<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id837eae4b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7945"><num value="7945">§ 7945.</num><heading> Preemption and election of State nonapplicability</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id837eae4c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7945/a"><num value="a" class="bold">(a)</num><heading class="bold"> Preemption</heading><content><p style="-uslm-lc:I11" class="indent0">This subpart preempts the laws of any State to the extent that such laws are inconsistent with this subpart, except that this subpart shall not preempt any State law that provides additional protection from liability relating to teachers.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id837eae4d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7945/b"><num value="b" class="bold">(b)</num><heading class="bold"> Election of State regarding nonapplicability</heading><chapeau style="-uslm-lc:I11" class="indent0">This subpart shall not apply to any civil action in a State court against a teacher with respect to claims arising within that State if such State enacts a statute in accordance with State requirements for enacting legislation—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id837eae4e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7945/b/1"><num value="1">(1)</num><content> citing the authority of this subsection;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id837eae4f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7945/b/2"><num value="2">(2)</num><content> declaring the election of such State that this subpart shall not apply, as of a date certain, to such civil action in the State; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id837eae50-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7945/b/3"><num value="3">(3)</num><content> containing no other provisions.</content>
