<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83515d0c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351"><num value="7351">§ 7351.</num><heading> Program authorized</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83515d0d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants to States</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83515d0e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">From amounts appropriated under <ref href="/us/usc/t20/s7355c">section 7355c of this title</ref> for this subpart for a fiscal year that are not reserved under subsection (c), the Secretary shall award grants (from allotments made under paragraph (2)) for the fiscal year to State educational agencies that have applications submitted under <ref href="/us/usc/t20/s7351b">section 7351b of this title</ref> approved to enable the State educational agencies to award grants to eligible local educational agencies for local authorized activities described in <ref href="/us/usc/t20/s7351a/a">section 7351a(a) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83515d0f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Allotment</heading><content><p style="-uslm-lc:I12" class="indent1">From amounts described in paragraph (1) for a fiscal year, the Secretary shall allot to each State educational agency for that fiscal year an amount that bears the same ratio to those amounts as the number of students in average daily attendance served by eligible local educational agencies in the State for that fiscal year bears to the number of all such students served by eligible local educational agencies in all States for that fiscal year.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83515d10-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Specially qualified agencies</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83515d11-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/a/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Eligibility and application</heading><content><p style="-uslm-lc:I13" class="indent2">If a State educational agency elects not to participate in the program under this subpart or does not have an application submitted under <ref href="/us/usc/t20/s7351b">section 7351b of this title</ref> approved, a specially qualified agency in such State desiring a grant under this subpart may submit an application under such section directly to the Secretary to receive an award under this subpart.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83515d12-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/a/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Direct awards</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may award, on a competitive basis or by formula, the amount the State educational agency is eligible to receive under paragraph (2) directly to a specially qualified agency in the State that has submitted an application in accordance with subparagraph (A) and obtained approval of the application.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83515d13-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/a/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Specially qualified agency defined</heading><content><p style="-uslm-lc:I13" class="indent2">In this subpart, the term “specially qualified agency” means an eligible local educational agency served by a State educational agency that does not participate in a program under this subpart in a fiscal year, that may apply directly to the Secretary for a grant in such year under this subsection.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83515d14-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b"><num value="b" class="bold">(b)</num><heading class="bold"> Local awards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83515d15-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Eligibility</heading><chapeau style="-uslm-lc:I12" class="indent1">A local educational agency shall be eligible to receive a grant under this subpart if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83515d16-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="id83515d17-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/1/A/i"><num value="i">(i)</num><content> 20 percent or more of the children ages 5 through 17 years served by the local educational agency are from families with incomes below the poverty line; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id83515d18-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/1/A/ii"><num value="ii">(ii)</num><content> all of the schools served by the agency are designated with a locale code of 32, 33, 41, 42, or 43, as determined by the Secretary; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83515d19-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/1/B"><num value="B">(B)</num><content> the agency meets the criteria established in clause (i) of subparagraph (A) and the Secretary, in accordance with paragraph (2), grants the local educational agency’s request to waive the criteria described in clause (ii) of such subparagraph.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83515d1a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Certification</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall determine whether to waive the criteria described in paragraph (1)(A)(ii) based on a demonstration by the local educational agency, and concurrence by the State educational agency, that the local educational agency is located in an area defined as rural by a governmental agency of the State.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83515d1b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Award basis</heading><chapeau style="-uslm-lc:I12" class="indent1">A State educational agency shall award grants to eligible local educational agencies—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83515d1c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/3/A"><num value="A">(A)</num><content> on a competitive basis;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83515d1d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/3/B"><num value="B">(B)</num><content> according to a formula based on the number of students in average daily attendance served by the eligible local educational agencies or schools in the State; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83515d1e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/b/3/C"><num value="C">(C)</num><content> according to an alternative formula, if, prior to awarding the grants, the State educational agency demonstrates, to the satisfaction of the Secretary, that the alternative formula enables the State educational agency to allot the grant funds in a manner that serves equal or greater concentrations of children from families with incomes below the poverty line, relative to the concentrations that would be served if the State educational agency used the formula described in subparagraph (B).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83515d1f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/c"><num value="c" class="bold">(c)</num><heading class="bold"> Reservations</heading><chapeau style="-uslm-lc:I11" class="indent0">From amounts appropriated under <ref href="/us/usc/t20/s7355c">section 7355c of this title</ref> for this subpart for a fiscal year, the Secretary shall reserve—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83515d20-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/c/1"><num value="1">(1)</num><content> one-half of 1 percent to make awards to elementary schools or secondary schools operated or supported by the Bureau of Indian Education, to carry out the activities authorized under this subpart; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83515d21-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7351/c/2"><num value="2">(2)</num><content> one-half of 1 percent to make awards to the outlying areas in accordance with their respective needs, to carry out the activities authorized under this subpart.</content>
