L. 115–410, § 10, Dec. 31, 2018, 132 Stat. 5416.)","seq_in_title":1879,"parent_identifier":"/us/usc/t20/ch72/schII/pt1","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch72","level":"chapter","num":"CHAPTER 72—","heading":"MUSEUM AND LIBRARY SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch72/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"LIBRARY SERVICES AND TECHNOLOGY","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch72/schII/pt1","level":"part","num":"Part 1—","heading":"Basic Program Requirements","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8391c0f8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131\"><num value=\"9131\">§ 9131.</num><heading> Reservations and allotments</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8391c0f9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Reservations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8391c0fa-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">From the amount appropriated under the authority of <ref href=\"/us/usc/t20/s9123\">section 9123 of this title</ref> for any fiscal year, the Director—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8391c0fb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/a/1/A\"><num value=\"A\">(A)</num><content> shall reserve 2.25 percent to award grants in accordance with <ref href=\"/us/usc/t20/s9161\">section 9161 of this title</ref>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8391c0fc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/a/1/B\"><num value=\"B\">(B)</num><content> shall reserve 3.75 percent to award national leadership grants or contracts in accordance with <ref href=\"/us/usc/t20/s9162\">section 9162 of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8391c0fd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Special rule</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If the funds reserved pursuant to paragraph (1)(B) for a fiscal year have not been obligated by the end of such fiscal year, then such funds shall be allotted in accordance with subsection (b) for the fiscal year succeeding the fiscal year for which the funds were so reserved.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8391c0fe-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Allotments</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8391c0ff-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">From the sums appropriated under the authority of <ref href=\"/us/usc/t20/s9123\">section 9123 of this title</ref> and not reserved under subsection (a) for any fiscal year, the Director shall award grants from minimum allotments, as determined under paragraph (3), to each State. Any sums remaining after minimum allotments are made for such year shall be allotted in the manner set forth in paragraph (2).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8391c100-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Remainder</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">From the remainder of any sums appropriated under the authority of <ref href=\"/us/usc/t20/s9123\">section 9123 of this title</ref> that are not reserved under subsection (a) and not allotted under paragraph (1) for any fiscal year, the Director shall award grants to each State in an amount that bears the same relation to such remainder as the population of the State bears to the population of all States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8391c101-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Minimum allotments</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8391c102-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this subsection, the minimum allotment for each State shall be $680,000, except that the minimum allotment shall be $60,000 in the case of the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8391c103-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Ratable reductions</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Notwithstanding subparagraph (A), if the sum appropriated under the authority of <ref href=\"/us/usc/t20/s9123\">section 9123 of this title</ref> and not reserved under subsection (a) for any fiscal year is insufficient to fully satisfy the requirement of subparagraph (A), each of the minimum allotments under such subparagraph shall be reduced ratably.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8391c104-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Exception</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id8391c105-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Notwithstanding subparagraph (A), if the sum appropriated under the authority of <ref href=\"/us/usc/t20/s9123\">section 9123 of this title</ref> and not reserved under subsection (a) for any fiscal year exceeds the aggregate of the allotments for all States under this subsection for fiscal year 2019—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id8391c106-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3/C/i/I\"><num value=\"I\">(I)</num><content> the minimum allotment for each State otherwise receiving a minimum allotment of $680,000 under subparagraph (A) shall be increased to $1,000,000; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id8391c107-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3/C/i/II\"><num value=\"II\">(II)</num><content> the minimum allotment for each State otherwise receiving a minimum allotment of $60,000 under subparagraph (A) shall be increased to $100,000.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id8391c108-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/3/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Insufficient funds to award alternative minimum</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">If the sum appropriated under the authority of <ref href=\"/us/usc/t20/s9123\">section 9123 of this title</ref> and not reserved under subsection (a) for any fiscal year exceeds the aggregate of the allotments for all States under this subsection for fiscal year 2019, yet is insufficient to fully satisfy the requirement of clause (i), such excess amount shall first be allotted among the States described in clause (i)(I) so as to increase equally the minimum allotment for each such State above $680,000. After the requirement of clause (i)(I) is fully satisfied for any fiscal year, any remainder of such excess amount shall be allotted among the States described in clause (i)(II) so as to increase equally the minimum allotment for each such State above $60,000.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8391c109-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9131/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Data</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The population of each State and of all the States shall be determined by the Director on the basis of the most recent data available from the Bureau of the Census.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id8391c10a-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/94/462/tII/s221\">Pub. Prior to amendment, text read as follows:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">“(A) <inline class=\"small-caps\">In general</inline>.—For the purposes of this subsection, the minimum allotment for each State shall be $340,000, except that the minimum allotment shall be $40,000 in the case of the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">“(B) <inline class=\"small-caps\">Ratable reductions</inline>.—If the sum appropriated under the authority of <ref href=\"/us/usc/t20/s9123\">section 9123 of this title</ref> and not reserved under subsection (a) of this section for any fiscal year is insufficient to fully satisfy the aggregate of the minimum allotments for all States for that purpose for such year, each of such minimum allotments shall be reduced ratably.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">“(C) <inline class=\"small-caps\">Special rule.—</inline></p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">“(i) <inline class=\"small-caps\">In general</inline>.—Notwithstanding any other provision of this subsection and using funds allotted for the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau under this subsection, the Director shall award grants to Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, or the Republic of Palau to carry out activities described in this subchapter in accordance with the provisions of this subchapter that the Director determines are not inconsistent with this subparagraph.</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">“(ii) <inline class=\"small-caps\">Award basis</inline>.—The Director shall award grants pursuant to clause (i) on a competitive basis and pursuant to recommendations from the Pacific Region Educational Laboratory in Honolulu, Hawaii.</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">“(iii) <inline class=\"small-caps\">Termination of eligibility</inline>.—Notwithstanding any other provision of law, the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau shall not receive any funds under this subchapter for any fiscal year that begins after <date date=\"2001-09-30\">September 30, 2001</date>.</p>\n<p style=\"-uslm-lc:I22\" class=\"indent1\">“(iv) <inline class=\"small-caps\">Administrative costs</inline>.—The Director may provide not more than 5 percent of the funds made available for grants under this subparagraph to pay the administrative costs of the Pacific Region Educational Laboratory regarding activities assisted under this subparagraph.”</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">1997—Subsec.
