Secretary and the availability of funds.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id834ca214-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Prohibited use</heading><content><p style="-uslm-lc:I12" class="indent1">No funds provided to an eligible entity for violence prevention activities may be used for construction, renovation, or repair of a facility or for the permanent infrastructure of the eligible entity.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id834ca215-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/c"><num value="c" class="bold">(c)</num><heading class="bold"> Definition of eligible entity</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section, the term “eligible entity” means—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id834ca216-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/c/1"><num value="1">(1)</num><content> a local educational agency, as defined in subparagraph (A), (B), or (C) of <ref href="/us/usc/t20/s7801/30">section 7801(30) of this title</ref>, or institution of higher education in which the learning environment has been disrupted due to a violent or traumatic crisis; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id834ca217-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7281/c/2"><num value="2">(2)</num><content> the Bureau of Indian Education in a case where the learning environment of a school operated or funded by the Bureau, including a school meeting the definition of a local educational agency under <ref href="/us/usc/t20/s7801/30/C">section 7801(30)(C) of this title</ref>, has been disrupted due to a violent or traumatic crisis.</content>
