<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6cfc18cc-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947"><num value="7947">§ 7947.</num><heading> Allocation of responsibility for noneconomic loss</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6cfc18cd-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947/a"><num value="a" class="bold">(a)</num><heading class="bold"> General rule</heading><content><p style="-uslm-lc:I11" class="indent0">In any civil action against a teacher, based on an act or omission of a teacher acting within the scope of the teacher’s employment or responsibilities to a school or governmental entity, the liability of the teacher for noneconomic loss shall be determined in accordance with subsection (b).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6cfc18ce-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947/b"><num value="b" class="bold">(b)</num><heading class="bold"> Amount of liability</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6cfc18cf-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6cfc18d0-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Liability</heading><content><p style="-uslm-lc:I13" class="indent2">Each defendant who is a teacher shall be liable only for the amount of noneconomic loss allocated to that defendant in direct proportion to the percentage of responsibility of that defendant (determined in accordance with paragraph (2)) for the harm to the claimant with respect to which that defendant is liable.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id6cfc18d1-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Separate judgment</heading><content><p style="-uslm-lc:I13" class="indent2">The court shall render a separate judgment against each defendant in an amount determined pursuant to subparagraph (A).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id6cfc18d2-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Percentage of responsibility</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of determining the amount of noneconomic loss allocated to a defendant who is a teacher under this section, the trier of fact shall determine the percentage of responsibility of each person responsible for the claimant’s harm, whether or not such person is a party to the action.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id6cfc18d3-d2f2-11e9-aa7d-f436298d01bb" identifier="/us/usc/t20/s7947/c"><num value="c" class="bold">(c)</num><heading class="bold"> Rule of construction</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to preempt or supersede any Federal or State law that further limits the application of joint liability in a civil action described in subsection (a), beyond the limitations established in this section.</p>
