<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8353cdb5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423"><num value="7423">§ 7423.</num><heading> Amount of grants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8353cdb6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/a"><num value="a" class="bold">(a)</num><heading class="bold"> Amount of grant awards</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8353cdb7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in subsection (b) and paragraph (2), the Secretary shall allocate to each local educational agency that has an approved application under this subpart an amount equal to the product of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8353cdb8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/a/1/A"><num value="A">(A)</num><content> the number of Indian children who are eligible under <ref href="/us/usc/t20/s7427">section 7427 of this title</ref> and served by such agency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8353cdb9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/a/1/B"><num value="B">(B)</num><chapeau> the greater of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8353cdba-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/a/1/B/i"><num value="i">(i)</num><content> the average per pupil expenditure of the State in which such agency is located; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8353cdbb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/a/1/B/ii"><num value="ii">(ii)</num><content> 80 percent of the average per pupil expenditure of all the States.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8353cdbc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reduction</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall reduce the amount of each allocation otherwise determined under this section in accordance with subsection (e).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8353cdbd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/b"><num value="b" class="bold">(b)</num><heading class="bold"> Minimum grant</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8353cdbe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding subsection (e), an entity that is eligible for a grant under <ref href="/us/usc/t20/s7422">section 7422 of this title</ref>, and a school that is operated or supported by the Bureau of Indian Education that is eligible for a grant under subsection (d), that submits an application that is approved by the Secretary, shall, subject to appropriations, receive a grant under this subpart in an amount that is not less than $3,000.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8353cdbf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Consortia</heading><content><p style="-uslm-lc:I12" class="indent1">Local educational agencies may form a consortium for the purpose of obtaining grants under this subpart.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8353cdc0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Increase</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may increase the minimum grant under paragraph (1) to not more than $4,000 for all grantees if the Secretary determines such increase is necessary to ensure the quality of the programs provided.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8353cdc1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/c"><num value="c" class="bold">(c)</num><heading class="bold"> Definition</heading><chapeau style="-uslm-lc:I11" class="indent0">For the purpose of this section, the term “average per pupil expenditure”, used with respect to a State, means an amount equal to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8353cdc2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/c/1"><num value="1">(1)</num><content> the sum of the aggregate current expenditures of all the local educational agencies in the State, plus any direct current expenditures by the State for the operation of such agencies, without regard to the sources of funds from which such local or State expenditures were made, during the second fiscal year preceding the fiscal year for which the computation is made; divided by</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8353cdc3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/c/2"><num value="2">(2)</num><content> the aggregate number of children who were included in average daily attendance for whom such agencies provided free public education during such preceding fiscal year.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8353cdc4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d"><num value="d" class="bold">(d)</num><heading class="bold"> Schools operated or supported by the Bureau of Indian Education</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8353cdc5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Subject to subsection (e), in addition to the grants awarded under subsection (a), the Secretary shall allocate to the Secretary of the Interior an amount equal to the product of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8353cdc6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/1/A"><num value="A">(A)</num><chapeau> the total number of Indian children enrolled in schools that are operated by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8353cdc7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/1/A/i"><num value="i">(i)</num><content> the Bureau of Indian Education; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8353cdc8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/1/A/ii"><num value="ii">(ii)</num><content> an Indian tribe, or an organization controlled or sanctioned by an Indian tribal government, for the children of that tribe under a contract with, or grant from, the Department of the Interior under the Indian Self-Determination Act [<ref href="/us/usc/t25/s5321">25 U.S.C. 5321</ref> et seq.] or the Tribally Controlled Schools Act of 1988 [<ref href="/us/usc/t25/s2501">25 U.S.C. 2501</ref> et seq.]; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8353cdc9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/1/B"><num value="B">(B)</num><chapeau> the greater of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8353cdca-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/1/B/i"><num value="i">(i)</num><content> the average per pupil expenditure of the State in which the school is located; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8353cdcb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/1/B/ii"><num value="ii">(ii)</num><content> 80 percent of the average per pupil expenditure of all the States.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8353cdcc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7423/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Special rule</heading><content><p style="-uslm-lc:I12" class="indent1">Any school described in paragraph (1)(A) that wishes to receive an allocation under this subpart shall submit an application in accordance with <ref href="/us/usc/t20/s7424">section 7424 of this title</ref>, and shall otherwise be treated as a local educational agency for the purpose of this subpart, except that such school shall not be subject to <ref href="/us/usc/t20/s7424/c/4">section 7424(c)(4) of this title</ref>, <ref href="/us/usc/t20/s7428/c">section 7428(c) of this title</ref>, or <ref href="/us/usc/t20/s7429">section 7429 of this title</ref>.</p>
