<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8366e09b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705"><num value="7705">§ 7705.</num><heading> Application for payments under sections 7702 and 7703 of this title</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8366e09c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">A local educational agency desiring to receive a payment under section 7702 or 7703 of this title shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8366e09d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/a/1"><num value="1">(1)</num><content> submit an application for such payment to the Secretary; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8366e09e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/a/2"><num value="2">(2)</num><content> provide a copy of such application to the State educational agency.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8366e09f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/b"><num value="b" class="bold">(b)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I11" class="indent0">Each such application shall be submitted in such form and manner as the Secretary may require, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8366e0a0-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/b/1"><num value="1">(1)</num><content> information to determine the eligibility of the local educational agency for a payment and the amount of such payment; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8366e0a1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/b/2"><num value="2">(2)</num><content> where applicable, an assurance that such agency is in compliance with <ref href="/us/usc/t20/s7704">section 7704 of this title</ref> (relating to children residing on Indian lands).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8366e0a2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/c"><num value="c" class="bold">(c)</num><heading class="bold"> Deadline for submission</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish deadlines for the submission of applications under this section.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8366e0a3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d"><num value="d" class="bold">(d)</num><heading class="bold"> Approval</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8366e0a4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall approve an application submitted under this section that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id8366e0a5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/1/A"><num value="A">(A)</num><content> except as provided in paragraph (2), is filed by the deadline established under subsection (c); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8366e0a6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/1/B"><num value="B">(B)</num><content> otherwise meets the requirements of this subchapter.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8366e0a7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Reduction in payment</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall approve an application filed not more than 60 days after a deadline established under subsection (c), or not more than 60 days after the date on which the Secretary sends written notice to the local educational agency pursuant to paragraph (3)(A), as the case may be, that otherwise meets the requirements of this subchapter, except that, notwithstanding <ref href="/us/usc/t20/s7703/e">section 7703(e) of this title</ref>, the Secretary shall reduce the payment based on such late application by 10 percent of the amount that would otherwise be paid.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8366e0a8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Late applications</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8366e0a9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Notice</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall, as soon as practicable after the deadline established under subsection (c), provide to each local educational agency that applied for a payment under section 7702 or 7703 of this title for the prior fiscal year, and with respect to which the Secretary has not received an application for a payment under either such section (as the case may be) for the fiscal year in question, written notice of the failure to comply with the deadline and instruction to ensure that the application is filed not later than 60 days after the date on which the Secretary sends the notice.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8366e0aa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Acceptance and approval of late applications</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall not accept or approve any application of a local educational agency that is filed more than 60 days after the date on which the Secretary sends written notice to the local educational agency pursuant to subparagraph (A).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8366e0ab-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7705/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> State application authority</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of law, a State educational agency that had been accepted as an applicant for funds under <ref href="/us/act/1950-09-30/s3">section 3 of the Act of September 30, 1950</ref> (Public Law 874, 81st Congress) (as such section was in effect on the day preceding <date date="1994-10-20">October 20, 1994</date>) in fiscal year 1994 shall be permitted to continue as an applicant under the same conditions by which such agency made application during such fiscal year only if such State educational agency distributes all funds received for the students for which application is being made by such State educational agency to the local educational agencies providing educational services to such students.</p>
