<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id836b9bd1-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824"><num value="7824">§ 7824.</num><heading> Consolidated set-aside for Department of the Interior funds</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836b9bd2-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/a"><num value="a" class="bold">(a)</num><heading class="bold"> General authority</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836b9bd3-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Transfer</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall transfer to the Department of the Interior, as a consolidated amount for covered programs, the Indian education programs under part A of subchapter VI, and the education for homeless children and youth program under subtitle B of title VII of the McKinney-Vento Homeless Assistance Act [<ref href="/us/usc/t42/s11431">42 U.S.C. 11431</ref> et seq.], the amounts allotted to the Department of the Interior under those programs.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836b9bd4-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Agreement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836b9bd5-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary and the Secretary of the Interior shall enter into an agreement, consistent with the requirements of the programs specified in paragraph (1), for the distribution and use of those program funds under terms that the Secretary determines best meet the purposes of those programs.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836b9bd6-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I13" class="indent2">The agreement shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836b9bd7-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/a/2/B/i"><num value="i">(i)</num><content> set forth the plans of the Secretary of the Interior for the use of the amount transferred and the achievement measures to assess program effectiveness, including program objectives; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836b9bd8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/a/2/B/ii"><num value="ii">(ii)</num><content> be developed in consultation with Indian tribes.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836b9bd9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/b"><num value="b" class="bold">(b)</num><heading class="bold"> Administration</heading><content><p style="-uslm-lc:I11" class="indent0">The Department of the Interior may use not more than 1.5 percent of the funds consolidated under this section for its costs related to the administration of the funds transferred under this section.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836b9bda-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/c"><num value="c" class="bold">(c)</num><heading class="bold"> Accountability system</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id836b9bdb-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/c/1"><num value="1">(1)</num><content> For the purposes of part A of subchapter I, the Secretary of Interior, in consultation with the Secretary, if the Secretary of the Interior requests the consultation, using a negotiated rulemaking process to develop regulations for implementation no later than the 2017-2018 academic year, shall define the standards, assessments, and accountability system consistent with <ref href="/us/usc/t20/s6311">section 6311 of this title</ref>, for the schools funded by the Bureau of Indian Education on a national, regional, or tribal basis, as appropriate, taking into account the unique circumstances and needs of such schools and the students served by such schools.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id836b9bdc-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/c/2"><num value="2">(2)</num><content> The tribal governing body or school board of a school funded by the Bureau of Indian Affairs may waive, in part or in whole, the requirements established pursuant to paragraph (1) where such requirements are determined by such body or school board to be inappropriate. If such requirements are waived, the tribal governing body or school board shall, within 60 days, submit to the Secretary of Interior a proposal for alternative standards, assessments, and an accountability system, if applicable, consistent with <ref href="/us/usc/t20/s6311">section 6311 of this title</ref>, that takes into account the unique circumstances and needs of such school or schools and the students served. The Secretary of the Interior and the Secretary shall approve such standards, assessments, and accountability system unless the Secretary determines that the standards, assessments, and accountability system do not meet the requirements of <ref href="/us/usc/t20/s6311">section 6311 of this title</ref>, taking into account the unique circumstances and needs of such school or schools and the students served.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id836b9bdd-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7824/c/3"><num value="3">(3)</num><heading> <inline class="small-caps">Technical assistance</inline>.—</heading><content>The Secretary of Interior and the Secretary shall, either directly or through a contract, provide technical assistance, upon request, to a tribal governing body or school board of a school funded by the Bureau of Indian Affairs that seeks a waiver under paragraph (2).</content>
