L. 114–95, title VII, §§ 7001(c)(2), 7012, Dec. 10, 2015, 129 Stat. 2074, 2087.)","seq_in_title":1748,"parent_identifier":"/us/usc/t20/ch70/schVII","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70","level":"chapter","num":"CHAPTER 70—","heading":"STRENGTHENING AND IMPROVEMENT OF ELEMENTARY AND SECONDARY SCHOOLS","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch70/schVII","level":"subchapter","num":"SUBCHAPTER VII—","heading":"IMPACT AID","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id83695176-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713\"><num value=\"7713\">§ 7713.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this subchapter:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83695177-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Armed Forces</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Armed Forces” means the Army, Navy, Air Force, Marine Corps, and Coast Guard.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83695178-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Average per-pupil expenditure</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “average per-pupil expenditure” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id83695179-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/2/A\"><num value=\"A\">(A)</num><content> the aggregate current expenditures of all local educational agencies in the State; divided by</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8369517a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/2/B\"><num value=\"B\">(B)</num><content> the total number of children in average daily attendance for whom such agencies provided free public education.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8369517b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Construction</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “construction” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8369517c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/3/A\"><num value=\"A\">(A)</num><content> the preparation of drawings and specifications for school facilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8369517d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/3/B\"><num value=\"B\">(B)</num><content> erecting, building, acquiring, altering, remodeling, repairing, or extending school facilities;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8369517e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/3/C\"><num value=\"C\">(C)</num><content> inspecting and supervising the construction of school facilities; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8369517f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/3/D\"><num value=\"D\">(D)</num><content> debt service for such activities.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83695180-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Current expenditures</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “current expenditures” means expenditures for free public education, including expenditures for administration, instruction, attendance and health services, pupil transportation services, operation and maintenance of plant, fixed charges, and net expenditures to cover deficits for food services and student body activities, but does not include expenditures for community services, capital outlay, and debt service, or any expenditures made from funds awarded under part A of subchapter I. The determination of whether an expenditure for the replacement of equipment is considered a current expenditure or a capital outlay shall be determined in accordance with generally accepted accounting principles as determined by the State.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id83695181-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Federal property</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83695182-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraphs (B) through (F), the term “Federal property” means real property that is not subject to taxation by any State or any political subdivision of a State due to Federal agreement, law, or policy, and that is—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695183-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/i\"><num value=\"i\">(i)</num><content> owned by the United States or leased by the United States from another entity;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695184-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii\"><num value=\"ii\">(ii)</num><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695185-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii/I\"><num value=\"I\">(I)</num><content> held in trust by the United States for individual Indians or Indian tribes;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695186-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii/II\"><num value=\"II\">(II)</num><content> held by individual Indians or Indian tribes subject to restrictions on alienation imposed by the United States;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695187-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii/III\"><num value=\"III\">(III)</num><chapeau> conveyed at any time under the Alaska Native Claims Settlement Act [<ref href=\"/us/usc/t43/s1601\">43 U.S.C. 1601</ref> et seq.] to a Native individual, Native group, or village or regional corporation (including single family occupancy properties that may have been subsequently sold or leased to a third party), except that property that is conveyed under such Act—</chapeau><item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id83695188-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii/III/aa\"><num value=\"aa\">(aa)</num><content> that is not taxed is, for the purposes of this paragraph, considered tax-exempt due to Federal law; and</content>\n</item>\n<item style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id83695189-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii/III/bb\"><num value=\"bb\">(bb)</num><content> is considered Federal property for the purpose of this paragraph if the property is located within a Regional Educational Attendance Area that has no taxing power;</content>\n</item>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369518a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii/IV\"><num value=\"IV\">(IV)</num><content> public land owned by the United States that is designated for the sole use and benefit of individual Indians or Indian tribes; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369518b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/ii/V\"><num value=\"V\">(V)</num><content> used for low-rent housing, as described in paragraph (10), that is located on land described in subclause (I), (II), (III), or (IV) of this clause or on land that met one of those descriptions immediately before such property’s use for such housing;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369518c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/iii\"><num value=\"iii\">(iii)</num><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369518d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/iii/I\"><num value=\"I\">(I)</num><content> part of a low-rent housing project assisted under the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437\">42 U.S.C. 1437</ref> et seq.];</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369518e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/iii/II\"><num value=\"II\">(II)</num><content> used to provide housing for homeless children at closed military installations pursuant to <ref href=\"/us/usc/t42/s11411\">section 11411 of title 42</ref>; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369518f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/iii/III\"><num value=\"III\">(III)</num><content> used for affordable housing assisted under the Native American Housing Assistance and Self-Determination Act of 1996 (<ref href=\"/us/usc/t25/s4101\">25 U.S.C. 4101</ref> et seq.); or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695190-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/A/iv\"><num value=\"iv\">(iv)</num><content> owned by a foreign government or by an international organization.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83695191-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Schools providing flight training to members of Air Force</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The term “Federal property” includes, so long as not subject to taxation by any State or any political subdivision of a State, and whether or not that tax exemption is due to Federal agreement, law, or policy, any school providing flight training to members of the Air Force under contract with the Air Force at an airport owned by a State or political subdivision of a State.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83695192-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Non-Federal easements, leases, licenses, permits, improvements, and certain other real property</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “Federal property” includes, whether or not subject to taxation by a State or a political subdivision of a State—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695193-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/C/i\"><num value=\"i\">(i)</num><content> any non-Federal easement, lease, license, permit, or other such interest in Federal property as otherwise described in this paragraph, but not including any non-Federal fee-simple interest;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695194-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/C/ii\"><num value=\"ii\">(ii)</num><content> any improvement on Federal property as otherwise described in this paragraph; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695195-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/C/iii\"><num value=\"iii\">(iii)</num><content> real property that, immediately before its sale or transfer to a non-Federal party, was owned by the United States and otherwise qualified as Federal property described in this paragraph, but only for one year beyond the end of the fiscal year of such sale or transfer.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83695196-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Certain Postal Service property and pipelines and utility lines</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Notwithstanding any other provision of this paragraph, the term “Federal property” does not include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695197-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/D/i\"><num value=\"i\">(i)</num><content> any real property under the jurisdiction of the United States Postal Service that is used primarily for the provision of postal services; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id83695198-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/D/ii\"><num value=\"ii\">(ii)</num><content> pipelines and utility lines.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id83695199-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Property with respect to which State or local tax revenues may not be expended, allocated, or available for free public education</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Notwithstanding any other provision of this paragraph, “Federal property” does not include any property on which children reside that is otherwise described in this paragraph if—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369519a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/E/i\"><num value=\"i\">(i)</num><content> no tax revenues of the State or of any political subdivision of the State may be expended for the free public education of children who reside on that Federal property; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369519b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/E/ii\"><num value=\"ii\">(ii)</num><content> no tax revenues of the State are allocated or available for the free public education of such children.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8369519c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Property located in the State of Oklahoma owned by Indian housing authority for low-income housing</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “Federal property” includes any real property located in the State of Oklahoma that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369519d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/F/i\"><num value=\"i\">(i)</num><content> is owned by an Indian housing authority and used for low-income housing (including housing assisted under or authorized by the Native American Housing Assistance and Self-Determination Act of 1996 [<ref href=\"/us/usc/t25/s4101\">25 U.S.C. 4101</ref> et seq.]); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id8369519e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/F/ii\"><num value=\"ii\">(ii)</num><chapeau> at any time—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id8369519f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/F/ii/I\"><num value=\"I\">(I)</num><content> was designated by treaty as tribal land; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id836951a0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/5/F/ii/II\"><num value=\"II\">(II)</num><content> satisfied the definition of Federal property under <ref href=\"/us/act/1950-09-30/s403/1/A\">section 403(1)(A) of the Act of September 30, 1950</ref> (Public Law 874, 81st Congress) (as such Act was in effect on the day preceding <date date=\"1994-10-20\">October 20, 1994</date>).</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836951a1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Free public education</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “free public education” means education that is provided—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836951a2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/6/A\"><num value=\"A\">(A)</num><content> at public expense, under public supervision and direction, and without tuition charge; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836951a3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/6/B\"><num value=\"B\">(B)</num><chapeau> as elementary or secondary education, as determined under State law, except that, notwithstanding State law, such term—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836951a4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/6/B/i\"><num value=\"i\">(i)</num><content> includes preschool education; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836951ad-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/9/A/ii\"><num value=\"ii\">(ii)</num><content> includes any State agency that directly operates and maintains facilities for providing free public education.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id836951ae-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/9/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exception</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “local educational agency” does not include any agency or school authority that the Secretary determines on a case-by-case basis—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836951af-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/9/B/i\"><num value=\"i\">(i)</num><content> was constituted or reconstituted primarily for the purpose of receiving assistance under this subchapter or the Act of <date date=\"1950-09-30\">September 30, 1950</date> (Public Law 874, 81st Congress) (as such Act was in effect on the day preceding <date date=\"1994-10-20\">October 20, 1994</date>) or increasing the amount of such assistance; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id836951b0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/9/B/ii\"><num value=\"ii\">(ii)</num><content> is not constituted or reconstituted for legitimate educational purposes.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836951b1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Low-rent housing</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “low-rent housing” means housing located on property that is described in paragraph (5)(A)(iii).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836951b2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> Modernization</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “modernization” means repair, renovation, alteration, or construction, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836951b3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/11/A\"><num value=\"A\">(A)</num><content> the concurrent installation of equipment; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836951b4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/11/B\"><num value=\"B\">(B)</num><content> the complete or partial replacement of an existing school facility, but only if such replacement is less expensive and more cost-effective than repair, renovation, or alteration of the school facility.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836951b5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> Revenue derived from local sources</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “revenue derived from local sources” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836951b6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/12/A\"><num value=\"A\">(A)</num><content> revenue produced within the boundaries of a local educational agency and available to such agency for such agency’s use; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836951b7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/12/B\"><num value=\"B\">(B)</num><content> funds collected by another governmental unit, but distributed back to a local educational agency in the same proportion as such funds were collected as a local revenue source.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id836951b8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> School facilities</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “school facilities” includes—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id836951b9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7713/13/A\"><num value=\"A\">(A)</num><content> classrooms and related facilities;
