<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id835888eb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452"><num value="7452">§ 7452.</num><heading> Grants to tribes for education administrative planning, development, and coordination</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id835888ec-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may award grants under this section to eligible applicants to enable the eligible applicants to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id835888ed-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/a/1"><num value="1">(1)</num><content> promote tribal self-determination in education;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id835888ee-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/a/2"><num value="2">(2)</num><content> improve the academic achievement of Indian children and youth; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id835888ef-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/a/3"><num value="3">(3)</num><content> promote the coordination and collaboration of tribal educational agencies with State educational agencies and local educational agencies to meet the unique educational and culturally related academic needs of Indian students.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id835888f0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/b"><num value="b" class="bold">(b)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id835888f1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Eligible applicant</heading><chapeau style="-uslm-lc:I12" class="indent1">In this section, the term “eligible applicant” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id835888f2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/b/1/A"><num value="A">(A)</num><content> an Indian tribe or tribal organization approved by an Indian tribe; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id835888f3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/b/1/B"><num value="B">(B)</num><content> a tribal educational agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id835888f4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Indian tribe</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Indian tribe” means a federally recognized tribe or a State-recognized tribe.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id835888f5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Tribal educational agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “tribal educational agency” means the agency, department, or instrumentality of an Indian tribe that is primarily responsible for supporting tribal students’ elementary and secondary education.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id835888f6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c"><num value="c" class="bold">(c)</num><heading class="bold"> Grant program</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary may award grants to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id835888f7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/1"><num value="1">(1)</num><content> eligible applicants described under subsection (b)(1)(A) to plan and develop a tribal educational agency, if the tribe or organization has no current tribal educational agency, for a period of not more than 1 year; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id835888f8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/2"><num value="2">(2)</num><chapeau> eligible applicants described under subsection (b)(1)(B), for a period of not more than 3 years, in order to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id835888f9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/2/A"><num value="A">(A)</num><content> directly administer education programs, including formula grant programs under this chapter, consistent with State law and under a written agreement between the parties;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id835888fa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/2/B"><num value="B">(B)</num><content> build capacity to administer and coordinate such education programs, and to improve the relationship and coordination between such applicants and the State educational agencies and local educational agencies that educate students from the tribe;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id835888fb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/2/C"><num value="C">(C)</num><content> receive training and support from the State educational agency and local educational agency, in areas such as data collection and analysis, grants management and monitoring, fiscal accountability, and other areas as needed;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id835888fc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/2/D"><num value="D">(D)</num><content> train and support the State educational agency and local educational agency in areas related to tribal history, language, or culture;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id835888fd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/2/E"><num value="E">(E)</num><content> build on existing activities or resources rather than replacing other funds; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id835888fe-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/c/2/F"><num value="F">(F)</num><content> carry out other activities, consistent with the purposes of this section.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id835888ff-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d"><num value="d" class="bold">(d)</num><heading class="bold"> Grant application</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83588900-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each eligible applicant desiring a grant under this section shall submit an application to the Secretary at such time and in such manner as the Secretary may reasonably prescribe.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83588901-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I12" class="indent1">Each application described in paragraph (1) shall contain—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83588902-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/2/A"><num value="A">(A)</num><content> a statement describing the activities to be conducted, and the objectives to be achieved, under the grant;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83588903-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/2/B"><num value="B">(B)</num><content> a description of the method to be used for evaluating the effectiveness of the activities for which assistance is sought and for determining whether such objectives are achieved; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83588904-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/2/C"><num value="C">(C)</num><chapeau> for applications for activities under subsection (c)(2), evidence of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83588905-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/2/C/i"><num value="i">(i)</num><content> a preliminary agreement with the appropriate State educational agency, 1 or more local educational agencies, or both the State educational agency and a local educational agency; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83588906-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/2/C/ii"><num value="ii">(ii)</num><content> existing capacity as a tribal educational agency.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83588907-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Approval</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may approve an application submitted by an eligible applicant under this subsection if the application, including any documentation submitted with the application—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83588908-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/3/A"><num value="A">(A)</num><content> demonstrates that the eligible applicant has consulted with other education entities, if any, within the territorial jurisdiction of the applicant that will be affected by the activities to be conducted under the grant;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83588909-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/3/B"><num value="B">(B)</num><content> provides for consultation with such other education entities in the operation and evaluation of the activities conducted under the grant; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8358890a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/d/3/C"><num value="C">(C)</num><content> demonstrates that there will be adequate resources provided under this section or from other sources to complete the activities for which assistance is sought.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8358890b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/e"><num value="e" class="bold">(e)</num><heading class="bold"> Restrictions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8358890c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7452/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An Indian tribe may not receive funds under this section if the tribe receives funds under section 1140 of the Education Amendments of 1978 (<ref href="/us/usc/t20/s2020">20 U.S.C. 2020</ref>).<ref class="footnoteRef" idref="fn002210">1</ref><note type="footnote" id="fn002210"><num>1</num> So in original.
