<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id837eae54-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946"><num value="7946">§ 7946.</num><heading> Limitation on liability for teachers</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id837eae55-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a"><num value="a" class="bold">(a)</num><heading class="bold"> Liability protection for teachers</heading><chapeau style="-uslm-lc:I11" class="indent0">Except as provided in subsection (b), no teacher in a school shall be liable for harm caused by an act or omission of the teacher on behalf of the school if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id837eae56-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a/1"><num value="1">(1)</num><content> the teacher was acting within the scope of the teacher’s employment or responsibilities to a school or governmental entity;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id837eae57-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a/2"><num value="2">(2)</num><content> the actions of the teacher were carried out in conformity with Federal, State, and local laws (including rules and regulations) in furtherance of efforts to control, discipline, expel, or suspend a student or maintain order or control in the classroom or school;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id837eae58-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a/3"><num value="3">(3)</num><content> if appropriate or required, the teacher was properly licensed, certified, or authorized by the appropriate authorities for the activities or practice involved in the State in which the harm occurred, where the activities were or practice was undertaken within the scope of the teacher’s responsibilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83811f59-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a/4"><num value="4">(4)</num><content> the harm was not caused by willful or criminal misconduct, gross negligence, reckless misconduct, or a conscious, flagrant indifference to the rights or safety of the individual harmed by the teacher; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83811f5a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a/5"><num value="5">(5)</num><chapeau> the harm was not caused by the teacher operating a motor vehicle, vessel, aircraft, or other vehicle for which the State requires the operator or the owner of the vehicle, craft, or vessel to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83811f5b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a/5/A"><num value="A">(A)</num><content> possess an operator’s license; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83811f5c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/a/5/B"><num value="B">(B)</num><content> maintain insurance.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83811f5d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/b"><num value="b" class="bold">(b)</num><heading class="bold"> Exceptions to teacher liability protection</heading><chapeau style="-uslm-lc:I11" class="indent0">If the laws of a State limit teacher liability subject to one or more of the following conditions, such conditions shall not be construed as inconsistent with this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id83811f5e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/b/1"><num value="1">(1)</num><content> A State law that requires a school or governmental entity to adhere to risk management procedures, including mandatory training of teachers.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83811f5f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/b/2"><num value="2">(2)</num><content> A State law that makes the school or governmental entity liable for the acts or omissions of its teachers to the same extent as an employer is liable for the acts or omissions of its employees.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83811f60-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/b/3"><num value="3">(3)</num><content> A State law that makes a limitation of liability inapplicable if the civil action was brought by an officer of a State or local government pursuant to State or local law.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83811f61-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/c"><num value="c" class="bold">(c)</num><heading class="bold"> Limitation on punitive damages based on the actions of teachers</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811f62-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> General rule</heading><content><p style="-uslm-lc:I12" class="indent1">Punitive damages may not be awarded against a teacher in an action brought for harm based on the act or omission of a teacher acting within the scope of the teacher’s employment or responsibilities to a school or governmental entity unless the claimant establishes by clear and convincing evidence that the harm was proximately caused by an act or omission of such teacher that constitutes willful or criminal misconduct, or a conscious, flagrant indifference to the rights or safety of the individual harmed.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811f63-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Construction</heading><content><p style="-uslm-lc:I12" class="indent1">Paragraph (1) does not create a cause of action for punitive damages and does not preempt or supersede any Federal or State law to the extent that such law would further limit the award of punitive damages.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83811f64-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/d"><num value="d" class="bold">(d)</num><heading class="bold"> Exceptions to limitations on liability</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811f65-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The limitations on the liability of a teacher under this subpart shall not apply to any misconduct that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83811f66-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/d/1/A"><num value="A">(A)</num><content> constitutes a crime of violence (as that term is defined in <ref href="/us/usc/t18/s16">section 16 of title 18</ref>) or act of international terrorism (as that term is defined in <ref href="/us/usc/t18/s2331">section 2331 of title 18</ref>) for which the defendant has been convicted in any court;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83811f67-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/d/1/B"><num value="B">(B)</num><content> involves a sexual offense, as defined by applicable State law, for which the defendant has been convicted in any court;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83811f68-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/d/1/C"><num value="C">(C)</num><content> involves misconduct for which the defendant has been found to have violated a Federal or State civil rights law; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83811f69-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/d/1/D"><num value="D">(D)</num><content> where the defendant was under the influence (as determined pursuant to applicable State law) of intoxicating alcohol or any drug at the time of the misconduct.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811f6a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Hiring</heading><content><p style="-uslm-lc:I12" class="indent1">The limitations on the liability of a teacher under this subpart shall not apply to misconduct during background investigations, or during other actions, involved in the hiring of a teacher.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83811f6b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/e"><num value="e" class="bold">(e)</num><heading class="bold"> Rules of construction</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811f6c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Concerning responsibility of teachers to schools and governmental entities</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this section shall be construed to affect any civil action brought by any school or any governmental entity against any teacher of such school.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811f6d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7946/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Concerning corporal punishment</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subpart shall be construed to affect any State or local law (including a rule or regulation) or policy pertaining to the use of corporal punishment.</p>
