<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id836e0c43-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861"><num value="7861">§ 7861.</num><heading> Waivers of statutory and regulatory requirements</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836e0c44-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c45-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Request for waiver by State or Indian tribe</heading><content><p style="-uslm-lc:I12" class="indent1">A State educational agency or Indian tribe that receives funds under a program authorized under this chapter may submit a request to the Secretary to waive any statutory or regulatory requirement of this chapter.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c46-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Local educational agency and school requests submitted through the State</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c47-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Request for waiver by local educational agency</heading><content><p style="-uslm-lc:I13" class="indent2">A local educational agency that receives funds under a program authorized under this chapter and desires a waiver of any statutory or regulatory requirement of this chapter shall submit a request containing the information described in subsection (b)(1) to the appropriate State educational agency. The State educational agency may then submit the request to the Secretary if the State educational agency determines the waiver appropriate.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c48-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Request for waiver by school</heading><content><p style="-uslm-lc:I13" class="indent2">An elementary school or secondary school that desires a waiver of any statutory or regulatory requirement of this chapter shall submit a request containing the information described in subsection (b)(1) to the local educational agency serving the school. The local educational agency may then submit the request to the State educational agency in accordance with subparagraph (A) if the local educational agency determines the waiver appropriate.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c49-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Receipt of waiver</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in subsection (b)(4) or (c), the Secretary may waive any statutory or regulatory requirement of this chapter for which a waiver request is submitted to the Secretary pursuant to this subsection.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836e0c4a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b"><num value="b" class="bold">(b)</num><heading class="bold"> Request for waiver</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c4b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">A State educational agency, acting on its own behalf or on behalf of a local educational agency in accordance with subsection (a)(2), or Indian tribe that desires a waiver shall submit a waiver request to the Secretary, which shall include a plan that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c4c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/1/A"><num value="A">(A)</num><content> identifies the Federal programs affected by the requested waiver;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c4d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/1/B"><num value="B">(B)</num><content> describes which Federal statutory or regulatory requirements are to be waived;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c4e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/1/C"><num value="C">(C)</num><content> describes how the waiving of such requirements will advance student academic achievement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c4f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/1/D"><num value="D">(D)</num><content> describes the methods the State educational agency, local educational agency, school, or Indian tribe will use to monitor and regularly evaluate the effectiveness of the implementation of the plan;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c50-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/1/E"><num value="E">(E)</num><content> includes only information directly related to the waiver request; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c51-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/1/F"><num value="F">(F)</num><content> describes how schools will continue to provide assistance to the same populations served by programs for which waivers are requested and, if the waiver relates to provisions of subsections (b) or (h) of <ref href="/us/usc/t20/s6311">section 6311 of this title</ref>, describes how the State educational agency, local educational agency, school, or Indian tribe will maintain or improve transparency in reporting to parents and the public on student achievement and school performance, including the achievement of the subgroups of students identified in <ref href="/us/usc/t20/s6311/b/2/B/xi">section 6311(b)(2)(B)(xi) of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c52-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Additional information</heading><chapeau style="-uslm-lc:I12" class="indent1">Such requests—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c53-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/2/A"><num value="A">(A)</num><content> may provide for waivers of requirements applicable to State educational agencies, local educational agencies, Indian tribes, and schools; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c54-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/2/B"><num value="B">(B)</num><chapeau> shall be developed and submitted—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836e0c55-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/2/B/i"><num value="i">(i)</num><subclause style="-uslm-lc:I14" class="indent3" id="id836e0c56-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/2/B/i/I"><num value="I">(I)</num><content> by local educational agencies (on behalf of those agencies and schools) to State educational agencies; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id836e0c57-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/2/B/i/II"><num value="II">(II)</num><content> by State educational agencies (on behalf of those agencies or on behalf of, and based on the requests of, local educational agencies in the State) to the Secretary; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c58-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/2/B/ii"><num value="ii">(ii)</num><content> by Indian tribes (on behalf of schools operated by the tribes) to the Secretary.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c59-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> General requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c5a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> State educational agencies</heading><chapeau style="-uslm-lc:I13" class="indent2">In the case of a waiver request submitted by a State educational agency acting on its own behalf, or on behalf of local educational agencies in the State under subsection (a)(2), the State educational agency shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836e0c5b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3/A/i"><num value="i">(i)</num><content> provide the public and any interested local educational agency in the State with notice and a reasonable opportunity to comment and provide input on the request, to the extent that the request impacts the local educational agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c5c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3/A/ii"><num value="ii">(ii)</num><content> submit the comments and input to the Secretary, with a description of how the State addressed the comments and input; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c5d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3/A/iii"><num value="iii">(iii)</num><content> provide notice and a reasonable time to comment to the public and local educational agencies in the manner in which the applying agency customarily provides similar notice and opportunity to comment to the public.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c5e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Local educational agencies</heading><chapeau style="-uslm-lc:I13" class="indent2">In the case of a waiver request submitted by a local educational agency that receives funds under this chapter—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836e0c5f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3/B/i"><num value="i">(i)</num><content> the request shall be reviewed and approved by the State educational agency in accordance with subsection (a)(2) before being submitted to the Secretary and be accompanied by the comments, if any, of the State educational agency and the public; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c60-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/3/B/ii"><num value="ii">(ii)</num><content> notice and a reasonable opportunity to comment regarding the waiver request shall be provided to the State educational agency and the public by the agency requesting the waiver in the manner in which that agency customarily provides similar notice and opportunity to comment to the public.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c61-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Waiver determination, demonstration, and revision</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c62-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall issue a written determination regarding the initial approval or disapproval of a waiver request not more than 120 days after the date on which such request is submitted. Initial disapproval of such request shall be based on the determination of the Secretary that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836e0c63-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/A/i"><num value="i">(i)</num><content> the waiver request does not meet the requirements of this section;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c64-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/A/ii"><num value="ii">(ii)</num><content> the waiver is not permitted under subsection (c);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c65-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/A/iii"><num value="iii">(iii)</num><content> the description required under paragraph (1)(C) in the plan provides insufficient information to demonstrate that the waiving of such requirements will advance student academic achievement consistent with the purposes of this chapter; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c66-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/A/iv"><num value="iv">(iv)</num><content> the waiver request does not provide for adequate evaluation to ensure review and continuous improvement of the plan.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c67-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Waiver determination and revision</heading><chapeau style="-uslm-lc:I13" class="indent2">Upon the initial determination of disapproval under subparagraph (A), the Secretary shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836e0c68-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/B/i"><num value="i">(i)</num><chapeau> immediately—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id836e0c69-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/B/i/I"><num value="I">(I)</num><content> notify the State educational agency, local educational agency (through the State educational agency), school (through the local educational agency), or Indian tribe, as applicable, of such determination; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id836e0c6a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/B/i/II"><num value="II">(II)</num><content> provide detailed reasons for such determination in writing to the applicable entity under subclause (I) to the public, such as posting in a clear and easily accessible format to the Department’s website;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c6b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/B/ii"><num value="ii">(ii)</num><content> offer the State educational agency, local educational agency (through the State educational agency), school (through the local educational agency), or Indian tribe an opportunity to revise and resubmit the waiver request by a date that is not more than 60 days after the date of such determination; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c6c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/B/iii"><num value="iii">(iii)</num><content> if the Secretary determines that the resubmission under clause (ii) does not meet the requirements of this section, at the request of the State educational agency, local educational agency, school, or Indian tribe, conduct a hearing not more than 30 days after the date of such resubmission.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c6d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Waiver disapproval</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary may ultimately disapprove a waiver request if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836e0c6e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/C/i"><num value="i">(i)</num><content> the State educational agency, local educational agency, school, or Indian tribe has been notified and offered an opportunity to revise and resubmit the waiver request, as described under clauses (i) and (ii) of subparagraph (B); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c6f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/C/ii"><num value="ii">(ii)</num><chapeau> the State educational agency, local educational agency (through the State educational agency), school (through the local educational agency), or Indian tribe—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id836e0c70-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/C/ii/I"><num value="I">(I)</num><content> does not revise and resubmit the waiver request; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id836e0c71-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/C/ii/II"><num value="II">(II)</num><content> revises and resubmits the waiver request, and the Secretary determines that such waiver request does not meet the requirements of this section after a hearing conducted under subparagraph (B)(iii), if such a hearing is requested.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id836e0c72-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/b/4/D"><num value="D" class="bold">(D)</num><heading class="bold"> External conditions</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall not disapprove a waiver request under this section based on conditions outside the scope of the waiver request.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836e0c73-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c"><num value="c" class="bold">(c)</num><heading class="bold"> Restrictions</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall not waive under this section any statutory or regulatory requirements relating to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c74-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/1"><num value="1">(1)</num><content> the allocation or distribution of funds to States, local educational agencies, Indian tribes, or other recipients of funds under this chapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c75-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/2"><num value="2">(2)</num><content> maintenance of effort;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c76-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/3"><num value="3">(3)</num><content> comparability of services;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c77-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/4"><num value="4">(4)</num><content> use of Federal funds to supplement, not supplant, non-Federal funds;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c78-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/5"><num value="5">(5)</num><content> equitable participation of private school students and teachers;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c79-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/6"><num value="6">(6)</num><content> parental participation and involvement;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c7a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/7"><num value="7">(7)</num><content> applicable civil rights requirements;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c7b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/8"><num value="8">(8)</num><content> the requirement for a charter school under part C of subchapter IV;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c7c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/9"><num value="9">(9)</num><chapeau> the prohibitions—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c7d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/9/A"><num value="A">(A)</num><content> in subpart 2 of part F;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c7e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/9/B"><num value="B">(B)</num><content> regarding use of funds for religious worship or instruction in <ref href="/us/usc/t20/s7885">section 7885 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c7f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/9/C"><num value="C">(C)</num><content> regarding activities in <ref href="/us/usc/t20/s7906">section 7906 of this title</ref>; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c80-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/c/10"><num value="10">(10)</num><content> the selection of a school attendance area or school under subsections (a) and (b) of <ref href="/us/usc/t20/s6313">section 6313 of this title</ref>, except that the Secretary may grant a waiver to allow a school attendance area or school to participate in activities under part A of subchapter I if the percentage of children from low-income families in the school attendance area or who attend the school is not more than 10 percentage points below the lowest percentage of those children for any school attendance area or school of the local educational agency that meets the requirements of subsections (a) and (b) of <ref href="/us/usc/t20/s6313">section 6313 of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836e0c81-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d"><num value="d" class="bold">(d)</num><heading class="bold"> Duration and extension of waiver; limitations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c82-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2), a waiver approved by the Secretary under this section may be for a period not to exceed 4 years.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c83-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Extension</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may extend the period described in paragraph (1) if the State demonstrates that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c84-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/2/A"><num value="A">(A)</num><content> the waiver has been effective in enabling the State or affected recipient to carry out the activities for which the waiver was requested and the waiver has contributed to improved student achievement; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c85-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/2/B"><num value="B">(B)</num><content> the extension is in the public interest.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id836e0c86-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Specific limitations</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall not require a State educational agency, local educational agency, school, or Indian tribe, as a condition of approval of a waiver request, to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c87-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3/A"><num value="A">(A)</num><content> include in, or delete from, such request, specific academic standards, such as the Common Core State Standards developed under the Common Core State Standards Initiative or any other standards common to a significant number of States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c88-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3/B"><num value="B">(B)</num><content> use specific academic assessment instruments or items, including assessments aligned to the standards described in subparagraph (A); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id836e0c89-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3/C"><num value="C">(C)</num><chapeau> include in, or delete from, such waiver request any specific elements of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id836e0c8a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3/C/i"><num value="i">(i)</num><content> State academic standards;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c8b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3/C/ii"><num value="ii">(ii)</num><content> academic assessments;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c8c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3/C/iii"><num value="iii">(iii)</num><content> State accountability systems; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id836e0c8d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/d/3/C/iv"><num value="iv">(iv)</num><content> teacher and school leader evaluation systems.</content>
</clause>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836e0c8e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/e"><num value="e" class="bold">(e)</num><heading class="bold"> Reports</heading><chapeau style="-uslm-lc:I11" class="indent0">A State educational agency, local educational agency, school, or Indian tribe receiving a waiver under this section shall describe, as part of, and pursuant to, the required annual reporting under <ref href="/us/usc/t20/s6311/h">section 6311(h) of this title</ref>—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c8f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/e/1"><num value="1">(1)</num><content> the progress of schools covered under the provisions of such waiver toward improving student academic achievement; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id836e0c90-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/e/2"><num value="2">(2)</num><content> how the use of the waiver has contributed to such progress.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836e0c91-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/f"><num value="f" class="bold">(f)</num><heading class="bold"> Termination of waivers</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall terminate a waiver under this section if, after notice and an opportunity for a hearing, the Secretary—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id836e0c92-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/f/A"><num value="A">(A)</num><content> presents a rationale and supporting information that clearly demonstrates that the waiver is not contributing to the progress of schools described in subsection (e)(1); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id836e0c93-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/f/B"><num value="B">(B)</num><content> determines that the waiver is no longer necessary to achieve its original purposes.</content>
</subparagraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id836e0c94-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7861/g"><num value="g" class="bold">(g)</num><heading class="bold"> Publication</heading><content><p style="-uslm-lc:I11" class="indent0">A notice of the Secretary’s decision to grant each waiver under subsection (a) shall be published in the Federal Register and the Secretary shall provide for the dissemination of the notice to State educational agencies, interested parties, including educators, parents, students, advocacy and civil rights organizations, and the public.</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Applicable Provisions of Law.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Streamlined waivers</inline>.—</heading><chapeau>The Secretary shall create an expedited application process to request a waiver and the Secretary may waive any statutory or regulatory requirements for a State educational agency (related to assessments, accountability, and reporting requirements related to assessments and accountability), if the Secretary determines that such a waiver is necessary and appropriate as described in subsection (a), under the following provisions of law:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><chapeau> The following provisions under section 1111 of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s6311">20 U.S.C. 6311</ref>):</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> Paragraphs (2) and (3) of subsection (b).</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Applicability to charter schools</inline>.—</heading><chapeau>Any waivers issued by the Secretary under this section shall be implemented, as applicable—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> for all public schools, including public charter schools within the boundaries of the recipient of the waiver;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> in accordance with State charter school law; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> pursuant to section 1111(c)(5) of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s6311/c/5">20 U.S.C. 6311(c)(5)</ref>).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Limitation</inline>.—</heading><content>Nothing in this section shall be construed to allow the Secretary to waive any statutory or regulatory requirements under applicable civil rights laws.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><heading> <inline class="small-caps">Accountability and improvement</inline>.—</heading><content>Any school located in a State that receives a waiver under paragraph (1) and that is identified for comprehensive support and improvement, targeted support and improvement, or additional targeted support in the 2019–2020 school year under section 1111(c)(4)(D) or section 1111(d)(2) of the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s6311/c/4/D">20 U.S.C. 6311(c)(4)(D)</ref> or (d)(2)) shall maintain that identification status in the 2020–2021 school year and continue to receive supports and interventions consistent with the school’s support and improvement plan in the 2020–2021 school year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">State and Local Requests for Waivers.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>A State educational agency, local educational agency, or Indian tribe that desires a waiver from any statutory or regulatory provision described under subsection (b)(2), may submit a waiver request to the Secretary in accordance with this subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Requests submitted</inline>.—</heading><chapeau>A request for a waiver under this subsection shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> identify the Federal programs affected by the requested waiver;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> describe which Federal statutory or regulatory requirements are to be waived;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> describe how the emergency involving Federal primary responsibility determined to exist by the President under the [sic] section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5191/b">42 U.S.C. 5191(b)</ref>) with respect to the Coronavirus Disease 2019 (COVID–19) prevents or otherwise restricts the ability of the State, State educational agency, local educational agency, Indian tribe, or school to comply with such statutory or regulatory requirements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> provide an assurance that the State educational agency, local educational agency, or Indian tribe will work to mitigate any negative effects, if any, that may occur as a result of the requested waiver.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Secretary approval.—</inline></heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>Except as provided under subparagraph (B), the Secretary shall approve or disapprove a waiver request submitted under paragraph (1) not more than 30 days after the date on which such request is submitted.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Exceptions</inline>.—</heading><chapeau>The Secretary may disapprove a waiver request submitted under paragraph (1), only if the Secretary determines that—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> the waiver request does not meet the requirements of this section;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> the waiver is not permitted pursuant to subsection (b)(2); or</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> the description required under paragraph (2)(C) provides insufficient information to demonstrate that the waiving of such requirements is necessary or appropriate consistent with subsection (a).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Duration</inline>.—</heading><content>A waiver approved by the Secretary under this section may be for a period not to exceed the 2019–2020 academic year, except to carry out full implementation of any maintenance of effort waivers granted during the 2019–2020 academic year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Reporting and Publication.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Public notice</inline>.—</heading><content>A State educational agency, Indian Tribe, or local educational agency requesting a waiver under subsection (b)(2) shall provide the public and all local educational agencies in the State with notice of, and the opportunity to comment on, the request by posting information regarding the waiver request and the process for commenting on the State website.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Notifying congress</inline>.—</heading><content>Not later than 7 days after granting a waiver under this section, the Secretary shall notify the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Appropriations of the Senate, the Committee on Education and Labor of the House of Representatives, and the Committee on Appropriations of the House of Representatives of such waiver.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Publication</inline>.—</heading><content>Not later than 30 days after granting a waiver under this section, the Secretary shall publish a notice of the Secretary’s decision (including which waiver was granted and the reason for granting the waiver) in the Federal Register and on the website of the Department of Education.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Report</inline>.—</heading><content>Not later than 30 days after the date of enactment of this Act [<date date="2020-03-27">Mar. 27, 2020</date>], the Secretary shall prepare and submit a report to the Committee on Health, Education, Labor, and Pensions and the Committee on Appropriations of the Senate, and the Committee on Education and Labor and the Committee on Appropriations of the House of Representatives, with recommendations on any additional waivers under the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1401">20 U.S.C. 1401</ref> [1400] et seq.), the Rehabilitation Act of 1973 (<ref href="/us/usc/t29/s701">29 U.S.C. 701</ref> et seq.), the Elementary and Secondary Education Act of 1965 (<ref href="/us/usc/t20/s6301">20 U.S.C. 6301</ref> et seq.), and the Carl D. Perkins Career and Technical Education Act of 2006 (<ref href="/us/usc/t20/s2301">20 U.S.C. 2301</ref> et seq.) the Secretary believes are necessary to be enacted into law to provide limited flexibility to States and local educational agencies to meet the needs of students during the emergency involving Federal primary responsibility determined to exist by the President under section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5191/b">42 U.S.C. 5191(b)</ref>) with respect to the Coronavirus Disease 2019 (COVID–19).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Terms</inline>.—</heading><content>In this section, the term ‘State educational agency’ includes the Bureau of Indian Education, and the term ‘local educational agency’ includes Bureau of Indian Education funded schools operated pursuant to a grant under the Tribally Controlled Schools Act of 1988 (<ref href="/us/usc/t25/s2501">25 U.S.C. 2501</ref> et seq.), or a contract under the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5301">25 U.S.C. 5301</ref> et seq.).”</content>
