<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id83588989-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491"><num value="7491">§ 7491.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this part:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8358898a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/1"><num value="1" class="bold">(1)</num><heading class="bold"> Adult</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “adult” means an individual who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8358898b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/1/A"><num value="A">(A)</num><content> has attained the age of 16 years; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8358898c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/1/B"><num value="B">(B)</num><content> has attained an age that is greater than the age of compulsory school attendance under an applicable State law.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8358898d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/2"><num value="2" class="bold">(2)</num><heading class="bold"> Free public education</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “free public education” means education that is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8358898e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/2/A"><num value="A">(A)</num><content> provided at public expense, under public supervision and direction, and without tuition charge; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8358898f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/2/B"><num value="B">(B)</num><content> provided as elementary or secondary education in the applicable State or to preschool children.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83588990-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3"><num value="3" class="bold">(3)</num><heading class="bold"> Indian</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “Indian” means an individual who is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83588991-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3/A"><num value="A">(A)</num><chapeau> a member of an Indian tribe or band, as membership is defined by the tribe or band, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83588992-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3/A/i"><num value="i">(i)</num><content> any tribe or band terminated since 1940; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83588993-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3/A/ii"><num value="ii">(ii)</num><content> any tribe or band recognized by the State in which the tribe or band resides;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83588994-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3/B"><num value="B">(B)</num><content> a descendant, in the first or second degree, of an individual described in subparagraph (A);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83588995-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3/C"><num value="C">(C)</num><content> considered by the Secretary of the Interior to be an Indian for any purpose;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83588996-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3/D"><num value="D">(D)</num><content> an Eskimo, Aleut, or other Alaska Native; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83588997-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/3/E"><num value="E">(E)</num><content> a member of an organized Indian group that received a grant under the Indian Education Act of 1988 as in effect the day preceding <date date="1994-10-20">October 20, 1994</date>.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83588998-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7491/4"><num value="4" class="bold">(4)</num><heading class="bold"> Traditional leaders</heading><content><p style="-uslm-lc:I12" class="indent1">The term “traditional leaders” has the meaning given the term in <ref href="/us/usc/t25/s2902">section 2902 of title 25</ref>.</p>
