value=\"7943\">§ 7943.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this subpart:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id837eae36-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Economic loss</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “economic loss” means any pecuniary loss resulting from harm (including the loss of earnings or other benefits related to employment, medical expense loss, replacement services loss, loss due to death, burial costs, and loss of business or employment opportunities) to the extent recovery for such loss is allowed under applicable State law.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id837eae37-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Harm</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “harm” includes physical, nonphysical, economic, and noneconomic losses.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id837eae38-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Noneconomic loss</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “noneconomic loss” means loss for physical or emotional pain, suffering, inconvenience, physical impairment, mental anguish, disfigurement, loss of enjoyment of life, loss of society or companionship, loss of consortium (other than loss of domestic service), hedonic damages, injury to reputation, or any other nonpecuniary loss of any kind or nature.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id837eae39-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> School</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “school” means a public or private kindergarten, a public or private elementary school or secondary school, or a home school.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id837eae3a-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> State</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State” means each of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, any other territory or possession of the United States, or any political subdivision of any such State, territory, or possession.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id837eae3b-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Teacher</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “teacher” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id837eae3c-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/A\"><num value=\"A\">(A)</num><content> a teacher, instructor, principal, or administrator;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id837eae3d-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/B\"><num value=\"B\">(B)</num><content> another educational professional who works in a school;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id837eae3e-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/C\"><num value=\"C\">(C)</num><chapeau> a professional or nonprofessional employee who—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id837eae3f-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/C/i\"><num value=\"i\">(i)</num><content> works in a school; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id837eae40-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/C/ii\"><num value=\"ii\">(ii)</num><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id837eae41-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/C/ii/I\"><num value=\"I\">(I)</num><content> in the employee’s job, maintains discipline or ensures safety; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id837eae42-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/C/ii/II\"><num value=\"II\">(II)</num><content> in an emergency, is called on to maintain discipline or ensure safety; or</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id837eae43-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s7943/6/D\"><num value=\"D\">(D)</num><content> an individual member of a school board (as distinct from the
