<chapeau style="-uslm-lc:I11" class="indent0">As used in this subpart: <ref class="footnoteRef" idref="fn002221">1</ref><note type="footnote" id="fn002221"><num>1</num> See References in Text note below.</note></chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811fa8-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/1"><num value="1" class="bold">(1)</num><heading class="bold"> Children</heading><content><p style="-uslm-lc:I12" class="indent1">The term “children” means individuals who have not attained the age of 18.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811fa9-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/2"><num value="2" class="bold">(2)</num><heading class="bold"> Children’s services</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “children’s services” means the provision on a routine or regular basis of health, day care, education, or library services—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83811faa-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/2/A"><num value="A">(A)</num><chapeau> that are funded, after <date date="2002-01-08">January 8, 2002</date>, directly by the Federal Government or through State or local governments, by Federal grant, loan, loan guarantee, or contract programs—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83811fab-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/2/A/i"><num value="i">(i)</num><content> administered by either the Secretary of Health and Human Services or the Secretary of Education (other than services provided and funded solely under titles XVIII and XIX of the Social Security Act [<ref href="/us/usc/t42/s1395">42 U.S.C. 1395</ref> et seq., 1396 et seq.]); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83811fac-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/2/A/ii"><num value="ii">(ii)</num><content> administered by the Secretary of Agriculture in the case of a clinic (as defined in part 246.2 of title 7, Code of Federal Regulations (or any corresponding similar regulation or ruling)) under section 17(b)(6) of the Child Nutrition Act of 1966 [<ref href="/us/usc/t42/s1786/b/6">42 U.S.C. 1786(b)(6)</ref>]; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83811fad-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/2/B"><num value="B">(B)</num><content> that are provided in indoor facilities that are constructed, operated, or maintained with such Federal funds, as determined by the appropriate head of a Federal agency in any enforcement action carried out under this subpart,<sup>1</sup></content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">except that nothing in clause (ii) of subparagraph (A) is intended to include facilities (other than clinics) where coupons are redeemed under the Child Nutrition Act of 1966 [<ref href="/us/usc/t42/s1771">42 U.S.C. 1771</ref> et seq.].</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811fae-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/3"><num value="3" class="bold">(3)</num><heading class="bold"> Indoor facility</heading><content><p style="-uslm-lc:I12" class="indent1">The term “indoor facility” means a building that is enclosed.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83811faf-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s7972/4"><num value="4" class="bold">(4)</num><heading class="bold"> Person</heading><content><p style="-uslm-lc:I12" class="indent1">The term “person” means any State or local subdivision of a State, agency of such State or subdivision, corporation, or partnership that owns or operates or otherwise controls and provides children’s services or any individual who owns or operates or otherwise controls and provides such services.</p>
