<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8391c124-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134"><num value="9134">§ 9134.</num><heading> State plans</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8391c125-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/a"><num value="a" class="bold">(a)</num><heading class="bold"> State plan required</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8391c126-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In order to be eligible to receive a grant under this subchapter, a State library administrative agency shall submit a State plan to the Director once every 5 years, as determined by the Director.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8391c127-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Duration</heading><content><p style="-uslm-lc:I12" class="indent1">The State plan shall cover a period of 5 fiscal years.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8391c128-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Revisions</heading><content><p style="-uslm-lc:I12" class="indent1">If a State library administrative agency makes a substantive revision to its State plan, then the State library administrative agency shall submit to the Director an amendment to the State plan containing such revision not later than April 1 of the fiscal year preceding the fiscal year for which the amendment will be effective.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8391c129-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b"><num value="b" class="bold">(b)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I11" class="indent0">The State plan shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8391c12a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/1"><num value="1">(1)</num><content> establish goals, and specify priorities, for the State consistent with the purposes of this subchapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8391c12b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/2"><num value="2">(2)</num><content> describe activities that are consistent with the goals and priorities established under paragraph (1), the purposes of this subchapter, and <ref href="/us/usc/t20/s9141">section 9141 of this title</ref>, that the State library administrative agency will carry out during such year using such grant;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8391c12c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/3"><num value="3">(3)</num><content> describe the procedures that such agency will use to carry out the activities described in paragraph (2);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8394322d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/4"><num value="4">(4)</num><content> describe the methodology that such agency will use to evaluate the success of the activities established under paragraph (2) in achieving the goals and meeting the priorities described in paragraph (1);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8394322e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/5"><num value="5">(5)</num><content> describe the procedures that such agency will use to involve libraries and library users throughout the State in policy decisions regarding implementation of this subchapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8394322f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6"><num value="6">(6)</num><chapeau> describe how the State library administrative agency will work with other State agencies and offices where appropriate to coordinate resources, programs, and activities and leverage, but not replace, the Federal and State investment in—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83943230-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/A"><num value="A">(A)</num><content> programs and activities under the Elementary and Secondary Education Act of 1965 [<ref href="/us/usc/t20/s6301">20 U.S.C. 6301</ref> et seq.] (including programs and activities under subparts 2 and 3 of part B of title II [<ref href="/us/usc/t20/s6641">20 U.S.C. 6641</ref> et seq., 6661 et seq.], and parts A and B of title IV [<ref href="/us/usc/t20/s7101">20 U.S.C. 7101</ref> et seq., 7171 et seq.], of such Act);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83943231-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/B"><num value="B">(B)</num><chapeau> early childhood education, including coordination with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83943232-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/B/i"><num value="i">(i)</num><content> the State’s activities carried out under subsections (b)(4) and (e)(1) of <ref href="/us/usc/t42/s9837">section 9837 of title 42</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83943233-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/B/ii"><num value="ii">(ii)</num><content> the activities described in the State’s strategic plan in accordance with <ref href="/us/usc/t42/s9837b/a/4/B/i">section 9837b(a)(4)(B)(i) of title 42</ref>;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83943234-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/C"><num value="C">(C)</num><chapeau> workforce development, including coordination with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83943235-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/C/i"><num value="i">(i)</num><content> the activities carried out by the State workforce development board under section 101 of the Workforce Innovation and Opportunity Act [<ref href="/us/usc/t29/s3111">29 U.S.C. 3111</ref>];</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83943236-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/C/ii"><num value="ii">(ii)</num><content> the State’s one-stop delivery system established under section 121(e) of such Act [<ref href="/us/usc/t29/s3151/e">29 U.S.C. 3151(e)</ref>]; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83943237-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/C/iii"><num value="iii">(iii)</num><content> the activities carried out by the State in support of adult education and literacy under title II of such Act [<ref href="/us/usc/t29/s3271">29 U.S.C. 3271</ref> et seq.]; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83943238-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/6/D"><num value="D">(D)</num><content> other Federal programs and activities that relate to library services, including economic, business, and community development, health information, critical thinking skills, digital literacy skills, financial literacy and other types of literacy skills;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id83943239-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/7"><num value="7">(7)</num><content> provide assurances that the State will comply with subsection (f); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id8394323a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/b/8"><num value="8">(8)</num><content> provide assurances satisfactory to the Director that such agency will make such reports, in such form and containing such information, as the Director may reasonably require to carry out this subchapter and to determine the extent to which funds provided under this subchapter have been effective in carrying out the purposes of this subchapter.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8394323b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/c"><num value="c" class="bold">(c)</num><heading class="bold"> Evaluation and report</heading><content><p style="-uslm-lc:I11" class="indent0">Each State library administrative agency receiving a grant under this subchapter shall independently evaluate, and report to the Director regarding, the activities assisted under this subchapter, prior to the end of the 5-year plan.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8394323c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/d"><num value="d" class="bold">(d)</num><heading class="bold"> Information</heading><content><p style="-uslm-lc:I11" class="indent0">Each library receiving assistance under this subchapter shall submit to the State library administrative agency such information as such agency may require to meet the requirements of subsection (c).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id8394323d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e"><num value="e" class="bold">(e)</num><heading class="bold"> Approval</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8394323e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Director shall approve any State plan under this subchapter that meets the requirements of this subchapter and provides satisfactory assurances that the provisions of such plan will be carried out.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8394323f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Public availability</heading><content><p style="-uslm-lc:I12" class="indent1">Each State library administrative agency receiving a grant under this subchapter shall make the State plan available to the public, including through electronic means.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83943240-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Administration</heading><chapeau style="-uslm-lc:I12" class="indent1">If the Director determines that the State plan does not meet the requirements of this section, the Director shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83943241-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e/3/A"><num value="A">(A)</num><content> immediately notify the State library administrative agency of such determination and the reasons for such determination;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83943242-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e/3/B"><num value="B">(B)</num><content> offer the State library administrative agency the opportunity to revise its State plan;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83943243-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e/3/C"><num value="C">(C)</num><content> provide technical assistance in order to assist the State library administrative agency in meeting the requirements of this section; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id83943244-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/e/3/D"><num value="D">(D)</num><content> provide the State library administrative agency the opportunity for a hearing.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id83943245-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f"><num value="f" class="bold">(f)</num><heading class="bold"> Internet safety</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83943246-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">No funds made available under this subchapter for a library described in section 9122(1)(A) or (B) of this title that does not receive services at discount rates under <ref href="/us/usc/t47/s254/h/6">section 254(h)(6) of title 47</ref> may be used to purchase computers used to access the Internet, or to pay for direct costs associated with accessing the Internet, for such library unless—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id83943247-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/A"><num value="A">(A)</num><chapeau> such library—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83943248-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/A/i"><num value="i">(i)</num><chapeau> has in place a policy of Internet safety for minors that includes the operation of a technology protection measure with respect to any of its computers with Internet access that protects against access through such computers to visual depictions that are—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id83943249-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/A/i/I"><num value="I">(I)</num><content> obscene;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8394324a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/A/i/II"><num value="II">(II)</num><content> child pornography; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8394324b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/A/i/III"><num value="III">(III)</num><content> harmful to minors; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8394324c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/A/ii"><num value="ii">(ii)</num><content> is enforcing the operation of such technology protection measure during any use of such computers by minors; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id8394324d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/B"><num value="B">(B)</num><chapeau> such library—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8394324e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/B/i"><num value="i">(i)</num><chapeau> has in place a policy of Internet safety that includes the operation of a technology protection measure with respect to any of its computers with Internet access that protects against access through such computers to visual depictions that are—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id8394324f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/B/i/I"><num value="I">(I)</num><content> obscene; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id83943250-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/B/i/II"><num value="II">(II)</num><content> child pornography; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83943251-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/1/B/ii"><num value="ii">(ii)</num><content> is enforcing the operation of such technology protection measure during any use of such computers.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83943252-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Access to other materials</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subsection shall be construed to prohibit a library from limiting Internet access to or otherwise protecting against materials other than those referred to in subclauses (I), (II), and (III) of paragraph (1)(A)(i).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83943253-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Disabling during certain use</heading><content><p style="-uslm-lc:I12" class="indent1">An administrator, supervisor, or other authority may disable a technology protection measure under paragraph (1) to enable access for bona fide research or other lawful purposes.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id83943254-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Timing and applicability of implementation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83943255-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">A library covered by paragraph (1) shall certify the compliance of such library with the requirements of paragraph (1) as part of the application process for the next program funding year under this subchapter following the effective date of this subsection, and for each subsequent program funding year thereafter.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83943256-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Process</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id83943257-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Libraries with Internet safety policies and technology protection measures in place</heading><content><p style="-uslm-lc:I14" class="indent3">A library covered by paragraph (1) that has in place an Internet safety policy meeting the requirements of paragraph (1) shall certify its compliance with paragraph (1) during each annual program application cycle under this subchapter.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id83943258-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Libraries without Internet safety policies and technology protection measures in place</heading><chapeau style="-uslm-lc:I14" class="indent3">A library covered by paragraph (1) that does not have in place an Internet safety policy meeting the requirements of paragraph (1)—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id83943259-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4/B/ii/I"><num value="I">(I)</num><content> for the first program year after the effective date of this subsection in which the library applies for funds under this subchapter, shall certify that it is undertaking such actions, including any necessary procurement procedures, to put in place an Internet safety policy that meets such requirements; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id8394325a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4/B/ii/II"><num value="II">(II)</num><content> for the second program year after the effective date of this subsection in which the library applies for funds under this subchapter, shall certify that such library is in compliance with such requirements.</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> Any library covered by paragraph (1) that is unable to certify compliance with such requirements in such second program year shall be ineligible for all funding under this subchapter for such second program year and all subsequent program years until such time as such library comes into compliance with such requirements.</continuation>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id8394325b-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/4/B/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Waivers</heading><content><p style="-uslm-lc:I14" class="indent3">Any library subject to a certification under clause (ii)(II) that cannot make the certification otherwise required by that clause may seek a waiver of that clause if State or local procurement rules or regulations or competitive bidding requirements prevent the making of the certification otherwise required by that clause. The library shall notify the Director of the Institute of Museum and Library Services of the applicability of that clause to the library. Such notice shall certify that the library will comply with the requirements in paragraph (1) before the start of the third program year after the effective date of this subsection for which the library is applying for funds under this subchapter.</p>
</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id8394325c-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/5"><num value="5" class="bold">(5)</num><heading class="bold"> Noncompliance</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8394325d-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> Use of General Education Provisions Act remedies</heading><chapeau style="-uslm-lc:I13" class="indent2">Whenever the Director of the Institute of Museum and Library Services has reason to believe that any recipient of funds this <ref class="footnoteRef" idref="fn002226">1</ref><note type="footnote" id="fn002226"><num>1</num> So in original. Probably should be preceded by “under”.</note> subchapter is failing to comply substantially with the requirements of this subsection, the Director may—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id8394325e-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/5/A/i"><num value="i">(i)</num><content> withhold further payments to the recipient under this subchapter,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id8394325f-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/5/A/ii"><num value="ii">(ii)</num><content> issue a complaint to compel compliance of the recipient through a cease and desist order, or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83943260-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/5/A/iii"><num value="iii">(iii)</num><content> enter into a compliance agreement with a recipient to bring it into compliance with such requirements.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83943261-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Recovery of funds prohibited</heading><content><p style="-uslm-lc:I13" class="indent2">The actions authorized by subparagraph (A) are the exclusive remedies available with respect to the failure of a library to comply substantially with a provision of this subsection, and the Director shall not seek a recovery of funds from the recipient for such failure.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83943262-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Recommencement of payments</heading><content><p style="-uslm-lc:I13" class="indent2">Whenever the Director determines (whether by certification or other appropriate evidence) that a recipient of funds who is subject to the withholding of payments under subparagraph (A)(i) has cured the failure providing the basis for the withholding of payments, the Director shall cease the withholding of payments to the recipient under that subparagraph.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id83943266-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Harmful to minors</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “harmful to minors” means any picture, image, graphic image file, or other visual depiction that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id83943267-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/7/B/i"><num value="i">(i)</num><content> taken as a whole and with respect to minors, appeals to a prurient interest in nudity, sex, or excretion;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83943268-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/7/B/ii"><num value="ii">(ii)</num><content> depicts, describes, or represents, in a patently offensive way with respect to what is suitable for minors, an actual or simulated sexual act or sexual contact, actual or simulated normal or perverted sexual acts, or a lewd exhibition of the genitals; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id83943269-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/7/B/iii"><num value="iii">(iii)</num><content> taken as a whole, lacks serious literary, artistic, political, or scientific value as to minors.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id8394326a-3b28-11eb-8459-b1d1037aec5b" identifier="/us/usc/t20/s9134/f/7/C"><num value="C" class="bold">(C)</num><heading class="bold"> Minor</heading><content><p style="-uslm-lc:I13" class="indent2">The term “minor” means an individual who has not attained the age of 17.</p>
