The functions of such bureau shall be those authorized by this subchapter. The use for the purposes of the Gallery of any part of the building transferred to the Smithsonian Institution pursuant to the Act of <date date=\"1958-03-28\">March 28, 1958</date> (<ref href=\"/us/stat/72/68\">72 Stat. 68</ref>), is authorized.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6b8c0e67-d2f2-11e9-aa7d-f436298d01bb\" identifier=\"/us/usc/t20/s75b/b\"><num value=\"b\">(b)</num><content> The Gallery shall function as a free public museum for the exhibition and study of portraiture and statuary depicting men and women who have made significant contributions to the history, development, and culture of the people of the United States and of the artists who created such portraiture and statuary.</content>\n</subsection>\n<sourceCredit id=\"id6b8c0e68-d2f2-11e9-aa7d-f436298d01bb\">(<ref href=\"/us/pl/87/443/s3\">Pub. L. 108–72, § 3</ref>, <date date=\"2003-08-15\">Aug. 15, 2003</date>, <ref href=\"/us/stat/117/888\">117 Stat. 888</ref>, provided that:<quotedContent origin=\"/us/pl/108/72/s3\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Authorization of Use of Funds.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Board of Regents of the Smithsonian Institution may plan, design, and construct improvements to the interior and exterior of the Patent Office Building (including the construction of a roof covering for the courtyard), using funds available to the Institution from nonappropriated sources.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Definition</inline>.—</heading><content>In this section, the term ‘Patent Office Building’ means the building transferred to the Smithsonian Institution pursuant to <ref href=\"/us/pl/85/357\">Public Law 85–357</ref> [<ref href=\"/us/stat/72/68\">72 Stat. 68</ref>].</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Design and Specifications</inline>.—</heading><chapeau>The design and specifications for any exterior alterations authorized by subsection (a) shall be—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> submitted by the Secretary of the Smithsonian Institution (referred to in this section as the ‘Secretary’) to the Commission of Fine Arts for comments and recommendations; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> subject to the review and approval of the National Capital Planning Commission in accordance with <ref href=\"/us/usc/t40/s8722\">section 8722 of title 40</ref>, United States Code, and <ref href=\"/us/act/1938-06-20/s16\">section 16 of the Act of June 20, 1938</ref> (sec. 6–641.15, D.C. Official Code).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Authority of Historic Preservation Agencies.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> take into account the effect of the improvements authorized by subsection (a) on the historic character of the Patent Office Building; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> provide the Advisory Council on Historic Preservation a reasonable opportunity to comment with regard to such improvements.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Status of smithsonian</inline>.—</heading><content>In carrying out this subsection, and in carrying out other projects in the District of Columbia which are subject to the review and approval of the National Capital Planning Commission in accordance with <ref href=\"/us/act/1938-06-20/s16\">section 16 of the Act of June 20, 1938</ref> (sec. 6–641.15, D.C.
