H, title III, § 311(d), Mar. 23, 2018, 132 Stat. 750.)","seq_in_title":1736,"parent_identifier":"/us/usc/t20/ch70/schVII","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70","level":"chapter","num":"CHAPTER 70—","heading":"STRENGTHENING AND IMPROVEMENT OF ELEMENTARY AND SECONDARY SCHOOLS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schVII","level":"subchapter","num":"SUBCHAPTER VII—","heading":"IMPACT AID","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id835fb442-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703\"><num value=\"7703\">§ 7703.</num><heading> Payments for eligible federally connected children</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id835fb443-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Computation of payment</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id835fb444-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For the purpose of computing the amount that a local educational agency is eligible to receive under subsection (b) or (d) for any fiscal year, the Secretary shall determine the number of children who were in average daily attendance in the schools of such agency, and for whom such agency provided free public education, during the preceding school year and who, while in attendance at such schools—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb445-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/A\"><num value=\"A\">(A)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb446-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/A/i\"><num value=\"i\">(i)</num><content> resided on Federal property with a parent employed on Federal property situated in whole or in part within the boundaries of the school district of such agency; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb447-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/A/ii\"><num value=\"ii\">(ii)</num><content> resided on Federal property with a parent who is an official of, and accredited by, a foreign government and is a foreign military officer;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb448-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/B\"><num value=\"B\">(B)</num><content> resided on Federal property and had a parent on active duty in the uniformed services (as defined in <ref href=\"/us/usc/t37/s101\">section 101 of title 37</ref>);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb449-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/C\"><num value=\"C\">(C)</num><content> resided on Indian lands;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb44a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/D\"><num value=\"D\">(D)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb44b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/D/i\"><num value=\"i\">(i)</num><content> had a parent on active duty in the uniformed services (as defined by <ref href=\"/us/usc/t37/s101\">section 101 of title 37</ref>) but did not reside on Federal property; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb44c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/D/ii\"><num value=\"ii\">(ii)</num><content> had a parent who is an official of, and has been accredited by, a foreign government and is a foreign military officer but did not reside on Federal property;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb44d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/E\"><num value=\"E\">(E)</num><content> resided in low-rent housing;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb44e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/F\"><num value=\"F\">(F)</num><content> resided on Federal property and is not described in subparagraph (A) or (B); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb44f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/G\"><num value=\"G\">(G)</num><chapeau> resided with a parent employed on Federal property situated—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb450-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/G/i\"><num value=\"i\">(i)</num><content> in whole or in part in the county in which such agency is located, or in whole or in part in such agency if such agency is located in more than one county; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb451-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/1/G/ii\"><num value=\"ii\">(ii)</num><content> if not in such county, in whole or in part in the same State as such agency.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id835fb452-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Determination of weighted student units</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For the purpose of computing the basic support payment under subsection (b), the Secretary shall calculate the total number of weighted student units for a local educational agency by adding together the results obtained by the following computations:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb453-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/A\"><num value=\"A\">(A)</num><content> Multiply the number of children described in subparagraphs (A) and (B) of paragraph (1) by a factor of 1.0.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb454-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/B\"><num value=\"B\">(B)</num><content> Multiply the number of children described in paragraph (1)(C) by a factor of 1.25.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb455-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/C\"><num value=\"C\">(C)</num><chapeau> Multiply the number of children described in subparagraphs (A) and (B) of paragraph (1) by a factor of .35 if the local educational agency has—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb456-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/C/i\"><num value=\"i\">(i)</num><content> a number of such children described in such subparagraphs which exceeds 5,000; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb457-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/C/ii\"><num value=\"ii\">(ii)</num><content> an average daily attendance for all children which exceeds 100,000.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb458-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/D\"><num value=\"D\">(D)</num><content> Multiply the number of children described in subparagraph (D) of paragraph (1) by a factor of .20.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb459-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/E\"><num value=\"E\">(E)</num><content> Multiply the number of children described in subparagraph (E) of paragraph (1) by a factor of .10.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb45a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/2/F\"><num value=\"F\">(F)</num><content> Multiply the number of children described in subparagraphs (F) and (G) of paragraph (1) by a factor of .05.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id835fb45b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Special rule</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall only compute a payment for a local educational agency for children described in subparagraph (F) or (G) of paragraph (1) if the number of such children equals or exceeds 1,000 or such number equals or exceeds 10 percent of the total number of students in average daily attendance in the schools of such agency.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id835fb45c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Military installation and Indian housing undergoing renovation or rebuilding</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb45d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Military installation housing</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Beginning in fiscal year 2014, in determining the amount of a payment for a local educational agency for children described in paragraph (1)(D)(i), the Secretary shall consider those children as if they were children described in paragraph (1)(B) if the Secretary determines, on the basis of a certification provided to the Secretary by a designated representative of the Secretary of Defense, that those children would have resided in housing on Federal property if the housing was not undergoing renovation or rebuilding. The total number of children treated as children described in paragraph (1)(B) shall not exceed the lessor of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb45e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4/A/i\"><num value=\"i\">(i)</num><content> the total number of children eligible under paragraph (1)(B) for the year prior to the initiation of the housing project on Federal property undergoing renovation or rebuilding; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb45f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4/A/ii\"><num value=\"ii\">(ii)</num><content> the total number of Federally connected children enrolled at the local educational agency as stated in the application filed for the payment for the year for which the determination is made.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb460-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Indian lands</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Beginning in fiscal year 2014, in determining the amount of a payment for a local educational agency that received a payment for children that resided on Indian lands in accordance with paragraph (1)(C) for the fiscal year prior to the fiscal year for which the local educational agency is making an application, the Secretary shall consider those children to be children described in paragraph (1)(C) if the Secretary determines on the basis of a certification provided to the Secretary by a designated representative of the Secretary of the Interior or the Secretary of Housing and Urban Development that those children would have resided in housing on Indian lands if the housing was not undergoing renovation or rebuilding. The total number of children treated as children described in paragraph (1)(C) shall not exceed the lessor of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb461-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4/B/i\"><num value=\"i\">(i)</num><content> the total number of children eligible under paragraph (1)(C) for the year prior to the initiation of the housing project on Indian lands undergoing renovation or rebuilding; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb462-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4/B/ii\"><num value=\"ii\">(ii)</num><content> the total number of Federally connected children enrolled at the local educational agency as stated in the application filed for the payment for the year for which the determination is made.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb463-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Eligible housing</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Renovation or rebuilding shall be defined as projects considered as capitalization, modernization, or restoration, as defined by the Secretary of Defense or the Secretary of the Interior (as the case may be) and are projects that last more than 30 days, but do not include “sustainment projects” such as painting, carpeting, or minor repairs.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id835fb464-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Military “Build to Lease” program housing</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb465-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of computing the amount of payment for a local educational agency for children identified under paragraph (1), the Secretary shall consider children residing in housing initially acquired or constructed under the former <ref href=\"/us/usc/t10/s2828/g\">section 2828(g) of title 10</ref> (commonly known as the “Build to Lease” program), as added by section 801 of the Military Construction Authorization Act, 1984, or under lease of off-base property under subchapter IV of chapter 169 of title 10, to be children described under paragraph (1)(B), if the property described is—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb466-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/5/A/i\"><num value=\"i\">(i)</num><content> within the fenced security perimeter of the military facility; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb467-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/5/A/ii\"><num value=\"ii\">(ii)</num><content> attached to, and under any type of force protection agreement with, the military installation upon which such housing is situated.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb468-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Additional requirements</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">If the property described in subparagraph (A) is not owned by the Federal Government, is subject to taxation by a State or political subdivision of a State, and thereby generates revenues for a local educational agency that is applying to receive a payment under this section, then the Secretary—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb469-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/5/B/i\"><num value=\"i\">(i)</num><content> shall require the local educational agency to provide certification from an appropriate official of the Department of Defense that the property is being used to provide military housing; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb46a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/a/5/B/ii\"><num value=\"ii\">(ii)</num><content> shall reduce the amount of the payment under this section by an amount equal to the amount of revenue from such taxation received in the second preceding fiscal year by such local educational agency, unless the amount of such revenue was taken into account by the State for such second preceding fiscal year and already resulted in a reduction in the amount of State aid paid to such local educational agency.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id835fb46b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Basic support payments; insufficient appropriations; State with only one local educational agency</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id835fb46c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Basic support payments</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb46d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">From the amount appropriated under <ref href=\"/us/usc/t20/s7714/b\">section 7714(b) of this title</ref> for a fiscal year, the Secretary is authorized to make basic support payments to eligible local educational agencies with children described in subsection (a).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb46e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Eligibility</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">A local educational agency is eligible to receive a basic support payment under subparagraph (A) for a fiscal year with respect to a number of children determined under subsection (a)(1) only if the number of children so determined with respect to such agency amounts to the lesser of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb46f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/B/i\"><num value=\"i\">(i)</num><content> at least 400 such children; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb470-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/B/ii\"><num value=\"ii\">(ii)</num><content> a number of such children which equals at least 3 percent of the total number of children who were in average daily attendance, during such year, at the schools of such agency and for whom such agency provided free public education.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb471-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Maximum amount</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The maximum amount that a local educational agency is eligible to receive under this paragraph for any fiscal year is the sum of the total weighted student units, as computed under subsection (a)(2), multiplied by the greater of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb472-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/C/i\"><num value=\"i\">(i)</num><content> one-half of the average per-pupil expenditure of the State in which the local educational agency is located for the third fiscal year preceding the fiscal year for which the determination is made;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb473-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/C/ii\"><num value=\"ii\">(ii)</num><content> one-half of the average per-pupil expenditure of all of the States for the third fiscal year preceding the fiscal year for which the determination is made;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb474-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/C/iii\"><num value=\"iii\">(iii)</num><content> the comparable local contribution rate certified by the State, as determined under regulations prescribed to carry out the Act of <date date=\"1950-09-30\">September 30, 1950</date> (Public Law 874, 81st Congress), as such regulations were in effect on <date date=\"1994-01-01\">January 1, 1994</date>; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id835fb475-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/C/iv\"><num value=\"iv\">(iv)</num><content> the average per-pupil expenditure of the State in which the local educational agency is located, multiplied by the local contribution percentage.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb476-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Data</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If satisfactory data from the third preceding fiscal year are not available for any of the expenditures described in clause (i) or (ii) of subparagraph (C), the Secretary shall use data from the most recent fiscal year for which data that are satisfactory to the Secretary are available.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb477-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Increase in local contribution rate due to unusual geographic factors</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If the current expenditures in those local educational agencies which the Secretary has determined to be generally comparable to the local educational agency for which a computation is made under subparagraph (C) are not reasonably comparable because of unusual geographical factors which affect the current expenditures necessary to maintain, in such agency, a level of education equivalent to that maintained in such other agencies, then the Secretary shall increase the local contribution rate for such agency under subparagraph (C)(iii) by such an amount which the Secretary determines will compensate such agency for the increase in current expenditures necessitated by such unusual geographical factors. The amount of any such supplementary payment may not exceed the per-pupil share (computed with regard to all children in average daily attendance), as determined by the Secretary, of the increased current expenditures necessitated by such unusual geographic factors.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb478-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/1/F\"><num value=\"F\">(F)</num><content> Beginning with fiscal year 2002, for the purpose of calculating a payment under this paragraph for a local educational agency whose local contribution rate was computed under subparagraph (C)(iii) for the previous year, the Secretary shall use a local contribution rate that is not less than 95 percent of the rate that the LEA received for the preceding year.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id835fb479-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Basic support payments for heavily impacted local educational agencies</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb47a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb47b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/A/i\"><num value=\"i\">(i)</num><content> From the amount appropriated under <ref href=\"/us/usc/t20/s7714/b\">section 7714(b) of this title</ref> for a fiscal year, the Secretary is authorized to make basic support payments to eligible heavily impacted local educational agencies with children described in subsection (a).</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id835fb47c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/A/ii\"><num value=\"ii\">(ii)</num><content> A local educational agency that receives a basic support payment under this paragraph for a fiscal year shall not be eligible to receive a basic support payment under paragraph (1) for that fiscal year.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb47d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Eligibility for heavily impacted local educational agencies</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb47e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">A heavily impacted local educational agency is eligible to receive a basic support payment under subparagraph (A) with respect to a number of children determined under subsection (a)(1) if the agency—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb47f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/I\"><num value=\"I\">(I)</num><chapeau> is a local educational agency—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb480-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/I/aa\"><num value=\"aa\">(aa)</num><content> whose boundaries are the same as a Federal military installation; or</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb481-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/I/bb\"><num value=\"bb\">(bb)</num><subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb482-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/I/bb/AA\"><num value=\"AA\">(AA)</num><content> whose boundaries are the same as an island property designated by the Secretary of the Interior to be property that is held in trust by the Federal Government; and</content>\n</subitem>\n<subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb483-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/I/bb/BB\"><num value=\"BB\">(BB)</num><content> that has no taxing authority;</content>\n</subitem>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb484-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/II\"><num value=\"II\">(II)</num><chapeau> is a local educational agency that—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb485-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/II/aa\"><num value=\"aa\">(aa)</num><content> has an enrollment of children described in subsection (a)(1) that constitutes a percentage of the total student enrollment of the agency that is not less than 45 percent;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb486-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/II/bb\"><num value=\"bb\">(bb)</num><chapeau> has a per-pupil expenditure that is less than—</chapeau><subitem style=\"-uslm-lc:I02\" class=\"indent6\" id=\"id835fb487-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/II/bb/AA\"><num value=\"AA\">(AA)</num><content> for an agency that has a total student enrollment of 500 or more students, 125 percent of the average per-pupil expenditure of the State in which the agency is located; or</content>\n</subitem>\n<subitem style=\"-uslm-lc:I02\" class=\"indent6\" id=\"id835fb488-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/II/bb/BB\"><num value=\"BB\">(BB)</num><content> for any agency that has a total student enrollment of less than 500 students, 150 percent of the average per-pupil expenditure of the State in which the agency is located or the average per-pupil expenditure of 3 or more comparable local educational agencies in the State in which the agency is located; and</content>\n</subitem>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb489-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/II/cc\"><num value=\"cc\">(cc)</num><content> is an agency that has a tax rate for general fund purposes that is not less than 95 percent of the average tax rate for general fund purposes of comparable local educational agencies in the State;</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb48a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/III\"><num value=\"III\">(III)</num><chapeau> is a local educational agency that—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb48b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/III/aa\"><num value=\"aa\">(aa)</num><content> has a tax rate for general fund purposes which is not less than 125 percent of the average tax rate for general fund purposes for comparable local educational agencies in the State;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb48c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/III/bb\"><num value=\"bb\">(bb)</num><subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb48d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/III/bb/AA\"><num value=\"AA\">(AA)</num><content> has an enrollment of children described in subsection (a)(1) that constitutes a percentage of the total student enrollment of the agency that is not less than 30 percent; or</content>\n</subitem>\n<subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb48e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/III/bb/BB\"><num value=\"BB\">(BB)</num><content> has an enrollment of children described in subsection (a)(1) that constitutes a percentage of the total student enrollment of the agency that is not less than 20 percent, and for the 3 fiscal years preceding the fiscal year for which the determination is made, the average enrollment of children who are not described in subsection (a)(1) and who are eligible for a free or reduced price lunch under the Richard B. Russell National School Lunch Act [<ref href=\"/us/usc/t42/s1751\">42 U.S.C. 1751</ref> et seq.] constitutes a percentage of the total student enrollment of the agency that is not less than 65 percent and received assistance for fiscal year 2017 pursuant to subparagraph (G); and</content>\n</subitem>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb48f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/III/cc\"><num value=\"cc\">(cc)</num><content> received assistance under subparagraph (A) of <ref href=\"/us/usc/t20/s7703/b/2\">section 7703(b)(2) of this title</ref>,<ref class=\"footnoteRef\" idref=\"fn002211\">1</ref><note type=\"footnote\" id=\"fn002211\"><num>1</num> See References in Text note below.</note> as such section was in effect on the day before <date date=\"2015-12-10\">December 10, 2015</date>, for a fiscal year prior to fiscal year 2017;</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb490-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/IV\"><num value=\"IV\">(IV)</num><chapeau> is a local educational agency that received a payment for fiscal year 2015 under section 7703(b)(2)(E) <sup>1</sup> of this title (as such section was in effect for such fiscal year) and has a total student enrollment of not less than 25,000 students, of which—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb491-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/IV/aa\"><num value=\"aa\">(aa)</num><content> not less than 35 percent are children described in subsection (a)(1); and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb492-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/IV/bb\"><num value=\"bb\">(bb)</num><subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb493-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/IV/bb/AA\"><num value=\"AA\">(AA)</num><content> not less than 3,500 of such children are children described in subparagraphs (A) and (B) of subsection (a)(1); or</content>\n</subitem>\n<subitem style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb494-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/IV/bb/BB\"><num value=\"BB\">(BB)</num><content> not less than 7,000 of such children are children described in subparagraph (D) of subsection (a)(1);</content>\n</subitem>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb495-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/V\"><num value=\"V\">(V)</num><chapeau> is a local educational agency that—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb496-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/V/aa\"><num value=\"aa\">(aa)</num><content> has an enrollment of children described in subsection (a)(1) including, for purposes of determining eligibility, those children described in subparagraphs (F) and (G) of such subsection, that is not less than 35 percent of the total student enrollment of the agency;</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb497-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/V/bb\"><num value=\"bb\">(bb)</num><content> has a per-pupil expenditure described in subclause (II)(bb) (except that a local educational agency with a total student enrollment of less than 350 students shall be deemed to have satisfied such per-pupil expenditure requirement) and has a tax rate for general fund purposes which is not less than 95 percent of the average tax rate for general fund purposes for comparable local educational agencies in the State; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb498-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/i/V/cc\"><num value=\"cc\">(cc)</num><content> was eligible to receive assistance under subparagraph (A) for fiscal year 2001.</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb499-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Loss of eligibility</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb49a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/ii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Subject to subclause (II), a heavily impacted local educational agency that met the requirements of clause (i) for a fiscal year shall be ineligible to receive a basic support payment under subparagraph (A) if the agency fails to meet the requirements of clause (i) for a subsequent fiscal year, except that such agency shall continue to receive a basic support payment under this paragraph for the fiscal year for which the ineligibility determination is made.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb49b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/ii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Loss of eligibility due to falling below 95 percent of the average tax rate for general fund purposes</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">In the case of a heavily impacted local educational agency described in subclause (II) or (V) of clause (i) that is eligible to receive a basic support payment under subparagraph (A), but that has had, for 2 consecutive fiscal years, a tax rate for general fund purposes that falls below 95 percent of the average tax rate for general fund purposes of comparable local educational agencies in the State, such agency shall be determined to be ineligible under clause (i) and ineligible to receive a basic support payment under subparagraph (A) for each fiscal year succeeding such 2 consecutive fiscal years for which the agency has such a tax rate for general fund purposes, and until the fiscal year for which the agency resumes such eligibility in accordance with clause (iii).</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb49c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/ii/III\"><num value=\"III\" class=\"bold\">(III)</num><heading class=\"bold\"> Taken over by State board of education</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">In the case of a heavily impacted local educational agency that is eligible to receive a basic support payment under subparagraph (A), but that has been taken over by a State board of education in any 2 previous years, such agency shall be deemed to maintain heavily impacted status for 2 fiscal years following <date date=\"2015-12-10\">December 10, 2015</date>.</p>\n</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb49d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Eligibility</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb49e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/iii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> First time</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">A local educational agency seeking a payment under this paragraph for the first time shall apply for and be determined eligible under clause (i) for 2 consecutive years before receiving such a payment, and shall not receive such a payment for the first year of eligibility.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb49f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/B/iii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Resumption of eligibility</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">A heavily impacted local educational agency described in clause (i) that becomes ineligible under such clause for 1 or more fiscal years may resume eligibility for a basic support payment under this paragraph for a subsequent fiscal year only if the agency meets the requirements of clause (i) for that subsequent fiscal year, except that such agency shall not receive a basic support payment under this paragraph until the fiscal year succeeding the fiscal year for which the eligibility determination is made.</p>\n</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb4a0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Maximum amount for heavily impacted local educational agencies</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4a1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Except as provided in subparagraph (D), the maximum amount that a heavily impacted local educational agency is eligible to receive under this paragraph for any fiscal year is the sum of the total weighted student units, as computed under subsection (a)(2) and subject to clause (ii), multiplied by the greater of—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4a2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/i/I\"><num value=\"I\">(I)</num><content> four-fifths of the average per-pupil expenditure of the State in which the local educational agency is located for the third fiscal year preceding the fiscal year for which the determination is made; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4a3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/i/II\"><num value=\"II\">(II)</num><content> four-fifths of the average per-pupil expenditure of all of the States for the third fiscal year preceding the fiscal year for which the determination is made.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4a4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Calculation of weighted student units</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4a5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/ii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><item style=\"-uslm-lc:I580469\" class=\"indent7 firstIndent-2 bold\" id=\"id835fb4a6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/ii/I/aa\"><num value=\"aa\">(aa)</num><heading> Percentage enrollment</heading><content><p style=\"-uslm-lc:I580434\" class=\"indent5\">For a local educational agency in which 35 percent or more of the total student enrollment of the schools of the agency are children described in subparagraph (D) or (E) (or a combination thereof) of subsection (a)(1), and that has an enrollment of children described in subparagraph (A), (B), or (C) of such subsection equal to at least 10 percent of the agency’s total enrollment, the Secretary shall calculate the weighted student units of those children described in subparagraph (D) or (E) of such subsection by multiplying the number of such children by a factor of 0.55.</p>\n</content>\n</item>\n<item style=\"-uslm-lc:I580469\" class=\"indent7 firstIndent-2 bold\" id=\"id835fb4a7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/ii/I/bb\"><num value=\"bb\">(bb)</num><heading> Exception</heading><content><p style=\"-uslm-lc:I580434\" class=\"indent5\">Notwithstanding item (aa), a local educational agency that received a payment under this paragraph for fiscal year 2013 shall not be required to have an enrollment of children described in subparagraph (A), (B), or (C) of subsection (a)(1) equal to at least 10 percent of the agency’s total enrollment and shall be eligible for the student weight as provided for in item (aa).</p>\n</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4a8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/ii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Enrollment of 100 or fewer children</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">For a local educational agency that has an enrollment of 100 or fewer children described in subsection (a)(1), the Secretary shall calculate the total number of weighted student units for purposes of subsection (a)(2) by multiplying the number of such children by a factor of 1.75.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4a9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/C/ii/III\"><num value=\"III\" class=\"bold\">(III)</num><heading class=\"bold\"> Enrollment of more than 100 children but less than 1000</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">For a local educational agency that is not described under subparagraph (B)(i)(I) and has an enrollment of more than 100 but not more than 1,000 children described in subsection (a)(1), the Secretary shall calculate the total number of weighted student units for purposes of subsection (a)(2) by multiplying the number of such children by a factor of 1.25.</p>\n</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb4aa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Maximum amount for large heavily impacted local educational agencies</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4ab-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4ac-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/i/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> Formula</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Subject to clauses (ii), (iii), and (iv), the maximum amount that a heavily impacted local educational agency described in subclause (II) is eligible to receive under this paragraph for any fiscal year shall be determined in accordance with the formula described in paragraph (1)(C).</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4ad-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/i/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Heavily impacted local educational agency</heading><chapeau style=\"-uslm-lc:I16\" class=\"indent4\">A heavily impacted local educational agency described in this subclause is a local educational agency that received a payment for fiscal year 2015 under section 7703(b)(2)(E) <sup>1</sup> of this title (as such section was in effect for such fiscal year) and has a total student enrollment of not less than 25,000 students, of which not less than 35 percent are children described in subsection (a)(1) and—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb4ae-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/i/II/aa\"><num value=\"aa\">(aa)</num><content> not less than 3,500 of such children are children described in subparagraphs (A) and (B) of subsection (a)(1); or</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb4af-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/i/II/bb\"><num value=\"bb\">(bb)</num><content> not less than 7,000 of such children are children described in subparagraph (D) of subsection (a)(1).</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4b0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Factor</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">For purposes of calculating the maximum amount described in clause (i), the factor used in determining the weighted student units under subsection (a)(2) with respect to children described in subparagraphs (A) and (B) of subsection (a)(1) shall be—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/ii/I\"><num value=\"I\">(I)</num><content> for fiscal year 2016, 1.35;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/ii/II\"><num value=\"II\">(II)</num><content> for each of fiscal years 2017 and 2018, 1.38;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/ii/III\"><num value=\"III\">(III)</num><content> for fiscal year 2019, 1.40;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/ii/IV\"><num value=\"IV\">(IV)</num><content> for fiscal year 2020, 1.42; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/ii/V\"><num value=\"V\">(V)</num><content> for fiscal year 2021 and each fiscal year thereafter, 1.45.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4b6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Factor for children who live off base</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">For purposes of calculating the maximum amount described in clause (i), the factor used in determining the weighted student units under subsection (a)(2) with respect to children described in subsection (a)(1)(D) shall be—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iii/I\"><num value=\"I\">(I)</num><content> for fiscal year 2016, .20;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iii/II\"><num value=\"II\">(II)</num><content> for each of fiscal years 2017 and 2018, .22;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4b9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iii/III\"><num value=\"III\">(III)</num><content> for each of fiscal years 2019 and 2020, .25; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4ba-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iii/IV\"><num value=\"IV\">(IV)</num><chapeau> for fiscal year 2021 and each fiscal year thereafter—</chapeau><item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb4bb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iii/IV/aa\"><num value=\"aa\">(aa)</num><content> .30 with respect to each of the first 7,000 children; and</content>\n</item>\n<item style=\"-uslm-lc:I580434\" class=\"indent5\" id=\"id835fb4bc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iii/IV/bb\"><num value=\"bb\">(bb)</num><content> .25 with respect to the number of children that exceeds 7,000.</content>\n</item>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4bd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Special rule</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Notwithstanding clauses (ii) and (iii), for fiscal year 2020 or any succeeding fiscal year, if the number of students who are children described in subparagraphs (A) and (B) of subsection (a)(1) for a local educational agency subject to this subparagraph exceeds 7,000 for such year or the number of students who are children described in subsection (a)(1)(D) for such local educational agency exceeds 12,750 for such year, then—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4be-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iv/I\"><num value=\"I\">(I)</num><content> the factor used, for the fiscal year for which the determination is being made, to determine the weighted student units under subsection (a)(2) with respect to children described in subparagraphs (A) and (B) of subsection (a)(1) shall be 1.40; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4bf-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/D/iv/II\"><num value=\"II\">(II)</num><content> the factor used, for such fiscal year, to determine the weighted student units under subsection (a)(2) with respect to children described in subsection (a)(1)(D) shall be .20.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb4c0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Data</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of providing assistance under this paragraph, the Secretary shall use student, revenue, expenditure, and tax data from the third fiscal year preceding the fiscal year for which the local educational agency is applying for assistance under this paragraph.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id835fb4c1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Determination of average tax rates for general fund purposes</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4c2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Except as provided in clause (ii), for the purpose of determining the average tax rates for general fund purposes for local educational agencies in a State under this paragraph, the Secretary shall use either—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4c3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F/i/I\"><num value=\"I\">(I)</num><content> the average tax rate for general fund purposes for comparable local educational agencies, as determined by the Secretary in regulations; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id835fb4c4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F/i/II\"><num value=\"II\">(II)</num><content> the average tax rate of all the local educational agencies in the State.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id835fb4c5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Fiscal years 2010–2015</heading><subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4c6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F/ii/I\"><num value=\"I\" class=\"bold\">(I)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">For fiscal years 2010 through 2015, any local educational agency that was found ineligible to receive a payment under subparagraph (A) because the Secretary determined that it failed to meet the average tax rate requirement for general fund purposes in subparagraph (B)(i)(II)(cc), shall be considered to have met that requirement, if its State determined, through an alternate calculation of average tax rates for general fund purposes, that such local educational agency met that requirement.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4c7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F/ii/II\"><num value=\"II\" class=\"bold\">(II)</num><heading class=\"bold\"> Subsequent fiscal years after 2015</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">For any succeeding fiscal year after 2015, any local educational agency identified in subclause (I) may continue to have its State use that alternate methodology to calculate whether the average tax rate requirement for general fund purposes under subparagraph (B)(i)(II)(cc) is met.</p>\n</content>\n</subclause>\n<subclause style=\"-uslm-lc:I72\" class=\"indent6 firstIndent-2\" id=\"id835fb4c8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/F/ii/III\"><num value=\"III\" class=\"bold\">(III)</num><heading class=\"bold\"> Availability of funds</heading><content><p style=\"-uslm-lc:I16\" class=\"indent4\">Notwithstanding any other provision of law limiting the period during which the Secretary may obligate funds appropriated for any fiscal year after 2012, the Secretary shall reserve a total of $14,000,000 from funds that remain unobligated under this section from fiscal years 2015 or 2016 in order to make payments under this clause for fiscal years 2011 through 2014.</p>\n</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225c9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/G\"><num value=\"G\" class=\"bold\">(G)</num><heading class=\"bold\"> Eligibility for heavily impacted local educational agencies affected by privatization of military housing</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id836225ca-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/G/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Eligibility</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">For any fiscal year, a heavily impacted local educational agency that received a basic support payment under this paragraph for the prior fiscal year, but is ineligible for such payment for the current fiscal year under subparagraph (B) due to the conversion of military housing units to private housing described in clause (iii), or as the direct result of base realignment and closure or modularization as determined by the Secretary of Defense and force structure change or force relocation, shall be deemed to meet the eligibility requirements under subparagraph (B) for the period during which the housing units are undergoing such conversion or during such time as activities associated with base closure and realignment, modularization, force structure change, or force relocation are ongoing.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id836225cb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/G/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Amount of payment</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The amount of a payment to a heavily impacted local educational agency for a fiscal year by reason of the application of clause (i), and calculated in accordance with subparagraph (C) or (D), as the case may be, shall be based on the number of children in average daily attendance in the schools of such agency for the fiscal year and under the same provisions of subparagraph (C) or (D) under which the agency was paid during the prior fiscal year.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id836225cc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/2/G/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Conversion of military housing units to private housing described</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">For purposes of clause (i), “conversion of military housing units to private housing” means the conversion of military housing units to private housing units pursuant to subchapter IV of chapter 169 of title 10 or pursuant to any other related provision of law.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836225cd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Payments with respect to fiscal years in which insufficient funds are appropriated</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225ce-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For any fiscal year in which the sums appropriated under <ref href=\"/us/usc/t20/s7714/b\">section 7714(b) of this title</ref> are insufficient to pay to each local educational agency the full amount computed under paragraphs (1) and (2), the Secretary shall make payments in accordance with this paragraph.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225cf-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Learning opportunity threshold payments in lieu of payments under paragraph (1)</heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836225d0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/B/i\"><num value=\"i\">(i)</num><chapeau> For fiscal years described in subparagraph (A), the Secretary shall compute a learning opportunity threshold payment (hereafter in this subchapter referred to as the “threshold payment”) in lieu of basic support payments under paragraph (1) by multiplying the amount obtained under paragraph (1)(C) by the total percentage obtained by adding—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225d1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/B/i/I\"><num value=\"I\">(I)</num><content> the percentage of federally connected children for each local educational agency determined by calculating the fraction, the numerator of which is the total number of children described under subsection (a)(1) and the denominator of which is the total number of children in average daily attendance at the schools served by such agency; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225d2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/B/i/II\"><num value=\"II\">(II)</num><content> the percentage that funds under paragraph (1)(C) represent of the total budget of the local educational agency, determined by calculating the fraction, the numerator of which is the total amount of funds calculated for each local educational agency under this paragraph, and the denominator of which is the total current expenditures for such agency in the second preceding fiscal year for which the determination is made.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836225d3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/B/ii\"><num value=\"ii\">(ii)</num><content> Such total percentage used to calculate threshold payments under paragraph (1) shall not exceed 100.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836225d4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/B/iii\"><num value=\"iii\">(iii)</num><content> In the case of a local educational agency providing a free public education to students enrolled in kindergarten through grade 12, that enrolls students described in subparagraphs (A), (B), and (D) of subsection (a)(1) only in grades 9 through 12, and that received a final payment for fiscal year 2009 calculated under <ref href=\"/us/usc/t20/s7703/b/3\">section 7703(b)(3) of this title</ref> (as such section was in effect on the day before <date date=\"2015-12-10\">December 10, 2015</date>) for students in grades 9 through 12, the Secretary shall, in calculating the agency’s payment, consider only that portion of such agency’s total enrollment of students in grades 9 through 12 when calculating the percentage under clause (i)(I) and only that portion of the total current expenditures attributed to the operation of grades 9 through 12 in such agency when calculating the percentage under clause (i)(II).</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836225d5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/B/iv\"><num value=\"iv\">(iv)</num><content> In the case of a local educational agency that has a total student enrollment of fewer than 1,000 students and that has a per-pupil expenditure that is less than the average per-pupil expenditure of the State in which the agency is located or less than the average per-pupil expenditure of all the States, the total percentage used to calculate threshold payments under clause (i) shall not be less than 40 percent.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225d6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Learning opportunity threshold payments in lieu of payments under paragraph (2)</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For fiscal years described in subparagraph (A), the learning opportunity threshold payment in lieu of basic support payments under paragraph (2) shall be equal to the amount obtained under subparagraph (C) or (D) of paragraph (2), as the case may be.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225d7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Ratable distribution</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">For fiscal years described in subparagraph (A), for which the sums available exceed the amount required to pay each local educational agency 100 percent of its threshold payment, the Secretary shall distribute the excess sums to each eligible local educational agency that has not received its full amount computed under paragraphs (1) or (2) (as the case may be) by multiplying—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225d8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/D/i\"><num value=\"i\">(i)</num><content> a percentage, the denominator of which is the difference between the full amount computed under paragraph (1) or (2) (as the case may be) for all local educational agencies and the amount of the threshold payment (as calculated under subparagraphs (B) and (C)) of all local educational agencies, and the numerator of which is the aggregate of the excess sums, by</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225d9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/D/ii\"><num value=\"ii\">(ii)</num><content> the difference between the full amount computed under paragraph (1) or (2) (as the case may be) for the agency and the amount of the threshold payment (as calculated under subparagraphs (B) or (C)) of the agency, except that no local educational agency shall receive more than 100 percent of the maximum payment calculated under subparagraph (C) or (D) of paragraph (2).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225da-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Insufficient payments</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For each fiscal year described in subparagraph (A) for which the sums appropriated are insufficient to pay each local educational agency all of the local educational agency’s threshold payment described in subparagraph (B), the Secretary shall ratably reduce the payment to each local educational agency under this paragraph.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225db-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Increases</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id836225dc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/F/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Increases based on insufficient funds</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If additional funds become available under 7714(b) of this title for making payments under paragraphs (1) and (2) and those funds are not sufficient to increase each local educational agency’s threshold payment above 100 percent of its threshold payment described in subparagraph (B), payments that were reduced under subparagraph (E) shall be increased by the Secretary on the same basis as such payments were reduced.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id836225dd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/F/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Increases based on sufficient funds</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If additional funds become available under <ref href=\"/us/usc/t20/s7714/b\">section 7714(b) of this title</ref> for making payments under paragraphs (1) and (2) and those funds are sufficient to increase each local educational agency’s threshold payment above 100 percent of its threshold payment described in subparagraph (B), the payment for each local educational agency shall be 100 percent of its threshold payment. The Secretary shall then distribute the excess sums to each eligible local educational agency in accordance with subparagraph (D).</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225de-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/G\"><num value=\"G\" class=\"bold\">(G)</num><heading class=\"bold\"> Provision of tax rate and resulting percentage</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">As soon as practicable following the payment of funds under paragraph (2) to an eligible local educational agency, the Secretary shall provide the local educational agency with a description of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225df-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/G/i\"><num value=\"i\">(i)</num><content> the tax rate of the local educational agency; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225e0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/3/G/ii\"><num value=\"ii\">(ii)</num><content> the percentage such tax rate represents of the average tax rate for general fund purposes of comparable local educational agencies in the State as determined under subclauses (II)(cc), III(aa), or (V)(bb) of paragraph (2)(B)(i) (as the case may be).</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836225e1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> States with only one local educational agency</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225e2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In any of the 50 States of the United States in which there is only one local educational agency, the Secretary shall, for purposes of subparagraphs (B) and (C) of paragraph (1) or subparagraphs (B) and (C) of paragraph (2), as the case may be, paragraph (3) of this subsection, and subsection (e), consider each administrative school district in the State to be a separate local educational agency.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225e3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Computation of maximum amount of basic support payment and threshold payment</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In computing the maximum payment amount under paragraph (1)(C) or subparagraph (C) or (D) of paragraph (2), as the case may be, and the learning opportunity threshold payment under subparagraph (B) or (C) of paragraph (3), as the case may be, for an administrative school district described in subparagraph (A)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225e4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/4/B/i\"><num value=\"i\">(i)</num><content> the Secretary shall first determine the maximum payment amount and the total current expenditures for the State as a whole; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225e5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/4/B/ii\"><num value=\"ii\">(ii)</num><chapeau> the Secretary shall then—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id836225e6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/4/B/ii/I\"><num value=\"I\">(I)</num><content> proportionately allocate such maximum payment amount among the administrative school districts on the basis of the respective weighted student units of such districts; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id836225e7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/4/B/ii/II\"><num value=\"II\">(II)</num><content> proportionately allocate such total current expenditures among the administrative school districts on the basis of the respective number of students in average daily attendance at such districts.</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836225e8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Local educational agencies affected by removal of Federal property</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225e9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In computing the amount of a basic support payment under this subsection for a fiscal year for a local educational agency described in subparagraph (B), the Secretary shall meet the additional requirements described in subparagraph (C).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225ea-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Local educational agency described</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A local educational agency described in this subparagraph is a local educational agency with respect to which Federal property (i) located within the boundaries of the agency, and (ii) on which one or more children reside who are receiving a free public education at a school of the agency, is transferred by the Federal Government to another entity in any fiscal year beginning on or after <date date=\"2000-10-30\">October 30, 2000</date>, so that the property is subject to taxation by the State or a political subdivision of the State.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836225eb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Additional requirements</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The additional requirements described in this subparagraph are the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225ec-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/C/i\"><num value=\"i\">(i)</num><content> For each fiscal year beginning after the date on which the Federal property is transferred, a child described in subparagraph (B) who continues to reside on such property and who continues to receive a free public education at a school of the agency shall be deemed to be a child who resides on Federal property for purposes of computing under the applicable subparagraph of subsection (a)(1) the amount that the agency is eligible to receive under this subsection.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225ed-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/C/ii\"><num value=\"ii\">(ii)</num><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225ee-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/C/ii/I\"><num value=\"I\">(I)</num><content> For the third fiscal year beginning after the date on which the Federal property is transferred, and for each fiscal year thereafter, the Secretary shall, after computing the amount that the agency is otherwise eligible to receive under this subsection for the fiscal year involved, deduct from such amount an amount equal to the revenue received by the agency for the immediately preceding fiscal year as a result of the taxable status of the former Federal property.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225ef-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/C/ii/II\"><num value=\"II\">(II)</num><chapeau> For purposes of determining the amount of revenue to be deducted in accordance with subclause (I), the local educational agency—</chapeau><item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id836225f0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/C/ii/II/aa\"><num value=\"aa\">(aa)</num><content> shall provide for a review and certification of such amount by an appropriate local tax authority; and</content>\n</item>\n<item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id836225f1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/b/5/C/ii/II/bb\"><num value=\"bb\">(bb)</num><content> shall submit to the Secretary a report containing the amount certified under item (aa).</content>\n</item>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id836225f2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Prior year data</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836225f3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in subsections (b)(1)(D), (b)(2), and paragraph (2), all calculations under this section shall be based on data for each local educational agency from not later than the fiscal year preceding the fiscal year for which the agency is making application for payment.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836225f4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exception</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Calculation of payments for a local educational agency shall be based on data from the fiscal year for which the agency is making an application for payment if such agency—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836225f5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/A\"><num value=\"A\">(A)</num><content> is newly established by a State, for the first year of operation of such agency only;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836225f6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/B\"><num value=\"B\">(B)</num><chapeau> was eligible to receive a payment under this section for the previous fiscal year and has had an overall increase in enrollment (as determined by the Secretary in consultation with the Secretary of Defense, the Secretary of the Interior, or the heads of other Federal agencies)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225f7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/B/i\"><num value=\"i\">(i)</num><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225f8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/B/i/I\"><num value=\"I\">(I)</num><chapeau> of not less than 10 percent of children described in—</chapeau><item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id836225f9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/B/i/I/aa\"><num value=\"aa\">(aa)</num><content> subparagraph (A), (B), (C), or (D) of subsection (a)(1); or</content>\n</item>\n<item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id836225fa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/B/i/I/bb\"><num value=\"bb\">(bb)</num><content> subparagraphs (F) and (G) of subsection (a)(1), but only to the extent that such children are civilian dependents of employees of the Department of Defense or the Department of the Interior; or</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225fb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/B/i/II\"><num value=\"II\">(II)</num><content> of not less than 100 of such children; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225fc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/B/ii\"><num value=\"ii\">(ii)</num><content> that is the direct result of closure or realignment of military installations under the base closure process or the relocation of members of the Armed Forces and civilian employees of the Department of Defense as part of the force structure changes or movements of units or personnel between military installations or because of actions initiated by the Secretary of the Interior or the head of another Federal agency; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836225fd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/C\"><num value=\"C\">(C)</num><chapeau> was eligible to receive a payment under this section for the previous fiscal year and has had an increase in enrollment (as determined by the Secretary)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225fe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/C/i\"><num value=\"i\">(i)</num><content> of not less than 10 percent of children described in subsection (a)(1) or not less than 100 of such children; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836225ff-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/c/2/C/ii\"><num value=\"ii\">(ii)</num><content> that is the direct result of the closure of a local educational agency that received a payment under subsection (b)(1) or (b)(2) for the previous fiscal year.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83622600-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Children with disabilities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83622601-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">From the amount appropriated under <ref href=\"/us/usc/t20/s7714/c\">section 7714(c) of this title</ref> for a fiscal year, the Secretary shall pay to each eligible local educational agency, on a pro rata basis, the amounts determined by—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83622602-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/d/1/A\"><num value=\"A\">(A)</num><content> multiplying the number of children described in subparagraphs (A)(ii), (B) and (C) of subsection (a)(1) who are eligible to receive services under the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1400\">20 U.S.C. 1400</ref> et seq.) by a factor of 1.0; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83622603-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/d/1/B\"><num value=\"B\">(B)</num><content> multiplying the number of children described in subparagraph (D) of subsection (a)(1) who are eligible to receive services under such Act by a factor of 0.5.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83622604-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Use of funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A local educational agency that receives funds under paragraph (1) shall use such funds to provide a free appropriate public education to children described in paragraph (1) in accordance with the Individuals with Disabilities Education Act (<ref href=\"/us/usc/t20/s1400\">20 U.S.C. 1400</ref> et seq.).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id83622605-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Hold harmless</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83622606-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In the case of any local educational agency eligible to receive a payment under subsection (b) whose calculated payment amount for a fiscal year is reduced by 20 percent, as compared to the amount received for the previous fiscal year, the Secretary shall pay the local educational agency, for the year of the reduction and the following 2 years, the amount determined under paragraph (2).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83622607-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Amount of reduction</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Subject to paragraph (3), A local educational agency described in paragraph (1) shall receive—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83622608-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/2/A\"><num value=\"A\">(A)</num><content> for the first year for which the reduced payment is determined, an amount that is not less than 90 percent of the total amount that the local educational agency received under subsection (b) for the previous fiscal year;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83622609-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/2/B\"><num value=\"B\">(B)</num><content> for the second year following such reduction, an amount that is not less than 85 percent of the total amount that the local educational agency received under subparagraph (A); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8362260a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/2/C\"><num value=\"C\">(C)</num><content> for the third year following such reduction, an amount that is not less than 80 percent of the total amount that the local educational agency received under subparagraph (B).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8362260b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Special rule</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For any fiscal year for which a local educational agency would receive a payment under subsection (b) in excess of the amount determined under paragraph (2), the payment received by the local educational agency for such fiscal year shall be calculated under paragraph (1) or (2) of subsection (b).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8362260c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Ratable reductions</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8362260d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If the sums made available under this subchapter for any fiscal year are insufficient to pay the full amounts that all local educational agencies in all States are eligible to receive under paragraph (1) for such year, then the Secretary shall ratably reduce the payments to all such agencies for such year.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8362260e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/e/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Additional funds</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If additional funds become available for making payments under paragraph (1) for such fiscal year, payments that were reduced under subparagraph (A) shall be increased on the same basis as such payments were reduced.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8362260f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7703/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Other funds</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of law, a local educational agency receiving funds under this section may also receive funds under section 386 of the National Defense Authorization Act for Fiscal Year 1993 or such section’s successor authority.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id83622610-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/89/10/tVII/s7003\">Pub. L. 115–245, div. B, title III, § 315</ref>, <date date=\"2018-09-28\">Sept. 28, 2018</date>, <ref href=\"/us/stat/132/3108\">132 Stat. 3108</ref>, provided that:<quotedContent origin=\"/us/pl/115/245/dB/tIII/s315\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><chapeau> For any local educational agency that for fiscal year 2018, had an enrollment of eligible Federally connected children that was at least 35 percent of the agency’s total student enrollment and a per-pupil expenditure that was less than the average per-pupil expenditure of the State or of all the States, and was determined ineligible to receive a payment under section 7003(b)(2)(A) of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s7703/b/2/A\">20 U.S.C. 7703(b)(2)(A)</ref>] for failing to meet the average tax rate requirement for general fund purposes in section 7003(b)(2)(B)(i)(V)(bb), and whose calculated payment amount under section 7003(b) for the three years following fiscal year 2019 is less than 80 percent of the amount received for fiscal year 2019, the Secretary [of Education] shall pay the local educational agency for the following three years not less than 90 percent of the total amount the local educational agency received under section 7003(b)(2) for fiscal year 2017 if such local educational agency—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> previously received a payment under section 7003(b)(2)(A) but did not receive a payment under section 7003(b)(2)(B)(ii) (or any predecessor of such provision) for each of fiscal years 2015 through 2017; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> was considered a local educational agency described in section 7003(b)(2)(B)(i)(V) (or any predecessor of such provision) for each such fiscal year.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><content> For fiscal year 2020 and succeeding fiscal years, if a local educational agency described in subsection (a) is eligible to receive a basic support payment pursuant to section 7003(b)(2) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2\">20 U.S.C. 7703(b)(2)</ref>), the payment received by the local educational agency shall be calculated under section 7003(b)(2) of such Act and not under subsection (a).”</content>\n</subsection>\n</quotedContent>\n</p>\n<p><ref href=\"/us/pl/115/141/dH/tIII/s311/a\">Pub. H, title III, § 311(a)</ref>–(c), <date date=\"2018-03-23\">Mar. 23, 2018</date>, <ref href=\"/us/stat/132/750\">132 Stat. 750</ref>, provided that:<quotedContent origin=\"/us/pl/115/141/dH/tIII/s311/a\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><chapeau> Notwithstanding any other provision of law except as provided under subsection (c), with respect to a local educational agency that was notified by the Secretary [of Education] in fiscal year 2017 of the agency’s eligibility to receive a basic support payment pursuant to section 7003(b)(2)(B)(i)(III) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2/B/i/III\">20 U.S.C. 7703(b)(2)(B)(i)(III)</ref>) for fiscal year 2017 but did not receive a payment under section 7003(b)(2) of such Act [<ref href=\"/us/usc/t20/s7703/b/2\">20 U.S.C. 7703(b)(2)</ref>] for fiscal year 2017, in addition to payments received by the local educational agency under section 7003(b)(1) of such Act [<ref href=\"/us/usc/t20/s7703/b/1\">20 U.S.C. 7703(b)(1)</ref>], the Secretary shall reserve from funds appropriated to carry out section 7003(b) [<ref href=\"/us/usc/t20/s7703/b\">20 U.S.C. 7703(b)</ref>] of such Act and make payments from such funds to such local educational agency for fiscal years 2017, 2018, 2019, and 2020 in the following amounts:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> $3,000,000 for fiscal year 2017.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> $5,000,000 for fiscal year 2018.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> $4,000,000 for fiscal year 2019.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> $4,000,000 for fiscal year 2020.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><content> For fiscal year 2017, a local educational agency described in subsection (a) shall not be eligible for a basic support payment pursuant to section 7003(b)(2) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2\">20 U.S.C. 7703(b)(2)</ref>).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><content> For fiscal year 2018 and succeeding fiscal years, if a local educational agency described in subsection (a) is eligible to receive a basic support payment pursuant to section 7003(b)(2) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2\">20 U.S.C. 7703(b)(2)</ref>), the payment received by the local educational agency shall be calculated under section 7003(b)(2) of such Act and not under subsection (a).”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id83646f0d-3b28-11eb-8459-b1d1037aec5b\"><heading class=\"centered smallCaps\">Impact Aid Amendments</heading><p><ref href=\"/us/pl/114/328/dA/tV/s579/a\">Pub. L. 114–328, div. H, title III, § 311(e)</ref>, <date date=\"2018-03-23\">Mar. 23, 2018</date>, <ref href=\"/us/stat/132/751\">132 Stat. 751</ref>, provided that:<quotedContent origin=\"/us/pl/115/141/dH/tIII/s311/e\">\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">References</inline>.—</heading><content>Except as otherwise expressly provided, any reference in this subsection to a section or other provision of title VII of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s7701\">20 U.S.C. 7701</ref> et seq.] shall be considered to be a reference to the section or other provision of such title VII as amended by the Every Student Succeeds Act (<ref href=\"/us/pl/114/95\">Public Law 114–95</ref>; <ref href=\"/us/stat/129/1802\">129 Stat. 1802</ref>).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Notwithstanding section 5(d) of the Every Student Succeeds Act (<ref href=\"/us/pl/114/95\">Public Law 114–95</ref>; <ref href=\"/us/stat/129/1806\">129 Stat. 1806</ref>) or section 7003(b)(2) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2\">20 U.S.C. 7703(b)(2)</ref>), with respect to any application submitted under section 7005 of such Act (<ref href=\"/us/usc/t20/s7705\">20 U.S.C. 7705</ref>) for eligibility consideration under subclause (II) or (V) of section 7003(b)(2)(B)(i) of such Act [<ref href=\"/us/usc/t20/s7703/b/2/B/i\">20 U.S.C. 7703(b)(2)(B)(i)</ref>] for fiscal year 2017 and any succeeding fiscal year, the Secretary of Education shall determine that a local educational agency meets the per-pupil expenditure requirement for purposes of such subclause (II) or (V), as applicable, only if—</chapeau><subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"A\">“(A)</num><content> in the case of a local educational agency that received a basic support payment for fiscal year 2001 under section 8003(b)(2)(B) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2/B\">20 U.S.C. 7703(b)(2)(B)</ref>) (as such section was in effect for such fiscal year), the agency, for the year for which the application is submitted, has a per-pupil expenditure that is less than the average per-pupil expenditure of the State in which the agency is located or the average per-pupil expenditure of all States (whichever average per-pupil expenditure is greater), except that a local educational agency with a total student enrollment of less than 350 students shall be deemed to have satisfied such per-pupil expenditure requirement; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"B\">“(B)</num><chapeau> in the case of a local educational agency that did not receive a basic support payment for fiscal year 2015 under such section 8003(b)(2)(B), as so in effect, the agency, for the year for which the application is submitted—</chapeau><clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"i\">“(i)</num><content> has a total student enrollment of 350 or more students and a per-pupil expenditure that is less than the average per-pupil expenditure of the State in which the agency is located; or</content>\n</clause>\n<clause style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"ii\">“(ii)</num><content> has a total student enrollment of less than 350 students and a per-pupil expenditure that is less than the average per-pupil expenditure of a comparable local educational agency or 3 comparable local educational agencies (whichever average per-pupil expenditure is greater), in the State in which the agency is located.”</content>\n</clause>\n</subparagraph>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id83646f0f-3b28-11eb-8459-b1d1037aec5b\"><heading class=\"centered smallCaps\">Special Rules</heading><p><ref href=\"/us/pl/114/328/dA/tV/s579/d/3\">Pub. L. 114–328, div. A, title V, § 579(d)(3)</ref>, <date date=\"2016-12-23\">Dec. 23, 2016</date>, <ref href=\"/us/stat/130/2148\">130 Stat. 2148</ref>, provided that:<quotedContent origin=\"/us/pl/114/328/dA/tV/s579/d/3\">\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Applicability for fiscal year 2016</inline>.—</heading><content>Notwithstanding any other provision of law, in making basic support payments under section 8003(b)(2) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2\">20 U.S.C. 7703(b)(2)</ref>) for fiscal year 2016, the Secretary of Education shall carry out subparagraphs (B)(i) and (E) of such section as if the amendments made to subparagraphs (B)(i)(IV) and (D) of section 7003(b)(2) of such Act [<ref href=\"/us/usc/t20/s7703/b/2\">20 U.S.C. 7703(b)(2)</ref>] (as amended and redesignated by this subsection and the Every Student Succeeds Act (<ref href=\"/us/pl/114/95\">Public Law 114–95</ref>; <ref href=\"/us/stat/129/1802\">129 Stat. 1802</ref>)) had also been made to the corresponding provisions of section 8003(b)(2) of the Elementary and Secondary Education Act of 1965, as in effect on the day before the date of enactment of the Every Student Succeeds Act [<date date=\"2015-12-10\">Dec. 10, 2015</date>].</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Loss of eligibility</inline>.—</heading><content>For fiscal year 2016 or any succeeding fiscal year, if a local educational agency is eligible for a basic support payment under subclause (IV) of section 7003(b)(2)(B)(i) of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s7703/b/2/B/i\">20 U.S.C. 7703(b)(2)(B)(i)</ref>] (as amended by this section and the Every Student Succeeds Act (<ref href=\"/us/pl/114/95\">Public Law 114–95</ref>; <ref href=\"/us/stat/129/1802\">129 Stat. 1802</ref>)) or through a corresponding provision under subparagraph (A), such local educational agency shall be ineligible to apply for a payment for such fiscal year under any other subclause of such section (or, for fiscal year 2016, any other item of section 8003(b)(2)(B)(i)(II) of the Elementary and Secondary Education Act of 1965 [<ref href=\"/us/usc/t20/s7703/b/2/B/i/II\">20 U.S.C. 7703(b)(2)(B)(i)(II)</ref>]).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Payment amounts</inline>.—</heading><chapeau>If, before the date of enactment of this Act [<date date=\"2016-12-23\">Dec. 23, 2016</date>], a local educational agency receives 1 or more payments under section 8003(b)(2)(E) of the Elementary and Secondary Education Act of 1965 (<ref href=\"/us/usc/t20/s7703/b/2/E\">20 U.S.C. 7703(b)(2)(E)</ref>) for fiscal year 2016, the sum of which is greater than the amount the Secretary of Education determines the local educational agency is entitled to receive under such section in accordance with subparagraph (A)—</chapeau><clause style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"i\">“(i)</num><content> the Secretary shall allow the local educational agency to retain the larger amount; and</content>\n</clause>\n<clause style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"ii\">“(ii)</num><content> such local educational agency shall not be eligible to receive any additional payment under such section for fiscal year 2016.”</content>\n</clause>\n</subparagraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id83646f10-3b28-11eb-8459-b1d1037aec5b\"><heading class=\"centered smallCaps\">Transition Provisions</heading><p><ref href=\"/us/pl/107/110/tVIII/s802/a/2\">Pub.
