L. 115–410, § 18, Dec. 31, 2018, 132 Stat. 5420.)","seq_in_title":1891,"parent_identifier":"/us/usc/t20/ch72/schIII","ancestors":[{"identifier":"/us/usc/t20","level":"title","num":"Title 20—","heading":"EDUCATION","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch72","level":"chapter","num":"CHAPTER 72—","heading":"MUSEUM AND LIBRARY SERVICES","status":null,"is_section":false},{"identifier":"/us/usc/t20/ch72/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"MUSEUM SERVICES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8398ecc6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173\"><num value=\"9173\">§ 9173.</num><heading> Museum services activities</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8398ecc7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Director, subject to the policy advice of the Museum and Library Services Board, may enter into arrangements, including grants, contracts, cooperative agreements, and other forms of assistance, with museums, States, local governments, and other entities as the Director considers appropriate, to pay the Federal share of the cost of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecc8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/1\"><num value=\"1\">(1)</num><content> supporting museums in providing learning and access to collections, information, and educational resources in a variety of formats (including exhibitions, programs, publications, and websites) for individuals of all ages;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecc9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/2\"><num value=\"2\">(2)</num><content> supporting museums in building learning partnerships with the Nation’s schools, including tribal schools, and developing museum resources, capabilities, and programs in support of State and local efforts to offer a well-rounded educational experience to all students;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecca-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/3\"><num value=\"3\">(3)</num><chapeau> supporting the conservation and preservation of museum collections, including efforts to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398eccb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/3/A\"><num value=\"A\">(A)</num><content> provide optimal conditions for storage, exhibition, and use;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398eccc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/3/B\"><num value=\"B\">(B)</num><content> prepare for and respond to disasters and emergency situations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398eccd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/3/C\"><num value=\"C\">(C)</num><content> establish endowments for conservation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecce-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/3/D\"><num value=\"D\">(D)</num><content> curate, stabilize, and organize object-related information; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398eccf-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/3/E\"><num value=\"E\">(E)</num><content> train museum staff in collections care;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecd0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/4\"><num value=\"4\">(4)</num><content> supporting efforts at the State level to leverage museum resources, including statewide assessments of museum services and needs and development of State plans to improve and maximize museum services through the State;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecd1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/5\"><num value=\"5\">(5)</num><content> creating shared technology tools and data resources, and developing museum staff training plans to improve and maximize museum services through organizations such as museum associations, professional networks, community-based organizations, and foundations, and through other collaborative mechanisms;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecd2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6\"><num value=\"6\">(6)</num><chapeau> stimulating greater collaboration, in order to share resources and strengthen communities, among museums and—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecd3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6/A\"><num value=\"A\">(A)</num><content> libraries;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecd4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6/B\"><num value=\"B\">(B)</num><content> schools;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecd5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6/C\"><num value=\"C\">(C)</num><content> institutions of higher education;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecd6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6/D\"><num value=\"D\">(D)</num><content> international, Federal, State, regional, tribal, and local agencies or organizations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecd7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6/E\"><num value=\"E\">(E)</num><content> nongovernmental organizations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecd8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6/F\"><num value=\"F\">(F)</num><content> other community organizations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8398ecd9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/6/G\"><num value=\"G\">(G)</num><content> other relevant research and policy organizations;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecda-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/7\"><num value=\"7\">(7)</num><content> encouraging the use of new and emerging technologies and media, including new ways to disseminate information, engage varied audiences in experiential learning, and support teachers and students to enhance access to and engagement with museum collections, programs, and services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecdb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/8\"><num value=\"8\">(8)</num><content> supporting museums in developing, carrying out, and providing programs and services that meet the needs of communities throughout the Nation, including people of diverse geographic, cultural, and socioeconomic backgrounds, individuals with disabilities, residents of rural and urban areas, Native Americans, military families, veterans, and caregivers, and for State institutions;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecdc-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/9\"><num value=\"9\">(9)</num><content> supporting professional development and technical assistance programs to enhance museum operations, and the skills of museum staff, at all levels, and to support the development of the next generation of museum leaders and professionals, in order to ensure the highest standards in all aspects of museum operations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecdd-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/10\"><num value=\"10\">(10)</num><content> supporting museums in research, program evaluation, and the collection and dissemination of information to museum professionals and the public;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecde-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/11\"><num value=\"11\">(11)</num><content> encouraging, supporting, and disseminating model programs of museum and library collaboration;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ecdf-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/12\"><num value=\"12\">(12)</num><content> enabling museums to serve as anchor institutions to support community revitalization and the creation of opportunities for advancement; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8398ece0-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/a/13\"><num value=\"13\">(13)</num><content> developing public and private partnerships with other agencies and community-based organizations to expand and enhance museum services.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8398ece1-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Federal share</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8398ece2-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> 50 percent</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraph (2), the Federal share described in subsection (a) shall be not more than 50 percent.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8398ece3-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Greater than 50 percent</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Director may use not more than 20 percent of the funds made available under this subchapter for a fiscal year to enter into arrangements under subsection (a) for which the Federal share may be greater than 50 percent.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8398ece4-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Operational expenses</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No funds for operational expenses may be provided under this section to any entity that is not a museum.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8398ece5-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Review and evaluation</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8398ece6-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Director shall establish procedures for reviewing and evaluating arrangements described in subsection (a) entered into under this subchapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8398ece7-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Grant distribution</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In awarding grants, the Director shall take into consideration the equitable distribution of grants to museums of various types and sizes and to different geographic areas of the United States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id8398ece8-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Applications for technical assistance</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8398ece9-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/c/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Director may use not more than 10 percent of the funds appropriated to carry out this subchapter for technical assistance.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id8398ecea-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/c/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Individual museums</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Individual museums may receive not more than 3 technical assistance awards under subparagraph (A). Subsequent awards for technical assistance shall be subject to review outside the Institute.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8398eceb-3b28-11eb-8459-b1d1037aec5b\" identifier=\"/us/usc/t20/s9173/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Services for Native Americans</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">From amounts appropriated under <ref href=\"/us/usc/t20/s9176\">section 9176 of this title</ref>, the Director shall reserve 2.25 percent to award grants to, or enter into contracts or cooperative agreements with, Indian tribes and organizations that primarily serve and represent Native Hawaiians (as defined in <ref href=\"/us/usc/t20/s7517\">section 7517 of this title</ref>), to enable such tribes and organizations to carry out the activities described in subsection (a).</p>\n</content>\n</subsection>\n<sourceCredit id=\"id8398ecec-3b28-11eb-8459-b1d1037aec5b\">(<ref href=\"/us/pl/94/462/tII/s274\">Pub.
